Was the Hillary Email investigation "rigged" ?

By now, most everyone has read the reports that James Comey had started gathering his "no charges necessary" thoughts prior to interviews being conducted with at least seventeen different witness. Apparently these witnesses included the guy who set up the email server, most of Clinton's top aides, and Hillary Clinton herself.

At first, second, and third glance, this certainly fits the bill of your conclusions being predetermined before you have all the facts. More to the point, it would appear that the meat and potatoes of the process was a big fat giant waste of time. It seems obvious that the actual investigation didn't matter much to Comey.

But here is the reality.

The facts (for the most part) were already known. Not just to Comey and the FBI, but to pretty much most of America. The decision to charge or not to charge was more likely a decision made based on Comey's interpretation of the statues, his consideration of past precedents, and such. It's entirely likely that the investigation itself (to the degree that it would offer Comey with a reason to charge Clinton) was effectively an exercise in futility. Comey had made a decision, and was not swayed away from that decision.

The only real question is if there was any chance that Comey could have been offered information that could have changed his mind. Was he willing to rip up his memos, and start over with a new set of memos telling the country why he was recommending charges?

That seems unlikely.

What we will probably "never" really know for sure is whether or not Comey's predetermined decisions to not charge Hillary were actually based on his interpretation of the law, based on his personal political feelings towards the situation, based on marching orders he was given from above, or based on some combination of these possibilities.

Obama's photographer trolls Trump's response to Hurricane Harvey
Harper’s Bazaar Erica Gonzales,Harper’s Bazaar Thu, Aug 31 2:05 AM PDT

From Harpers Bazaar UK

Barack Obama's White House photographer Pete Souza has been not-so-subtly trolling Donald Trump since the election. On Instagram, he's sneakily mocked Trump's first 100 days in office, awkward hand-holding with the First Lady, and disrespect for women, to name a few-each with a fitting photo of President Obama. Now, his latest jab is targeted at the president's response to Hurricane Harvey.

Donald and Melania Trump jetted down to Texas yesterday to meet with local officials and survey relief efforts in areas affected by the tragedy. But Trump "didn't meet a single storm victim, see an inch of rain or get near a flooded street," Politico reports. He did, however, make a rally-style speech in Corpus Christi, TX, where he praised the "turnout" of people who gathered to watch him from the street.

Trump to hurricane victims in Corpus Christi, TX: "Thank you everybody. What a crowd, what a turnout." (via Reuters) pic.twitter.com/kVe3f8NmTL - Kyle Griffin (@kylegriffin1) August 29, 2017
Souza responded by sharing a photo of President Obama consoling a victim of Hurricane Sandy in 2012. In the shot, the then-POTUS embraces a distraught woman identified as Dana Vanzant amidst storm wreckage in New Jersey. (Photos of Trump personally meeting Harvey victims have yet to surface.)

So Sandy was a category two hurricane... 233 people died from that storm.

Harvey was a category four hurricane that they believe will in the end have caused more damage than Sandy and Katrina together... and it looks like the total death count will be around a third of what it was from Sandy...

But Obama's crisis skills were much better, because he shook hands and didn't wear the wrong hat... whereas all Trump and his team did was save lives.

Okay then...

While Hurricane Harvey brought out the best in many, it also brought out the worst. Across social media, certain liberals were feeling less than sympathetic to Texans, seen as Trump voters and Republican Party backers. ‘I don’t believe in instant karma, but this feels like it for Texas’, tweeted a University of Tampa professor: ‘Hopefully this will help them realise the GOP doesn’t care about them.’ (This professor was later fired for this tweet, which he shouldn’t have been.)

The heroism shown by ordinary Texans has been a great antidote to the prejudices expressed by well-off liberals towards ‘deplorable’ Americans. The politically correct view is that white folks are irredeemably racist, and the country is inescapably divided by race, yet the images from Houston told a different story: a black deputy sheriff wading through floodwaters with a white child in each arm; a white SWAT officer carrying a Vietnamese-American woman and her baby through floodwaters; three Asian and Hispanic constables moving an elderly woman in a wheelchair.

