Comey testimony has potential peril for the left...

Everyone assumes that James Comey's testimony this week will provide another "nail in the coffin" for Donald Trump. Think of the slobber coming off the chin of a St, Benard and you can get a feel for how much many liberals are looking forward to the Comey testimony.

But much like the stock market will "price something in" even before it happens, I believe that the idea that Comey will suggest that Donald Trump tried to "obstruct" the FBI investigation has already been assumed by many people, and has already been factored into people's mindset.

So the best case scenario for the never Trumpers is that he tells them what they expect that he will, and reinforce what has already been assumed by many people. That doesn't seem like much of an upside?


But what happens if he doesn't say what the left expects him to say?

This morning there are reports out that James Comey is "not" planning to testify that he felt that his investigation was obstructed by Trump. Of course nobody really knows what Comey will say or how he will answer specific questions.  (Moreover, nobody can know how the media will report what he says - although I have a pretty good idea). Bottom line, this is just another anonymous source likely providing speculation based on limited information.

But it should raise the question about the possibility that Comey testifies that he didn't feel pressured enough in any of his meetings with Trump to fall within the scope of "obstruction". In fact, given what we know about Comey and his appreciation for following protocol, it would seem unlikely that he did actually feel there was obstruction, but chose not to report it.  But, either way, if he comes out and denies (to any degree) that he felt he was being obstructed, it's going to create a challenge for the NYT, WaPo, CNN, and gang to provide the juicy headline that they have no doubt already written a hundred times over in their dreams.

Moreover, what would happen to the "case" that the media and the Democrats have been building in regards to Trump breaking the law by obstructing justice? Notes or no notes, it would have been a dubious case of "he said she said" even if Comey had suggested that he felt (based on private conversations) that his investigation was obstructed. Perhaps with specific sworn allegations from Comey along with other questionable actions, a case could be made (although many top constitutional scholars disagree) that Trump was attempting to obstruct justice. But without the absolute testimony of the key player to all of this, one would think that those allegations start to look less and less tangible.

This looks an awful lot like a break even / lose proposition for the left. Perhaps they are the ones who should be most concerned.

Going to be fun listening to every word comey says. Will he or won't he. I'll avoid speculation like our esteemed host made and say again, lets wait for the show, it is less than a day away. I wonder if the liar in chief will tweet his disdain during the hearing. Now that will be telling of his mental state. We shall see and I am sure will be subject of much discourse after the hearing. It will be fun to see how much spin CH will put on the actual words and poor logic he will use to make him feel better.

Different polling outfits put Trump at varying levels of approval, but the RealClearPolitics average had him at 39.8 percent Tuesday, while the weighted average from FiveThirtyEight had him at exactly 39 percent. Not great numbers, but still better than Clinton. On Day 138 of his presidency, just 37.8 percent of Americans approved of the job he was doing, according to FiveThirtyEight.

If you compare where each president stood at this point in the Gallup tracking poll, however, the two are deadlocked. The most recent Gallup survey pegged Trump's approval at 37 percent, the exact same figure the polling company

Clinton's numbers soon turned around, and by the end of June, Gallup had him in the mid-40s. By the time he left office, 66 percent of the country approved of him.

Wonder how long before the liar in chief's numbers turn around.. I doubt it will be anything close to clintons performance, LOLOLOLOL

Director of National Intelligence James Clapper was caught off guard Monday by a question on the widely-covered arrest of 12 men in an alleged terror plot in London. Today, Clapper's spokeswoman admits that it was because he had not been briefed on the arrests.

In an interview with ABC's Diane Sawyer, taped Monday afternoon, Clapper was asked about the arrests, which had happened hours before and were featured on all of the network morning news broadcasts. Secretary of Homeland Security Janet Napolitano and Chief Counterterrorism Advisor John Brennan, who were also participating in the joint interview, were aware of the arrests.

"First of all, London," Sawyer began. "How serious is it? Any implication that it was coming here? ... Director Clapper?"

"London?" Clapper said after a pause, before Brennan entered the conversation explaining the arrests.

Later in the interview, Sawyer returned to the subject.

"I was a little surprised you didn't know about London," Sawyer told Clapper.

"Oh, I'm sorry, I didn't," he replied.

The Justice Department announced Wednesday it will no longer allow prosecutors to strike settlement agreements with big companies directing them to make payouts to outside groups, ending an Obama-era practice that Republicans decried as a “slush fund” that padded the accounts of liberal interest groups.

In a memo sent to 94 U.S. attorneys' offices early Wednesday, Attorney General Jeff Sessions said he would end the practice that allowed companies to meet settlement burdens by giving money to groups that were neither victims nor parties to the case.

Sessions said the money should, instead, go to the Treasury Department or victims.

“When the federal government settles a case against a corporate wrongdoer, any settlement funds should go first to the victims and then to the American people—not to bankroll third-party special interest groups or the political friends of whoever is in power,” Sessions said in a statement.

Conservatives have long fought the policy introduced under the Obama administration. Earlier this year, Republican lawmakers introduced legislation that would prohibit the Department of Justice from requiring defendants to donate money to outside groups, after concerns that the settlements bypass congressional appropriations processes.
