Democrats desperately fight the tax bill...

I always find it amusing when one side accuses the other of committing some form of political suicide, while simultaneously attempting to talk them out of it. As power hungry and partisan as Politicians are these days, they would never "fight" something that aligns them with their political goals of power and control.

Reality? If the Democrats really thought that the GOP was committing political suicide by passing the tax bill, they would probably shut up, let it pass, and then reap the benefits in 2018. Then when they win the Presidency back in 2020 (citing bad tax policy) they can undo the tax bill before it causes too much damage.

Problem? There will be a tangible reality to the tax bill. As much as it's a hypothetical debate right now, with both sides spinning the "potential" of what the end result might look like, complete with competing analysis, competing opinions, and competing narratives... if the bill passes, we will know in 2018 whether or not it raises taxes (as Democrats suggest) lowers taxes (as Republican suggest) or pretty much stay the same (as nobody is suggesting).

In other words, the proof "will" be in the pudding as they say.

Once the bill passes, the changes take affect, and people's paychecks are effected one way or the other... then you take a poll and find out what people think. Because then it won't matter who is suggesting what, or what side the media is taking, or anything else. The only thing that will matter is whether or not the bill puts more or less money in the pockets of Americans.

Bottom line. Polling today might have some effect with how politicians vote. But polling does not determine how the bill ultimately works. The bill will either raise or lower taxes completely independently of what the public "believes".  If the bill (as I suspect) actually lowers taxes for most people, the suggestions of it being a tax "hike" will no doubt be one of the biggest examples of "fake news" we have seen to date.

There are three reasons, according to nonpartisan tax experts. First, a corporation would pay that global minimum tax only on profits above a “routine” rate of return on the tangible assets — such as a factory — that it has overseas. So the more equipment a corporation has in other countries, the more tax-free income it can earn. The legislation thus offers corporations “a perverse incentive” to shift assembly lines abroad, says Steve Rosenthal of the Tax Policy Center.

Second, the Senate bill sets the “routine” return at 10 percent — far more generous than would typically be the case….As a result, a U.S. corporation that builds a $100 million plant in another country and makes a foreign profit of $20 million would pay roughly $1 million in tax versus $4 million on the same profits if earned in the United States, says Rosenthal, who has been a tax lawyer for 25 years and drafted tax legislation as a staff member for the Joint Committee on Taxation.

Finally, the minimum levy would be calculated on a global average rather than for individual countries where a corporation operates. So a U.S. multinational could lower its tax bill by shifting profits from U.S. locations to tax havens such as the Cayman Islands.

….Companies also are likely to continue to locate valuable intellectual property overseas to pay a lower rate than what they would face in the United States, likely to be around 20 percent, analysts said. “The plan does not meaningfully reduce the incentives for companies to move their operations and shift their income overseas,” [says Rebecca Kysar, a professor at Brooklyn Law School]. “You could say it will make things worse.”

Congressional Republicans have after all, for the past two Presidential terms, fought for their political interests regardless of the consequences. The budget fights, hostage on federal default, denials of every service including those advocated in their own party, the list goes on ...

But the Democrats are more concerned with their philosophical agenda, and their constituents will not abide letting something like this pass, regardless of how it will ultimately damage the Republicans. The US has about the 3rd or 4th highest effective tax rate, around 22% if I recall correctly (and I do). About average for developed nations in fact.

Talking about the nominal tax rate is just another way of being deceptive. The effective rate, the one that matters, is how much they actually pay.

That's the nominal tax rate KD. The amount of taxes that US Corporations actually pay, due to numerous exemptions and loopholes created to offset that high nominal rate, is about 22%. In other words, you've been had by corporate lobbyists and those politicians who've been paid by them.

When he just couldn't take it anymore he lashed out at Republicans: "This is serious stuff. We believe you're messing up America," he shouted. "You could pay attention for a couple of minutes."

My arms and considerably larger and more defined now. I put in an hour or more five or six days a week in the gym. I do that in spite of severe pain due to a damaged lumbar spine. I'm not going to rot away watching Netflix and Amazon prime video.

President Trump monopolizes our list of the year’s worst falsehoods and bogus claims.

Summary
We first dubbed President Donald Trump, then just a candidate, as “King of Whoppers” in our annual roundup of notable false claims for 2015.

He dominated our list that year – and again in 2016 – but there was still plenty of room for others.

This year? The takeover is complete.

