 U.S. Supreme Court’s grants certiorari in Janus v. American Federation of State

Take one: 
The Associated Press says that with a conservative majority, the Supreme Court will hear “a new case with the potential to financially cripple Democratic-leaning labor unions that represent government workers. The justices deadlocked 4-4 in a similar case last year.”
Take two: 
In Friedrichs, decided last year, the Court split 4-4 following the death of Justice Scalia, and therefore left standing a 9th Circuit decision adverse to the plaintiff, a California school teacher. In Janus, like Friedrichs, plaintiffs are asking the Court to overturn the ruling in Abood v. Detroit Board of Education and bar public employees from being forced into unions, or from being required to support unions via the fiction of “fair share” contributions. It is widely believed that Rebecca Friedrichs would have won her case had Scalia lived, and that, with Neil Gorsuch now sitting in place of Scalia, Janus and his co-plaintiff will win, Abood will be overturned, and public sector unions will be dealt a very serious blow.
Both liberals and conservatives are pretty much in agreement on this one.

They both agree that the 9th circuit court decision that allowed the teacher's union to continue to automatically collect/deduct dues from all employees (whether or not they are part of the union) will likely be overturned when the USSC hears the case (for the second time) in the upcoming session.

Moreover, liberals and conservatives are pretty much in agreement that this will cause a serious (if not fatal) blow to the political interests of the public sector unions. Certainly these unions can still do the unimportant trivial things... you know, like negotiate wages, benefits, and working conditions for employees. But the "really important" aspects of the unions (supporting the Democratic Party) would be a thing of the past.

Neil Gorsuch is still a tangible reminder of why this country is better off with Hillary Clinton fuming around in the private sector.

The leaders of the Senate Judiciary Committee say that they have reached an agreement to subpoena Paul Manafort, former Trump campaign chairman, to testify before the committee if he won't appear voluntarily.

The chairman of the committee, Sen. Chuck Grassley, R-Iowa, cautioned that there were still things to be worked out saying, "there's been agreement in principle, but the details have not been filled in yet."

This comes after CBS News confirmed earlier this month that Manafort was wiretapped under a foreign intelligence warrant in connection with U.S. concerns that he was communicating with Russian operatives who wanted to influence the American election.
The U.S. government listened in on Manafort's conversations during the presidential campaign and through the election — though not constantly — and its surveillance includes the period when Manafort was Mr. Trump's campaign chairman.
The FBI raided his home in July and The Washington Post reported in early August that the search warrant was wide-ranging and FBI agents left his home with various records.

In other words, the entire electrical grid will have to be rebuilt. That will take months if not years no matter how much money and how many people you throw at the project.

The priority for grid repair will be commercial thoroughfares, stores, gas stations and hospitals.

That will facilitate distribution of supplies.

In a rare occurrence, all 13 judges of the 2nd Circuit Court of Appeals heard oral arguments in Zarda v. Altitude Express Tuesday. The case originated in 2010 when skydiving instructor Donald Zarda sued his former employer, Altitude Express, alleging he had been fired because of his sexual orientation. The judges are expected to decide if the Title VII provision of the 1964 Civil Rights Act that protects against discrimination based on gender should also apply to discrimination based on sexual orientation.

I fully understand that some people are deeply offended by the display of concern over police officers using brutal tactics and in some cases, deadly force. This is why this started. But then the President declared that this was disrespectful to the American National Anthem and to those thousands of Americans who fought and died to defend the very right to express dissent.

Even worse, is that this entire tweet bomb, and the campaign style campaign speech, was a cynical attempt to fire up his base. And to divert attention away from the Republican party's leadership and failure to fill his primary campaign promises, especially to repeal and replace Obamacare. This is an attack on the first amendment rights of the Constitution of the United States Of America. To President Trump, to differ with him is, deeply offensive.

To make it worse, was his failure to act in response to the disaster in Puerto Rico. Hundreds of shipping containers are sitting on the dock in San Pedro harbor, unable to move because there is no fuel for transportation vehicles. We have the capacity to send helicopters and other methods to distribute drinking water and food to thousands of American citizens. He also took five days to suspend the Jones act. This to many people, believe that he wasn't concerned about, because the largely Hispanic population was not his concern. I don't necessarily agree with that, but given his comments on the illegal immigrants, who to him, were rapists, drug dealers and murderers, I can see why many other people can believe that.

It's obvious that his comments have been successful on his base and on this blog. Not this page, that has a very offensive photograph of the poster child, called rrb. But the owner of this blog, allows him to keep a personal attack on the top of the site, because I dare disagree with him. So be it.

The Coast Guard are helping shuttle more supplies into the island. The US Army is clearing streets. The Navy Seabees are also on the ground clearing.

Now Commonsense will tell us how it is that the suppressed workers in the cotton mills of the South in the 30's had NO right to just compensation in order to buy food, clothing, and shelter for themselves. Instead they were kept enslaved by the mill owners who forced them to accept "pay" vouchers they could only redeem at the company store under a system designed to cause them soon to "owe their soul" to the company store.

