USSC Upholds Trump Travel Ban

Yes, the President has the authority to block people from coming into the country

Let's start with this. It was totally expected that the Administration (and Presidential authority in general) would win the day. The only real question was whether or not the ruling would somehow "temper" the travel ban in order to garner additional Justices. Obviously the ruling did not wallow into the areas of grey, but rather stuck with the black and white core of the issue. Ultimately the court upheld not only this particular ban specifically, but also the President's authority to place limits on immigration and travel in general.


This obviously is a bitter blow to those who suggested that Trump should not have the authority to make these decisions, or that he should be required to "run it by a Judge" before making these sort of executive calls. The Justices made it crystal clear (much like other cases this session) that it is not up to the courts to provide personal opinions regarding the merits of certain actions, but rather it is only up to the courts to decide the fundamental legality or constitutionality of an action.

The constitution and federal law makes it crystal clear that the President of the United States (whether that be Barack Obama or Donald Trump) has the authority to make judgement calls regarding who can and cannot enter our country. The decision today makes it even clearer that the personal opinions of any particular judge is legally irrelevant.

Rep. Keith Ellison (D-MN) suggested Tuesday morning that Supreme Court Justice Neil Gorsuch had been bribed, after the Court handed down a 5-4 decision upholding President Donald Trump’s “travel ban” as constitutional.
Gorsuch, who joined the Court’s majority, had “done what his paymasters sent him there to do,” Ellison told CNN.

Ellison, who is deputy chair of the Democratic National Committee, had earlier compared the decision in Trump v. Hawaii to the Supreme Court’s infamous Dred Scott decision, which upheld slavery in the pre-Civil War era:

In the 5-4 opinion penned by Chief Justice John Roberts, the court found that Trump's immigration restriction fell "squarely" within the president's authority. The court rejected claims that the ban was motivated by religious hostility.

"The [order] is expressly premised on legitimate purposes: preventing entry of nationals who cannot be adequately vetted and inducing other nations to improve their practices," Roberts wrote. "The text says nothing about religion"

The authority of the President to control the borders and who comes and goes is what was confirmed here with this decision. Their was no legal considerations for the constitutional rights of non-Americans.

The President can issue an executive order to put a temporary halt to any immigration, asylum, and any other travel from non-Americans from any country from Mexico down to Central America.

The exact same legal considerations would exist, and the USSC would ultimately overrule whatever idiot Federal Judge who (once again) chooses to ignore the constitution, federal law, and USSC precedent and rule against Trump as a matter of "resistance".

if you possessed the intellect and reading comprehension to understand the actual statute, it applies to whatever country or set of countries trump wishes to ban. including third world shitholes like guatemala, honduras, nicaragua, mexico, venezuela, and wherever the fuck else trump would like to impose a restriction.

Here’s the text of the opinion. And note this from the majority opinion:

Finally, the dissent invokes Korematsu v. United States, 323 U. S. 214 (1944). Whatever rhetorical advantage the dissent may see in doing so, Korematsu has nothing to do with this case. The forcible relocation of U. S. citizens to concentration camps, solely and explicitly on the basis of race, is objectively unlawful and outside the scope of Presidential authority. But it is wholly inapt to liken that morally repugnant order to a facially neutral policy denying certain foreign nationals the privilege of admission. See post, at 26–28. Ouch. I believe this is also a formal overruling of Korematsu, since it’s signed by 5 justices. Note that FDR’s action is properly characterized here as racist.

Nothing has changed. Every President has had the right to use travel bans and most of them have done so. The idiocy is that four of our USSC Justic es believed that we should effectively ignore the law and constitution (simply because they hate Trump).

This is why it was so important for Trump to win. Neil Gorsuch!!!

We cannot afford more partisan Justices who believe that they are entitled to overturn the constitution and the laws because they "feel" like it.
