We watch as the brains of liberal reporters turn to mush...

The Law Can’t Stop Trump. Only Impeachment Can.
Shortly after the Washington Post’s devastating report that President Trump “revealed highly classified information to the Russian foreign minister and ambassador” and “jeopardized a critical source of intelligence on the Islamic State,” Republicans in Congress began to weigh in. “We certainly don’t want any president to leak classified information but the president does have the right to do that,” insisted Senator John McCain. “It’s no longer classified the minute he utters it,” explained Senator Jim Risch.
The argument was eerily familiar. Trump, as his supporters pointed out, had a legal right to fire FBI Director James Comey. Likewise legal, Trump’s decision to hold on to his vast and non-transparent business empire, the value of which he can increase through his powers as president.
The president has a massive amount of leeway because the system is set up with the unstated presumption that the president is a responsible person who will act in a broadly legitimate, competent fashion.
The system is designed so that the only remedy for a president who cannot faithfully act in the public interest is impeachment. For the moment, that course of action — the only one that can save the country from the dire risk of its man-child president — is unfathomable to the Republicans who have a hammerlock on government.

Let's start with a couple of questions:
  • Do liberals like Jonathan Chait understand that impeachment is a tool that the constitution provides congress to deal with a President who has broken the law? 
  • Do liberals like Jonathan Chait understand that impeachment is not a tool that the constitution provides to remove a President that liberals don't believe is acting in public interest? 

Obviously Mr Chait doesn't understand. Unfortunately this simple reality seems to have disappeared along with objectivity and logic in most liberals these days. One can only assume they are the effects of late stage Trump Derangement Syndrome. 

So no Jonathan, unless the President actually breaks the law... the constitution does not allow you to impeach him. The law and impeachment are fundamentally connected. There cannot be the latter without the breaking of the former. 

Impeachment actually requires Congress to draw up the "articles of impeachment" which must include the "high crimes or misdemeanors" committed.  If everything the President does (that you don't like) is technically legal, then their are no "high crimes or misdemeanors" being committed. Alas, he cannot be impeached. I know this must be frustrating and all. But it is what it is.

Your actual only recourse is simple. You vote against him if he runs for reelection in 2020. 

Meanwhile, he is the President, and as President he has the same "leeway" as any other President and the constitution provides him with the same so called "unstated presumptions" as any other President. 

That means he can fire the FBI director if he wants. That means he decides who replaces the FBI director and what qualities and priorities that director should have. If the President wants to hire an FBI director that will investigate internal leaks with the threat of criminal charges, then that is what he will get. As President it's his call. If there is political fallout, well then there is political fallout. 

That fallout (or lack thereof) takes place at the ballot box every other November. It doesn't come with "impeachment hearing" on whether or not liberals like what he is doing.

McMaster completely defended Trump... stating (again) that the details were about ongoing operations and were totally appropriate. He also pointed out that Trump wouldn't even have the sort of information necessary to provide the sort of "sensitive" information to the Russians that is being suggested.

Furthermore, he called the leaks a problem that puts our national security at risk... while fundamentally suggesting that the WaPo story was not even accurate.

Erick Erickson says he knows one of the sources who told the Washington Post that President Trump gave classified information to the Russian foreign minister and “the source is solidly supportive of President Trump, or at least has been and was during Campaign 2016.

“But the President will not take any internal criticism, no matter how politely it is given. He does not want advice, cannot be corrected, and is too insecure to see any constructive feedback as anything other than an attack. So some of the sources are left with no other option but to go to the media, leak the story, and hope that the intense blowback gives the President a swift kick in the butt. Perhaps then he will recognize he screwed up. The President cares vastly more about what the press says than what his advisers say. That is a real problem and one his advisers are having to recognize and use, even if it causes messy stories to get outside the White House perimeter.

A new Public Policy Polling survey shows Democrats now have a 49% to 38% lead overall on the generic congressional ballot.

“Even more notable though is that among voters who say they’re ‘very excited’ to turn out in the 2018 election, the Democratic lead balloons to 27 points at 61% to 34%. The outcome of lower turnout midterm elections often hinges on which side is more engaged, and Democrats have the clear advantage at this point on that front — 63% of their voters say they’re ‘very excited’ about voting in next year’s election, compared to only 52% of Republicans who say the same.”

Also of note: Only 25% of voters support the GOP health care bill, while 52% are opposed.

Two big errors in Chait's text. First, the 25th(?) Amendment provides an alternative way to remove the president (the vice president and a majority of the cabinet secretaries jointly pronounce the president unfit to serve). If that method is pursued to its ultimate conclusion (votes on the president's fitness to serve in Congress) I believe the number of votes required is the same, but it is not a removal after being impeached. The biggest difference is that this would originate from within the Executive branch, not Congress.

The second error is in the understanding of impeachment. The founders included language that the president could not face criminal charges while in office. But they realized that the president could well be a dangerous crook, and thus created impeachment as a way for Congress to get rid of the worst of the worst.

We have more recourse than the two extremes of impeachment vs doing nothing until the next election. It's up to Congress to keep him in check regarding policy, and his own handlers to reign in his impulsiveness.