As it happens, this was not exceptional: as anyone who has travelled through Texas and the South will know, social interactions between people of different backgrounds are casually pleasant. Unlike PC liberals, most people don’t see life through a prism of racial categories. In response to Harvey, we didn’t see the ‘diversity’ of essentially different people – we saw citizens helping citizens, Texans helping Texans.

Original Letter Gave Different Reasons for Firing Comey

Special counsel Robert Mueller “has obtained a letter that President Trump and a top political aide drafted in the days before Mr. Trump fired FBI director James Comey which explains the president’s rationale for why he planned to dismiss the director,” the New York Times reports.

“The May letter had been met with opposition from Donald McGahn, the White House counsel, who believed that some of its contents were problematic… Mr. McGahn successfully blocked the president from sending Mr. Comey the letter, which Mr. Trump had composed with Stephen Miller, one of the president’s top political advisers.”

“A different letter, written by the deputy attorney general, Rod Rosenstein, and focused on Mr. Comey’s handling of the investigation into Hillary Clinton’s private email server, was ultimately sent to the FBI director on the day he was fired.”

Depends on your interpretation. I have read legal analysis that argues it both ways. If a President pardons someone for a federal crime, charging them for the same (or similar) offense at the state levels would have to overcome inevitable legal chalenges of double jeopardy.

If it's believed that the prosecution is attempting to use the state to get around a pardon, that argument is much stronger.

Interesting. Double jeopardy is specific to a jurisdiction. If a crime can be charged in both State and Federal jurisdictions, it's not double jeopardy to charge the same crime in both. So I don't see how that argument can be applied.

Maybe ... if the President has pardoned someone against a crime against the US (Federal) and it's a crime that could be charged by a State, they are prevented by separation of powers. But if NY prosecutes a person for a crime which is not also a Federal one, then the President might not be able to pardon him.

A real war hero tells us the Coldheartedtruth.

Congress will return from recess next week facing continued gridlock as we lurch from one self-created crisis to another. We are proving inadequate not only to our most difficult problems but also to routine duties. Our national political campaigns never stop. We seem convinced that majorities exist to impose their will with few concessions and that minorities exist to prevent the party in power from doing anything important.

That’s not how we were meant to govern. Our entire system of government — with its checks and balances, its bicameral Congress, its protections of the rights of the minority — was designed for compromise. It seldom works smoothly or speedily. It was never expected to.

It requires pragmatic problem-solving from even the most passionate partisans. It relies on compromise between opposing sides to protect the interests we share. We can fight like hell for our ideas to prevail. But we have to respect each other or at least respect the fact that we need each other.

That has never been truer than today, when Congress must govern with a president who has no experience of public office, is often poorly informed and can be impulsive in his speech and conduct.

We must respect his authority and constitutional responsibilities. We must, where we can, cooperate with him. But we are not his subordinates. We don’t answer to him. We answer to the American people. We must be diligent in discharging our responsibility to serve as a check on his power. And we should value our identity as members of Congress more than our partisan affiliation.

Certainly...

But if we are at a point where the Russian Federal Election probe was investigating crimes that are only applicable to NY State...

Then certainly Trump/Rosenstein would be justified to shut down Mueller for going well outside of his jurisdiction here.

CH, that's the worst case scenario. Trump has been busy fighting with the Congress Republicans. There would be almost no legislation would be passed. And they could conduct their own investigation. He's lost so much support, don't bet against it.

wp, And Trump shutting down the investigation is a fantasy scenario. Even if he was somehow justified, even if he could, and did, the repercussions would likely be worse than letting it run its course.

Exactly. Outside the tax reform bill would be passed, but nothing much else would be passed. The Wall? Tied to a shutdown of the government? This fall is going to be a disaster.