In his first year as president, Trump used his bully pulpit and Twitter account to fuel conspiracy theories, level unsubstantiated accusations and issue easily debunked boasts about his accomplishments.

And a chorus of administration officials helped in spreading his falsehoods.

Trump complained — without a shred of evidence — that massive voter fraud cost him the 2016 popular vote. He doubled down by creating the Presidential Advisory Commission on Election Integrity and appointing a vice chairman who falsely claimed to have “proof” that Democrats stole a U.S. Senate seat in New Hampshire.

Even as he mobilized the federal government to ferret out Democratic voter fraud, Trump refused to accept the U.S. intelligence community’s consensus finding that Russia interfered in the 2016 campaign.

Trump disparaged the “so-called ‘Russian hacking’” as a “hoax” and a “phony Russian Witch Hunt,” and compared the conduct of U.S. intelligence agencies to “Nazi Germany.” He then falsely accused the “dishonest” news media of making it “sound like I had a feud with the intelligence community.”

When he spoke of himself, Trump’s boastfulness went far beyond the facts.

He claimed that his inaugural crowd “went all the way back to the Washington Monument,” and sent out his press secretary to declare it the “largest audience to ever witness an inauguration, period, both in person and around the globe.” He described his tax plan as the “biggest tax cut in the history of our country,” and took credit for making the U.S. nuclear arsenal “far stronger and more powerful than ever” after seven months on the job. None of that was true.

Trump is clearly an outlier. If he and his aides were removed from our list, we would be left with a dozen or more notable falsehoods roughly equally distributed between the two parties. You’ll find those at the end of this very long list.

Forgive us for the length. But consider this: It could be even longer.

Because I am pretty sure that taxes will either go up or go down irrelevant of what polls suggest. I am pretty sure there isn't a provision in the law that waits for poll results before determining the new tax rates.

Moreover, one would suspect that any Republicans who believed that it would be a tax hike for them (because that is what they've been told) will be the first to change their minds about it, if in fact they get a tax cut.

It's the economy, stupid. If people start earning more money, and companies start earning more profits, and people get to keep a larger portion of their paychecks, they will be happy.

2018 is a political lifetime away and 2020 is several political lifetimes away.

A highly partisan group of House Republicans has gathered secretly for weeks in the Capitol in an effort to build a case that senior leaders of the Justice Department and FBI improperly — and perhaps criminally — mishandled the contents of a dossier that describes alleged ties between President Donald Trump and Russia, according to four people familiar with their plans.

A subset of the Republican members of the House intelligence committee, led by Chairman Devin Nunes of California, has been quietly working parallel to the committee's high-profile inquiry into Russian meddling in the 2016 presidential election. They haven't informed Democrats about their plans, but they have consulted with the House's general counsel.

The people familiar with Nunes' plans said the goal is to highlight what some committee Republicans see as corruption and conspiracy in the upper ranks of federal law enforcement. The group hopes to release a report early next year detailing their concerns about the DOJ and FBI, and they might seek congressional votes to declassify elements of their evidence.

That final product could ultimately be used by Republicans to discredit special counsel Robert Mueller’s investigation into whether any Trump aides colluded with Russia during the 2016 campaign — or possibly even to justify his dismissal, as some rank-and-file Republicans and Trump allies have demanded. (The president has said he is not currently considering firing Mueller.)

Republicans in the Nunes-led group suspect the FBI and DOJ have worked either to hurt Trump or aid his former campaign rival Hillary Clinton, a sense that has pervaded parts of the president’s inner circle. Trump has long called the investigations into whether Russia meddled in the 2016 election a “witch hunt,” and on Tuesday, his son Donald Trump Jr. told a crowd in Florida the probes were part of a “rigged system” by “people at the highest levels of government” who were working to hurt the president.

The sources familiar with the separate inquiry said it was born out of steadily building frustration with the Justice Department's refusal to share details of the way the Trump dossier was used to launch the FBI's investigation of his campaign team last year — or whether it was the basis for any court-ordered surveillance of Trump associates.

The group is relying on the same documents and testimony provided by top Obama administration officials — such as former acting attorney general Sally Yates, former attorney general Loretta Lynch and former UN ambassador Samantha Power — who were grilled as part of the intelligence committee's broader Russia probe.

It's unclear how many members of the intelligence committee are participating in the side effort. Lawmakers on the full committee interviewed by POLITICO refused to discuss it.

