Bottom Line:

Besides the fact that it is now confirmed that Donald Trump is not under any investigation...

  • The Director of National Intelligence testified today that there was "no interference or push back" from the President or anyone else in regards to the Russian probe.
  • The National Security Agency Director testified today that he was never directed or pressured by the President or anyone else to do anything "illegal, immoral, unethical, or inappropriate" regarding the Russian probe or anything else.
  • The former FBI director declared in a statement released today that he did not believe that the President attempted to interfere or put an end to the "broader investigation of Russian or possible links to his campaign."

Looks like the left has come up with three strikes as it pertains to their clever narrative that the President tried to obstruct the Russian investigation. I can't imagine that deep down most of the Trump-haters are not at least mildly disappointed by these events. If they are not disappointed, it's likely because they are in denial (or are still more willing to believe anonymous sources than sworn testimony).

But hey, they still have the idea that the President wanted his FBI director to be "loyal" and that he hoped he could "let it go" specifically in regards to General Flynn. I am sure many a liberal will argue that this is somehow Nixonian and should demand immediate articles of impeachment.  But I think this argument falls well short of what it will take to convince Republicans to follow suit.

The difference between you and I was that I read Comey's statement, basically took it at face value, and reported what was written.

You read someone else's opinion about what they read (the spin on this is crazy)... or possibly read someone else's opinion who didn't even bother to read it.

I think for myself.

You rely on others to do your thinking for you.

Well here's the thing: President Obama did do that, or so it seems -- we don't have the full conversation (Gates did not apparently write a memo about it immediately after it occurs). At the very least, the conversation seems to have gone into the area of Gates' loyalty to Obama -- with Gates pledging loyalty, of a kind.

When Will Trump Counterpunch?

Politico: “How long can Trump resist taking to Twitter to bash Comey midhearing? Even his aides can never be sure, and reports suggest Trump is going to be watching Comey’s testimony and prepared to respond.”

“Even if he stays silent, the prospect of a presidential smackdown from the other end of Pennsylvania Avenue will hang over the hearing all morning — and possibly become grist for other ongoing investigative efforts.”

The Missing Comey Conversations

Politico: “Comey revealed in his written testimony that he’s had nine one-on-one conversations with Trump — ‘three in person and six on the phone.’ Yet he goes into detail about only five of those instances.”

“Senators are sure to ask Comey about the other conversations — their substance, their tone and their timing – to see whether they give a fuller picture of Trump’s posture toward his FBI director in those crucial months.”

“Comey says his last interaction with Trump came on April 11, a month before he was fired. If so, what might have transpired in the intervening weeks that led Trump to ax Comey at the moment he did?”

Who Are the Trump ‘Satellites’?

Mike Allen notes that former FBI Directory James Comey uses a word in his Senate testimony “that I suspect will become famous as the investigation unfolds.”

The President went on to say that if there were some “satellite” associates of his who did something wrong, it would be good to find that out, but that he hadn’t done anything wrong and hoped I would find a way to get it out that we weren’t investigating him.

The big question: Who does the Trump think of as “satellites”?

Most Shocking Testimony Since Watergate

Benjamin Wittes: “James Comey’s seven-page written statement, released by the Senate Intelligence Committee this afternoon in connection with Comey’s impending testimony tomorrow, draws no conclusions, makes no allegations, and indeed, expresses no opinions. It recounts, in spare and simple prose, a set of facts to which Comey is prepared to testify under oath tomorrow. Despite this sparseness, or maybe I should say because of it, it is the most shocking single document compiled about the official conduct of the public duties of any President since the release of the Watergate tapes.”

That's easy. Trump just kept boiling and burning because he had an FBI director who wouldn't pledge him unquestioning loyalty, boiling and burning because Comey would not pledge himself to making the Russian mess just go away.

This is interesting---
Leaks May Be Part of FBI Strategy

Daily Beast: “But there’s an explanation for at least some of the leaks that’s a little more cunning than the rest—one that might bring some actual resolution. Four current and former law enforcement officials believe prosecutors have been treating Trump and his associates like a criminal network, and subjecting them to an array of time-tested law enforcement tricks.

“One of those tricks involves floating names of potential targets of the investigation, to try and get potential co-conspirators to turn on one another. Another, called ‘tickling the wire,’ entails strategically leaking information to try and provoke targets under surveillance into saying something dumb, or even incriminating.”
Said one former FBI official: “You want people to freak out, to say, ‘are they talking about me? Is this me? What do they know?’—and you want them to do this in a way that is captured. Now we wait for the cover up.”

The Biggest Scandal Is the GOP’s Response

Michael Grunwald: “There are still plenty of unanswered questions about Russia—including the usual questions about what the president knew and when he knew it—but what’s shocking is how many questions have already been answered. The scandal has already led to the abrupt firing of Trump’s national security adviser. His attorney general and his son-in-law are also under siege for making false statements about their contacts with Russians; his former campaign manager is in legal jeopardy over his own political and financial ties to Russian operatives. And Trump himself keeps saying and tweeting things that would make any defense lawyer cringe, while doing things in his official capacity that make Vladimir Putin smile. It isn’t clear how much, if any, of this behavior has been criminal, but a lot of it is pretty clearly scandalous.

“The main unanswered question is whether the Republicans who control Congress will do anything about any of it. So far, their response has mostly amounted to ‘Ha! ha! ha!'”

Democrats are salivating at the prospect of an "Alexander Butterfield Moment" during Comey's testimony (Butterfield told the Watergate Committee about the existence of Nixon's secret recording system).

I don't expect anything like that to occur. But that won't stop Democrats from reaching conclusions not supported by the evidence.

My prediction is that Comey will go far enough in his criticism of Trump that Democrats will interpret it as "Guilty! Impeach him!" But Comey's statements will reveal no criminal wrongdoing by Trump whatsoever, so Republicans will scream "Innocent! Witch hunt!"

So the end result is that post-testimony opinions will be the same as the pre-testimony opinions.

Correct, not me. Quote me all you like, but I do request that people refrain from impersonating me.

Regarding the three Directors, if their stories hold up and are not contradicted by other high level officials, the SI will not make a case for obstruction. There has to be direction, or pressure, somewhere in the investigation for there to be obstruction, and it's not very credible that Trump would have dealt directly with lower level investigators.

If you go the route of looking at public statements as "pressure" and even obstruction, then you'd better start with Obama and the Clinton investigation. There were a lot of people, including me, who were upset at President Obama's interference but the fact is, precedent has been set. It was marginally acceptable to Justice then, therefore is is acceptable now.

wphamilton said...

It looks like those Directors' statements are contradicted by Comey after all. Comey said that Trump directed him to close the investigation of the Flynn /Russia connection.

So the Special Investigation still has legs.

Take solace in the President's power to end the Special Investigation. Congress will probably gin up impeachment hearings if he does, but Trump does have that option.
