Hearings going well for Gorsuch!
Not so well for Democrats!


By all accounts, the Gorsuch hearing is going well for the good guys. The good guys being anyone who wants Justices who will abide by the constitution, not impose their own personal opinions over the letter of the law, and objectively call legal balls and strikes.

Meanwhile things are not going so well for the Democrats who have been flailing around in vain attempts to undermine the future Supreme Court member. I can personally say I am embarrassed by our own Minnesota Senator, who repeatedly showed the country how little he actually respects a the confirmation process. In posing questions about Justice Merrick Garland, about the actions of a law school friend, and whether Gorsuch can tell him exactly what Steve Bannon and Reince Preibus meant when they said such and such... Al Franken was more comedian than Senator.

Did you hear the one about a guy you knew in college who helped get an amendment
on the ballot in Ohio? It turns out I believe that should disqualify you to be a judge?

At this point in time, there is little reason to vote against Gorsuch, other than for pure political spite. If he is not the most qualified nominee in recent history, he has certainly been the hardest one to crack in the confirmation hearing.

Start with mortality. A recent survey concluded that “regardless of cross-national differences in access to quality medical care, the fact remains that the overwhelming contributors to the incidence of disease (e.g. poor health behaviors) operate largely outside the influence of medical care.” Americans seem to be sicker than people in other countries, and while people often attribute this to lack of preventive care, on some metrics that ought to improve our life-expectancy -- such as screening tests -- America actually does more than other places. Other contributing conditions, such as obesity, have shown little response to the things that primary care physicians can do, such as tell you that you should lose weight.

We’re also at greater risk for fatal injuries than people in other countries. We have a higher homicide rate, in part because Americans seem to be more violent and in part because we have greater access to guns. And we drive more, so more of us die in auto accidents. No matter what you think of America’s car-driven development policy, or its gun-control regime, you can’t think that altering our health-care system is going to keep Americans from driving to their suburban homes, or shooting each other.

Skeptical? Let’s look at what happened when the U.S. greatly expanded the government’s funding of health care: Between 2014 and 2015, age-adjusted mortality rose for the first time in decades.

Did Obamacare kill those extra people? Nah. Car crashes, guns and drug overdoses did. But this experiment certainly indicates that simply eyeballing the government’s health care financing, and comparing it to the mortality rate, is not a good way to assess the effect of the health-care system on human lifespan.

All right, maybe single payer isn’t going to make us all live as long as the proud people of Monaco. But surely getting the government involved can control the cost side?

Well, actually, that too is more complicated than it sounds. When you actually look at our spending, you see that even before Obamacare, America spent more on its government systems as a percentage of GDP than many of the comparison countries we’re supposed to emulate -- this to cover a fraction of the population. Somehow, getting the government involved did not make American health care cheap.

Michelle was the president's wife. She wasn't the first wife to have her own office, I strongly suspect. I don't think any presidential daughters ever had offices there. Malia and Sasha never did. Nor did Jenna and Barbara.

A unanimous Supreme Court strengthened the rights of nearly 7 million schoolchildren with disabilities Wednesday and did so by rejecting a lower standard set by Judge Neil M. Gorsuch.

The ruling, one of the most important of this term, came as President Trump’s Supreme Court nominee is wrapping up his third day of testimony before a Senate committee.

Justices ruled for the parents of Endrew F., a Colorado boy with autism who pulled their son from the public school after his progress “essentially stalled.”

They enrolled him in a private academy that specialized in autism, where his behavior and learning improved markedly. They then sued the school district for a reimbursement, alleging a violation of the federal law that promises a “free appropriate public education” to children with disabilities.

Chief Justice John G. Roberts Jr. said the school district had not met its duty under the law. Children like Endrew F. have a right to an “educational program that is reasonably calculated to enable [them] to make progress,” he said. And the learning program “must be appropriately ambitious in light of” the child’s capabilities.

This stand “is markedly more demanding than the ‘merely more than de minimus’ test applied by the 10th Circuit," he said, including a 2008 opinion written by Gorsuch. Under that standard, a school need show only that it was providing a minimal special program with some level of benefit.

The high court did not mention Gorsuch’s opinion in the earlier case, but it reversed a 10th Circuit ruling that had relied on it.

Asked about the issue on Wednesday, Gorsuch said he was a part of a unanimous three-judge panel that had sought to follow a Supreme Court standard set in 1982.

Several liberal groups described the court's decision as a direct rebuke of Gorsuch.

However, Senate Judiciary Committee Chairman Charles E. Grassley (R-Iowa) noted that Gorsuch was not part of the three-judge panel whose ruling was directly reversed in the court’s decision in Endrew F. vs. Douglas County.

MO, Cscared McCaskill will be allowed by the Dems to vote for USSC Gorsuch in an attempt to keep that Senate seat in 2018, a tough row to hoe. Over that last Election, MO, went all Republican from the Gov to both State Houses. It was a sea change in the Heartland of America.