Yet more came out on Trump's temper, fuming and cursing, is seen and even General Kelly is becoming increasingly frustrated. This fall is going to be epic. And we're looking at North Korea to which is really really dangerous. His not trusted by most of the leaders of the Nations we need to depend on to work with us on this. This is a very very frightening scenario and I don't think we're going to enjoy it not one bit. Our nation will be torn apart has people are noting all the time and in the surveys even on Fox show that they believe that Donald Trump is dividing the country. And the polls between 35 and 40% or is base and it's getting weaker. Some of the prime strongest supporters are pulling away.

Roger, you said,

James please cease and dissent the comments with the c word and all the other stuff like that don't fall into the same dirty swamp with those that sleep with the alligators. Don't sink into the swamp be above it because Liberals are superior in most ways to the really the whacked-out here. Most of them anyhow. So please cease and you would be better man for that.

Roger, as a matter of simple information, I have never once used the c word in any of my posts, not a single one of them, so I don't know what you mean unless "comment removed by author" originally attributed such language to me and has been removed.

Again, I have never used that word in a single post of mine, ever.

Glad to make that clear. :-)

I did once send emails to a number of Kansas Methodist churches inviting them to look at this blog and see what "Savagette," an ex Methodist, was saying here. (Savagette was her then self designation.)

"LIBERALS ARE SUPERIOR" Alky

I do believe that HB and Mr. Opie does this blog a great service in that they bring all of us the voice, policy and prospective of today's Democrat Party.

So thanks boys.

It looks like Google voice to text does not translate alky.

Some how he believes I pay his house payment, too funny.

CHT is there anyway you can "lock" HB's post today at 10:16 am on this thread. I would hate to see HB delete it. It just that good.

Where explains he failed to sell a home bought for $182,000, at a market peak he would have earn in his words "million dollar profit".

Like I have said for many years, just quote him.

Roger that would be me. I was mistaken that the injin had some self respect and would hopefully take the hint and go away. Obviously I was sadly mistaken and discover much to my surprise she has none and isn't bothered by my language. You are correct, I fell into her realm of idiocy and kinda regret it. I have no pity or care for such a waste of resources and space and find her behavior beyond deplorable. But, I don't live with it and I don't understand how she has such such an empty life to try and affect others she don't know. But, then again, I am not a seer and truly don't care for someone who is as vain as her. But, I will try to hold my tongue, but when she starts with the commie or fattie comments. all bets are off...I give it one post n Same for stump broke farmer who is a bigger ass at times. But you knew that...

Relevant on-topic piece on the subject of this thread:

"It Wasn’t Comey’s Decision to Exonerate Hillary – It Was Obama’s

In his April 10 comments, Obama made the obvious explicit: He did not want the certain Democratic nominee, the candidate he was backing to succeed him, to be indicted. Conveniently, his remarks (inevitably echoed by Comey) did not mention that an intent to endanger national security was not an element of the criminal offenses Clinton was suspected of committing – in classic Obama fashion, he was urging her innocence of a strawman crime while dodging any discussion of the crimes she had actually committed. As we also now know – but as Obama knew at the time – the president himself had communicated with Clinton over her non-secure, private communications system, using an alias. The Obama administration refused to disclose these several e-mail exchanges because they undoubtedly involve classified conversations between the president and his secretary of state. It would not have been possible to prosecute Mrs. Clinton for mishandling classified information without its being clear that President Obama had engaged in the same conduct. The administration was never, ever going to allow that to happen.

*Some twitter thoughts*

Gabriel Malor @gabrielmalor
None of the broadcast newscasts covered the revelation that Comey drafted his statement exonerating Clinton before interviewing her, others.

Josh Jordan Retweeted Gabriel Malor

This is a hugely damaging revelation about Comey. The broadcast networks ignoring the story is proving Trump supporters right about them.