"I don't talk about what we do behind closed doors," said Rep. Mike Conaway (R-Texas), who's leading the intelligence committee's bipartisan Russia probe. "I'm not going to talk about that," said Rep. Peter King (R-N.Y.), another member of the panel.

DOJ and FBI officials also declined to comment. Deputy Attorney General Rod Rosenstein defended the FBI and Mueller's team at a recent hearing on Capitol Hill. "The special counsel investigation is not a witch hunt," he said.

Rep. Adam Schiff (D-Calif.), the top Democrat on the House intelligence committee, said he wasn't aware of the Nunes effort but said it fit with what he sees as an increasingly destructive bent in Republicans’ rhetoric and actions.

"I think what we are seeing in our committee ... is an effort to attack the Department of Justice, an effort to attack the FBI, to attack Bob Mueller, is an effort to undermine the investigations and these institutions out of fear of what they’ll find and try to discredit them in advance," he said. "It’s a pernicious thing to do that will ultimately inflict long-term damage on these institutions."

The Nunes-led group is the latest evidence of an increasingly toxic and bruising confrontation between Republicans on Capitol Hill and the highest ranks of the justice system. Some Hill Republicans are irate about the Justice Department's refusal to provide more details about its investigation of Trump associates' ties to Russia. They're also frothing over the FBI's handling of the Trump-Russia dossier, which GOP lawmakers have openly mocked as "discredited" and "disproven.”

In recent weeks, GOP lawmakers have berated top Justice Department officials and threatened to hold them in contempt of Congress, and a couple of rank-and-file members described ongoing investigations of Trump associates in startling terms — including as a potential "coup" attempt. On Wednesday, Fox News reported that Nunes intends to subpoena senior FBI agents connected to the dossier.

Earlier this week, Senate Judiciary Committee Chairman Chuck Grassley (R-Iowa) called for the FBI's deputy director, Andrew McCabe, to be replaced amid claims by Republicans of anti-Trump bias infecting the bureau. And Gowdy, the chairman of the House oversight committee, joined House Judiciary Committee Chairman Bob Goodlatte on Tuesday to request interviews with senior FBI officials as early as Thursday — which some lawmakers say is the precursor to subpoenas.

Does the 4th Amendment apply to private emails in general? I say yes, and cite the famous United States v. Warshak.

Government served emails are a little less clear. A different legal standard was applied in O'Connor v. Ortega, regarding the privacy of publicly employed. The main thrust here is with regards to "workplace policy" - eg, you're SOL.

The thing that complicates this question is whether you consider it in the public-sector or private sector context. I haven't even gone into this since CH et al haven't gotten past the first steps yet, let alone nuances like this. There are two directions here, depending on which, and both ultimately resolve against Trump; but it doesn't matter since Trump's lawyers are making a different (dubious) argument based on Quon v. Arch Wireless, (which extended privacy rights based on an "informal understanding" where the bosses verbally told employees that they don't read the emails)

I think this "informal understanding" is extremely weak in the case of GSA email accounts, because GSA officials deny it. Technically, GSA consent is sufficient (without a warrant) because of the policy and because of the prior notification.

Granting for the sake of argument, government searches of computers and data are allowed without a warrant, even when there is an expectation of privacy, as long as there is reasonable suspicion of workplace misconduct. So even if transition employees DID have some 4th amendment protections (for the sake of argument), Mueller still probably doesn't need a warrant under the workplace framework. Given GSA cooperation, he probably doesn't even need the misconduct (although he almost certainly had a reasonable basis to believe misconduct).

So please, in that reasoning, what exactly is it that I "think I know" but really don't?

You should understand that "the top corporate tax rate" of 39% is the nominal top tax rate, and not what Corporations actually pay. It's only one factor in calculating corporate taxes, and is cut in half by the time the check is signed.

The 18% is the percentage of total revenue, of all corporations. Some pay more, others less, perhaps some pay zero and a few pay the 39%. There is disparity in effective rates. Disparity leads to free market distortions (and BAD tax policy). Therefore simply reducing the top nominal tax rate does NOT resolve the distorting disparities, UNLESS you also eliminate the special exemptions and loopholes that allow corporations to cut their actual tax bill in half.

Factor in the deductions etc and:

Argentina is highest at 22.6%
Japan 21.7%
UK 18.7%
US 18.6%
Brazil 17%
Germany 15.5%

As you can see, US taxes are at the high end, but they are NOT the highest in the world and certainly not any 39%.