We can pressure Congress in the arena of public advocacy, and make sure that they are aware that failures will place their position in jeopardy. I have some sympathy for Trump with the way the media has treated him (not that I want to feel any sympathy for him). But if the press does take it on themselves to bring pressure, for even slightly more adult members of Congress to mitigate Trump's continual acting out, I don't really see much wrong in that.

White House scrambles to limit damage

The White House scrambled on Tuesday to limit the damage from President Trump’s latest controversy — allegations that he revealed highly classified information during an Oval Office meeting with Russian officials.

National security adviser H.R. McMaster sought to defuse the situation, insisting on nine separate occasions that the discussions were “wholly appropriate” and amounted to a normal exchange of information.

“What the president discussed with the foreign minister was wholly appropriate to that conversation and is consistent with the routine sharing of information between the president and any leaders with whom he's engaged,” McMaster told reporters during a tense, 11-minute question-and-answer session at the White House.

But McMaster raised new questions when he suggested that Trump could not have compromised intelligence sources or methods because the president “wasn't even aware of” the source of the information he discussed with the Russians.

Trump jumped in to defend himself earlier Tuesday, writing in a string of early morning tweets that he has the “absolute right” to disclose “facts pertaining to terrorism and airline flight safety” to the Russians.

Neither Trump nor his advisers have specifically denied that he divulged highly classified information to top Russian diplomats, the crux of reports from The Washington Post and other outlets detailing the Oval Office meeting.

The president ignored questions about what exactly he told Russian Foreign Minister Sergey Lavrov and Ambassador Sergey Kislyak on May 10, only telling reporters the meeting was “very, very successful” and that “we want to get as many to help fight terrorism as possible.”

The memo (if it even exists) means almost nothing, Roger.

Compare and contrast to the Hillary Clinton email investigation:

- Where the Justice Department did not allow a Grand Jury to be sat.
- Immunity deals were provided to pretty everyone.
- They allowed one attorney to represent several people.
- They allowed people who were being investigated to represent other people who were being investigated.

You would need tangible evidence that there was actually action taken to impede the Russian probe investigation. Which given that none of what the Obama Administration was considered impeding... it creates a pretty high bar.

Simple Roger. You look at the evidence. If there is evidence that the President or the Justice Department interfered with the investigation.

According to the sworn testimony of the acting director, there has been no hampering of the investigation. His testimony states that the FBI has been given free reign.

(Something they were not given in the Clinton investigation).

Here is what we do know.

Under the law, Comey is required to immediately inform the Department of Justice of any attempt to obstruct justice by any person, even the President of the United States. Failure to do so would result in criminal charges against Comey. (18 USC 4 and 28 USC 1361) He would also, upon sufficient proof, lose his license to practice law.

So, if Comey believed Trump attempted to obstruct justice, did he comply with the law by reporting it to the DOJ? If not, it calls into question whether the events occurred as the Times reported it.

Obstruction requires what’s called “specific intent” to interfere with a criminal case. If Comey concluded, however, that Trump’s language was vague, ambiguous or elliptical, then he has no duty under the law to report it because it does not rise to the level of specific intent. Thus, no crime.

There is no evidence Comey ever alerted officials at the Justice Department, as he is duty-bound to do. Surely if he had, that incriminating information would have made its way to the public either by an indictment or, more likely, an investigation that could hardly be kept confidential in the intervening months.

Comey’s memo is being treated as a “smoking gun” only because the media and Democrats, likely prompted by Comey himself, are now peddling it that way.

Comey will soon testify before Congress about this and other matters. His memo will likely be produced pursuant to a subpoena. The words and the context will matter.

But by writing a memo, Comey has put himself in a box. If he now accuses the President of obstruction, he places himself in legal jeopardy for failing to promptly and properly report it. If he says it was merely an uncomfortable conversation, he clears the president of wrongdoing and sullies his own image as a guy who attempted to smear the man who fired him.

Either way, James Comey comes out a loser. No matter. The media will hail him a hero.

I'd like to know more about the basis for saying "An F.B.I. agent’s contemporaneous notes are widely held up in court as credible evidence of conversations." I'm guessing that's a reference to the admissibility of the evidence as an exception to the hearsay rule (803(6)). The weight to be given the evidence depends on all of the circumstances. By the way, it's double hearsay, since we're asked not only to believe what Comey wrote but the unnamed individuals who told the NYT about the memo. The NYT has not seen a copy of the memo.

But let's assume the memo exists and says what you read quoted in the post title. How bad is it to say Flynn is a "good guy" and to express "hope" about the outcome? The headline has a pretty aggressive paraphrase of the quote. It reads: "Comey Memo Says Trump Asked Him to End Flynn Investigation."

The asking is at most only implicit in what is a declarative statement: "I hope you can see your way clear to letting this go." That's just Trump revealing what he hopes for. There's no question at all, let alone any pressure or threat. And "see your way clear" is a delicate phrase. That's not saying do it my way. Go your way. And if your path is clear and it gets you to the outcome I hope for, then I will get what I want, but I'm assuming you will go where you see it clear.
