Mueller To Congress: I’ll Pass On Being Politicized, Thanks Just The Same
Special counsel Robert Mueller’s team has expressed reticence to him testifying publicly in front of the House Judiciary Committee, according to sources familiar with the matter.
The special counsel’s team has expressed the notion that Mueller does not want to appear political after staying behind the scenes for two years and not speaking as he conducted his investigation into President Donald Trump. One option is to have him testify behind closed doors, but sources caution numerous options are being considered in the negotiations between the committee and the special counsel’s team.

I don't mean to beat a dead horse here, but it's unlikely that Robert Mueller has much to say that is going to help the Democrats here. Pretty much everything they might "want" him to say, is exactly what their "faithful" believe anyways. So him saying it (or not saying it) really will have no relevance to much of anything. Democrats and the anti-Trumpers read a 440 page report that said there was no evidence of conspiracy or coordination, took a couple of days to absorb that, and then came back and insisted that there still was conspiracy and coordination.

You cannot fix stupid.

The truth is that Mueller signed his name to a 440 plus page report that was nearly two years in the making. He isn't going to take the time to write out such a detailed report only to come back a few weeks later and tell us that he really meant to write something else, but just didn't.
  • Mueller would testify that he did not find evidence of conspiracy or coordination, because that is what he wrote in his report.
  • Mueller would testify that he did not come to a conclusion about obstruction, because that is what he wrote in his report.
The reality is that Mueller wouldn't really have much choice but to stand by his report 100% even if he really didn't, and there is actually no tangible reason to suggest that he doesn't still stand by his report 100%. Mueller does not seem like the sort of person who would put in all of this work and then write something he didn't believe. Moreover, to the degree that Mueller's report was swayed by other opinions, it's likely those opinions came from people who are more anti-Trump than he is. If anything, his personal opinions might be on the conservative side of all of this. 

The real problems for Mueller and his testimony would not come from Democrats hammering him on why he didn't recommend obstruction charges, but rather from Republicans who would hammer him on why he picked special counsel investigators who worked personally with the Clintons, were attorneys for the Clintons, or were big donors and supporters of the Clintons. He would be asked to what degree "he" relied on opposition research to fuel his investigation, and he would be questioned rather harshly on when it became clear that there was not going to be a finding of conspiracy, and why it took him so long to share that with the public. 

The potential for Democrats to "score points" during a Mueller hearing would rely on the pipe-dream that Mueller doesn't believe what he wrote. The potential for Republicans to "score points" would rely on the fact that he probably "does" believe what he wrote.

President Trump went off on Twitter early this morning about the chorus of Democratic calls to bring forth impeachment proceedings against him, claiming that Democrats want a “do over” of special counsel Robert Mueller’s investigation, NBC News reports.

Said Trump: “Everything the Democrats are asking me for is based on an illegally started investigation that failed for them, especially when the Mueller Report came back with a NO COLLUSION finding. Now they say Impeach President Trump, even though he did nothin wrong, while they ‘fish!'”

He added: “After two years of an expensive and comprehensive Witch Hunt, the Democrats don’t like the result and they want a DO OVER. In other words, the Witch Hunt continues!”

A new Monmouth poll finds 73% of Americans say that special counsel Robert Mueller should appear before Congress to testify about his investigation. This includes 58% who say that Mueller should appear at a public hearing and 14% who say that it should only be in a closed setting.

The survey also finds 67% say that former White House counsel Don McGahn should appear before Congress to testify about what he knew as a key witness in the investigation. This includes 56% who say that McGahn should appear at a public hearing and 10% who say that it should only be in a closed setting.

In addition, 69% say that Congress should get a full version of the Mueller report along with supporting documents.

“It’s obviously an incredible waste of money,” said Robert Weissman, president of the group Public Citizen. He then quipped: “Of course, the more time he spends golfing, the less time he spends governing, the better.”

