Kavanaugh or Hardiman

It's Kavanaugh


First impressions. He seems like a real guy. Coaches his daughter's sports teams. Volunteers at the church. Feeds the homeless. Also seems nervous during his speech, which was actually short of appealing in a down to earth way. 

Right off the bat, the left is up in arms. He might do this, he might do that. On CNN they were actually arguing that he might rule the same way Kennedy did on Obamacare (if it ever came back around) and that it might matter if Roberts changed his vote.

Think about that twisted logic for a second. If the same case came around again (they never do) and one Justice changes his mind (um... why?) then Kavanaugh is unacceptable because he would vote like Kennedy?  Anyways...  apparently, the only acceptable pick from a Republican President replacing a conservative Justice is to find someone "less conservative".  Of course, if that's all you got, then you got shit. 

Bigger problems will be placating people like Paul Rand... sorry um... Rand Paul who suggests that he has doubts about some of this rulings and at one point stated he wasn't sure he could support him (but now had done an about face and claims to have an open mind). I doubt you will lose Collins, much less Murkowski on this one. But there is going to be a fight. No doubt about it.

To be clear, we are looking at one source, second hand, who saw Kavanaugh in a black limo. Oh, and Hardiman is in D.C. for a conference, so it is entirely coincidence. But multiple sources say that Comey and Kethledge are no longer on the list, so it does appear that it is narrowed to two. 

I am actually surprised that the secret has not been let out of the bag with a White House so full of leakers, huh?  But given the President may have not actually made a decision but a few hours ago, there may have just not been enough people in the know to have leaked the nominee at this point.

Sean Hannity has become the preeminent advisor of choice by the President. Hannity is opposed to Kavanaugh. The last person who has been with the President while he decides will probably be a clear winner.

President Trump has decided on his nominee to the Supreme Court after spending Monday morning working the phones primarily seeking input about two judges who were said to be the finalists, Brett M. Kavanaugh and Thomas M. Hardiman, people familiar with the discussions said.

Those who discussed the president’s decision, and spoke on the condition of anonymity, did not disclose the name of the president’s selection.

Mr. Trump had been going back and forth between Judge Kavanaugh, the favorite of the White House counsel, Donald F. McGahn II, and Judge Hardiman, whom the president’s sister, Maryanne Trump Barry, a former colleague of Judge Hardiman’s, has pressed him to choose.

Two other candidates for the seat of the retiring Justice Anthony M. Kennedy — Judge Amy Coney Barrett and Judge Raymond Kethledge — were not the focus of Mr. Trump’s morning discussions, according to those familiar with the discussions.

The drama-focused president is going to announce his choice for the Kennedy seat in a Monday night address to the country at 9 p.m. He said on Sunday that he hoped to have made a decision by noon on Monday.

The president has been lobbied in the final hours of his selection process by both supporters and opponents of the four candidates, all of whom are federal appeals court judge with conservative records.

Judge Barrett, the only woman under consideration, has the support of Sean Hannity, the Fox News host and close Trump ally, who played golf with the president in New Jersey on Sunday.

Mr. Kethledge also has supporters. But he has a comparatively thin record of judicial opinions, and some conservatives have voiced concerns that he could turn out to be similar to Justice David Souter, who was appointed to the court by President George H.W. Bush but sometimes sided with the court’s liberals. Mr. Kethledge’s rulings in an immigration case have brought criticism from conservatives like the commentator Ann Coulter. And Judge Hardiman, the first in his family to graduate from college, has the kind of personal story that appeals to many Trump supporters.

But it is Judge Kavanaugh who has been the focus of much of the lobbying, both for and against him. Besides Mr. McGahn, he has the support of some Republicans who admire his record as a lawyer working with the independent counsel Kenneth W. Starr in the investigation of President Bill Clinton and later in the George W. Bush White House as well as his conservative record as a judge.

But that element of his record is among the reasons that some Republicans in Congress are concerned about a confirmation hearing in the Senate. Others have expressed concern about how Judge Kavanaugh would vote on cases related to the Affordable Care Act. Senator Mitch McConnell, the majority leader, has tried to warn the president through gentle nudging that Judge Hardiman and Judge Kethledge would be the safest choices for confirmation.


I still think it's Kavanaugh.

His speech was very good. I got a feeling from what he said about judicial decisions need to make common sense that he won't be a 100% dependable conservative and original intent as the bottom line.

But I believe that the President should be excused from some of the burdens of ordinary citizenship while serving in office,” argued Kavanaugh in the law review article. He then asserted that “the indictment and trial of a sitting President, moreover, would cripple the federal government, rendering it unable to function with credibility in either the international or domestic arenas. Such an outcome would ill serve the public interest, especially in times of financial or national security crisis.”

He should not be seated on the Supreme Court.

Kavanaugh has said in a dissent to a ruling giving illegal immigrant children abortions that are often the result of rape or incest that "a new right for unlawful immigrant minors in U.S. government detention to obtain immediate abortion on demand."

Liberals are right to be worried that Roe may be overturned. It is such a badly reasoned decision with no justification in law and the Constitution the if subject was anything else it would already be overturned.

It is decision that takes human life without due process in clear violation of the 14th amendment.

if a woman was actually exercising some level of control over her own body, she'd actually figure out how NOT to get knocked up in the first place using the myriad of birth control available .
