Btw... this is technically another crime...

Huma Abedin admits that Clinton burned daily schedules


Is it any wonder that the Clinton legal team and State Department originally fought the request for Abedin and other Clinton aides to be questioned?

Let's use a bit of common sense here based on tangible history. If General Petraeus was charged with mishandling of classified information, for (among other things) keeping his schedule in his home office and showing his biographer. Then it would be clear that such a schedule (being classified State documentation) would be required to be retained as a matter of legal record keeping. Destruction of classified State owned materials would therefor be (stay with me here)... illegal. At least illegal for anyone not named Clinton.

Would the defense be that Clinton was unaware that her schedule was considered a matter of State record, bound to be maintained? Would she go with the "I just burned it for convenience" defense? Perhaps it will be the "the procedure of burning your schedule" was allowed and approved defense?

My best guess will be that it will be argued as "common practice" and that despite being in clear violation within the letter of the law, that there are legal nuances involved that us peasants would not understand.