The $102 million total to date spent on Trump’s presidential golfing represents 255 times the annual presidential salary he volunteered not to take. It is more than three times the cost of special counsel Robert Mueller’s investigation that Trump continually complains about. It would fund for six years the Special Olympics program that Trump’s proposed budget had originally cut to save money.

President Trump abruptly canceled a meeting with Democratic leaders on Wednesday, saying he was unable to work with them on legislation following comments by House Speaker Nancy Pelosi (D-Calif.) that he was “engaged in a cover-up.”

Trump made an unscheduled appearance in the Rose Garden shortly afterward and in a meandering 10-minute address said he had left the meeting with Pelosi and Senate Minority Leader Charles E. Schumer (D-N.Y.) at which they were supposed to talk about working together on a $2 billion infrastructure plan.

“Instead of walking in happily to a meeting, I walk in to look at people who said I was doing a cover-up,” Trump said, adding that he can’t work on infrastructure “under these circumstances.”

Pelosi made her comments earlier Wednesday morning during a closed-door meeting with House Democrats called to discuss ongoing investigations of Trump and his administration. Despite her accusation of a cover-up, Pelosi and all but one of her six committee chairmen with investigatory powers tamped down talk of impeachment proceedings during the meeting.

A growing number of rank-and-file Democrats have called for the launch of an impeachment inquiry against Trump as frustrations build over the administration’s stonewalling of congressional probes.

But during Wednesday’s meeting, five of the chairmen who addressed the caucus focused on recent successes in court battles to force the administration to comply with subpoenas and counseled a more measured course advocated by Pelosi, according to multiple people in the room.

The meeting “reflected where most of this caucus is at,” said Rep. Dean Phillips (D-Minn.). “Have faith on the courts and have faith in process, and impeachment only if absolutely necessary.”

Addressing reporters afterward, Pelosi said Democrats had “a very positive meeting” and called for staying the course on investigations.

“We do believe that it’s important to follow the facts,” she said. “We believe that no one is above the law, including the president of the United States. And we believe the president of the United States is engaged in a cover-up.”

In remarks to fellow Democrats during the meeting, Pelosi, according to multiple members, showed no sign of moving away from her approach.

“Stay the course,” said Rep. Sean Patrick Maloney (D-N.Y.), summarizing Pelosi’s remarks.

After the meeting, Rep. Lois Frankel (D-Fla.) argued that the committees should continue investigating and that Democrats should focus on legislation, saying that “the impeachment question is taking up all the oxygen in the room.”

“Look, in my mind, even if we impeach, the Senate isn’t going to do anything about it … so what is our goal?” she asked. “If we don’t want Trump to be the president … we’ve got to get him in 2020.”

During the meeting, House Financial Services Chairwoman Maxine Waters (D-Calif.) was the only one of the chairmen to call for moving forward with impeachment proceedings, a stance consistent with her past advocacy for seeking to remove Trump.

While other chairmen said they were outraged by Trump’s conduct, several offered reasons to follow Pelosi’s lead. House Oversight and Reform Committee Chairman Elijah E. Cummings (D-Md.), for instance, warned that some freshmen lawmakers in swing districts could lose races if Democrats are too aggressive in pursuing impeachment.

Ahead of the meeting, Trump aimed a barrage of early-morning tweets at House Democrats questioning their priorities as they prepared to discuss investigations into the administration amid the growing calls for impeachment proceedings.

In his tweets, Trump claimed that Democrats are “getting ZERO work done in Congress” and are instead focused on what he called a continuation of a “Witch Hunt” into whether he sought to obstruct special counsel Robert S. Mueller III’s investigation into Russian interference in the 2016 presidential election.

Monday night, a band of frustrated House Judiciary Committee members — including powerful chairman Jerrold Nadler (D-N.Y.) — confronted Pelosi on her no-impeachment position and encouraged her to green-light an inquiry.

