Leandra English denied restraining order...

A temporary restraining order to halt President Trump's pick for acting director of the CFPB, Mick Mulvaney, has been denied by a judge.

Apparently the Judge understands the difference between an absence and a vacancy.

Doubt it had anything to do with "the difference between an absence and a vacancy" (because there isn't much difference)

As I'd predicted earlier, no court is likely to tell the President that he cannot appoint an Acting Director.

President Trump a showman for sure, staged a meeting in which he tricked Schumer and polsi, when they baby toe sucked and did not attend. THE President went on with the meeting leaving thier seats empty and thier name plates on the table.

The salient part (for our purposes here) of that Appeals decision in PHH vs CFPB is:

"we remedy the constitutional violation here by severing the for-cause removal provision from the statute. As a result, the CFPB now will operate as an executive agency. The President of the United States now has the power to supervise and direct the Director of the CFPB, and may remove the Director at will at any time."

... which is a wordier way to say what I wrote above, and in the previous blog discussion.