Hard to see how THAT was not enslavement

Hard to see what right to life, liberty, and the pursuit of happiness can even begin to exist under such conditions.

Hard to see ANY concept of freedom in such a situation.

Members of Congress might want to familiarize themselves with the story of Kansas' failed tax-cutting experiment as they begin deliberations on President Donald Trump's tax-reform plan.

It could serve as a cautionary tale because some elements of the president's updated proposal mirror pieces of the tax-cut plan that Republican Gov. Sam Brownback pushed through the state legislature in 2012, promising it would deliver a "shot of adrenaline" to the Kansas economy.

It didn't. Instead, revenues crashed, forcing Brownback and lawmakers to resort to spending cuts, borrowing and accounting tricks to maintain a balanced budget.

So, Kansans reading headlines about the Trump tax cuts might be excused for having a déjà vu moment.

"Are you kidding me," says University of Kansas political scientist Burdett Loomis. "I think it is pretty clear that the Kansas experiment was a failure."

William Gale of the centrist Brookings Institution called the Kansas tax cuts "a lab test for how supply side tax cuts may work at the federal level."

Not well, he concluded in a July blog post.

"The Brownback plan aimed to boost the Kansas economy, but instead led to sluggish growth, lower than expected revenues and brutal cuts to government programs," Gale wrote.

"Red-state experiment"

In his self-described "red-state experiment," Brownback, who's been nominated for a State Department post with the Trump Administration, slashed individual income tax rates and lowered to zero the tax on so-called pass-through business income, which usually comes from small businesses and partnerships.

In Kansas, business owners responded by restructuring their companies as limited liability corporations to avoid paying income taxes.

State revenues plummeted by hundreds of millions of dollars and continued to miss projections for several years.

Like Brownback, Trump and GOP congressional leaders say lowering income and business taxes will spur investment and economic growth. Their plan would reduce the nation's top income tax rate to 35 percent from 39.6 percent and lower the corporate tax to 20 percent from the current 35 percent.

Unlike the Kansas experiment, the president's proposal wouldn't exempt pass-through income but it would lower the rate that high-earning professionals in business partnerships pay to 25 percent.

"The promise [in Kansas] was that the tax cuts would generate so much economic growth that you wouldn't really feel the revenue loss," said Michael Leachman, director of state fiscal research at the liberal Center on Budget and Policy Priorities, said. "The same sorts of promises are now being made at the federal level."

Kansans felt it.

Spending cuts, borrowing

With state revenues in free fall, Brownback rejected calls to roll back parts of his signature tax cuts. Instead, he slashed university budgets, cancelled highway projects and convinced reluctant lawmakers to go along with a plan to borrow $1 billion to shore up the state's public pension fund.

Angry voters responded in 2016 by ousting dozens of conservative Republicans who supported the tax cuts and replacing them with Democrats and moderate Republicans who promised to "fix the mess" in Topek

As far as I know, my southern ancestors had no slaves. Washington did. Jefferson did, and had children by one of them.

As for the mills, laws were passed preventing the gross exploitation of mill workers, wives, husbands, and even children, thus humanizing a system designed to take advantage of the desperate-for-work masses of that time.

Christian compassion expressed through the more justice-minded churches had much to do with bringing needed reforms.

Schumer points to Kansas to criticize Trump’s tax plan

In a warning shot to Republicans crafting landmark tax legislation, Senate Minority Leader Chuck Schumer said on Sunday that Kansas’ experiment with tax cuts foreshadows what can happen if the GOP relies on “fake numbers” to support its effort.

Speaking on CBS’ "Face the Nation," Schumer rebutted assertions by the Trump administration that the president’s tax plan is not designed to cut taxes for rich Americans.

“It's completely focused on the wealthy and the powerful. Not on the middle class,” Schumer said.

The New York Democrat also attacked Republicans’ assertion that the tax plan won’t add to the deficit. Kansas’ 2012 tax cuts led to a budget deficit that forced the state to cut funding for schools and infrastructure, Schumer said. Facing a major budget deficit, Kansas lawmakers in June approved legislation that rolled back many of Gov. Sam Brownback’s tax cuts.

“This idea that cutting taxes on the wealthy, this trickle-down economics which the Republican Party loves, does not create growth,” Schumer said. “It never has."

He insisted that if Republicans want to get anywhere with Trump’s tax plan, they need to work with Democrats.

“They have to consult us,” he said. “They can't just put down a plan and say, ‘Bipartisanship is you guys come over and do what we want,’ when it's against our principles.”



Sen. Bernie Sanders (I-Vt.) was dubious of the idea that the plan wouldn't overwhelmingly benefit the rich.

"For Trump to go on television [and say] that, oh, this doesn't benefit the wealthy is absolutely outrageous," he said on CNN's State of the Union.

"Of course, it benefits the wealthy. And of course it benefits large multinational corporations.

"We are living in a moment of massive income and wealth inequality. The very, very rich are getting richer. Middle class is shrinking."