Pelosi refused, arguing that the caucus is not behind the move and that it would impede other committees in pursuing their investigations.Pro-impeachment members, however, argue that an impeachment inquiry will enable investigators to more quickly secure documents and witness testimony that the White House has blocked at every turn. Since Monday, about 25 lawmakers have gone public to call for an inquiry to begin.

To ease the pressure and the tension, Pelosi has privately signaled that she will green-light more aggressive investigative measures, according to several lawmakers. They expect her and her leadership team to schedule a contempt vote in June against Attorney General William P. Barr and potentially former White House counsel Donald McGahn, who failed to comply with a Hill subpoena, as well as Treasury Secretary Steven Mnuchin, who has denied Congress’s request for Trump’s tax returns.

Pelosi, these lawmakers say, is also talking about so-called “inherent contempt” in a real way. That includes potentially tweaking House rules to allow chairmen to slap steep fines on Trump
officials who ignore subpoenas.

Since taking control of the House in January, Democrats have passed several legislative measures, including bills on health care and ethics reform, that have not been taken up in the Republican-led Senate.

The tension over stepped-up House oversight of Trump comes amid continuing discussions of one potential issue on which both Trump and Pelosi have expressed hope for cooperation: investing in the country’s ailing infrastructure. Trump is scheduled to meet later Tuesday morning on the subject with Pelosi, Senate Minority Leader Charles E. Schumer (D-N.Y.) and others.

“Hopefully they’re going to have a come-to-Jesus moment where they realize what a terrible idea this is,” Sanders said of the planned Democratic caucus meeting.

In his morning tweets, Trump continued to question why Democrats were interested in hearing the testimony from his aides and others who were interviewed as part of Mueller’s investigation.

Mueller’s report concluded that the Russian government interfered in the 2016 presidential election “in sweeping and systematic fashion.”
The report did not find sufficient evidence to bring charges of criminal conspiracy with Russia against Trump or anyone associated with his campaign. It did not offer a conclusion on whether Trump obstructed justice.

Barr later concluded that there was not sufficient evidence for obstruction of justice, but House Democrats are continuing to pursue that issue.

“After two years of an expensive and comprehensive Witch Hunt, the Democrats don’t like the result and they want a DO OVER,” Trump said in one of his morning tweets. “In other words, the Witch Hunt continues!”

In another, he claimed to have done nothing wrong and suggested that Democrats were now on a fishing expedition.

In a later tweet, Trump claimed that his job approval number would be 65 percent if not for the Mueller investigation. A Quinnipiac University poll released this week found that 38 percent of registered voters approve of the job Trump is doing, while 57 percent disapprove.

Minutes later, in a news conference of their own after they returned to the Capitol, Pelosi and Schumer shot back.

"To watch what just happened in the White House would make your jaw drop," Schumer said.

He said the president's remarks were not spur-of-the-moment but "a pre-planned excuse" because Trump wanted to avoid raising taxes to pay for an infrastructure plan. Schumer cited a sign placed on the president's podium listing details and costs of the Mueller investigation that he said must have been prepared well ahead of time.

Pelosi did not address the "cover-up" language she and the president used but said "we went in in a spirit of bipartisanship" to the White House meeting and that Trump "took a pass" on a chance to do a bipartisan infrastrcuture effort. "It makes me wonder why he did," she said.

"I pray for the President of the United States," she said. "I pray for the United States of America."

Great point James. I am sure a lot of Republicans would ask him about that, as according to DOJ policy (and he was a DOJ employee) it's never their job to "exonerate" someone. Only to make a binary decision as to whether or not there is enough evidence to indict someone.

One of the many things Barr suggested was not done "by the books".

But I suspect that Mueller didn't have the evidence to make a declaration that he would otherwise be "indicted" (or he would have stated that, just like Ken Starr stated it when he probed Clinton).

The "hedge" was all political. Which is why Barr called him out on it. He doesn't want to try to explain why he had a very simple job, and could neither complete it or follow basic elementary DOJ policy.
