Trump, GOP win shutdown fight (for now)...
Dems crawl away with their tail between their legs...

That seems to be the major consensus at this point. Liberals are saying that the Democrats caved. Conservatives are saying that the Democrats caved. FOX reports that Schumer and gang caved and blinked. CNN and MSNBC are reporting just the facts (suggesting they cannot find anything in the deal to claim any sort of Democratic victory).

Moving forward, both groups agreed to work on comprehensive immigration reform, with some mixed messages about DACA. Schumer suggested that if there is no agreement on comprehensive immigration reform before Feb 8th, that a clean DACA bill will be put up for vote. But McConnell and others are simply suggesting that they are opening up the floor to debate, and will allow amendments from both sides as part of the process. There has been no acknowledgement from any Republicans that they agreed to pass (or even vote on) a clean DACA fix at any point. There is no guarantee that such a clean vote would pass the House, get 60 votes in the Senate, or be signed by the President (considering passing a clean DACA bill basically guarantees an end to any comprehensive immigration bill).

Perhaps this is more of a threat by Schumer and Democrats, that if an immigration deal is not reached prior to the Feb 8th deadline, that they will again push a shutdown over DACA. But if that strategy didn't work today, it won't work on Feb 8th. Especially considering the two sides will have over two weeks to work out the endgame to an immigration bill that they have already been working on for months.

The reality that Schumer and the Democrats have to accept is that there will be no DACA fix that is not part of a comprehensive immigration deal where they have to concede to both Trump and Republicans on several points. Yeah, this will piss off their base. But it may be their only way forward.

Chuck Schumer accepted Mitch McConnell’s promise to vote on Dreamers in exchange for reopening the government. If he breaks that promise, all hell will break loose.

Two truths emerged from a deal that the Senate cut on Monday to re-open the federal government after a weekend-long shutdown. The first is that Democrats caved. The second is that they find themselves somewhat better positioned for what is likely to be another, far more bitter, shutdown battle in the coming weeks.

Senate Minority Leader Chuck Schumer (D-N.Y.) announced on Monday that he would accept a deal that would fund the government through Feb. 8 in exchange for a relatively vague promise from Senate Majority Leader Mitch McConnell (R-K.Y.) to bring up legislation that would address the so-called Dreamers—undocumented youth brought to the U.S. illegally.

The deal was, on its surface, devoid of a major win for either party—but especially for Democrats. Republicans kicked the can down the road on government funding, but they also gave no concrete policy concessions in exchange for votes. A majority of Senate Democrats sided with them anyway.

“Are you looking for a spine?” one top Senate Democratic aide told The Daily Beast after the Senate vote concluded. “Because, I don’t have one to sell you.”

But the loss obscured what others saw as a longer term gain for Democrats. As Congress now goes about considering immigration reform, there are new political variables at play.

Republicans no longer have children’s health care as a political cudgel against Democrats, since the bill that passed on Monday includes a six-year authorization for the Children’s Health Insurance Program (CHIP). And McConnell is on the spot to follow through on his pledge to resolve the standoff over the Deferred Action for Childhood Arrivals (DACA) program.

In caucus meetings, Senate Democrats made the case that they need to show Republicans that they are willing to go to extreme lengths—even forcing another shutdown next month—in order to salvage DACA protections. Liberal activists are expected to mobilize a campaign to pressure Democrats to keep their word.

The Democrats who voted for the stopgap funding extension on Monday argued that McConnell’s promise was so public that it would be a political disaster for the majority leader if he reneged.

“There is no way that we would have been on immigration had we not forced the issue,” Sen. Brian Schatz (D-HI) told The Daily Beast, characterizing the shutdown as a victory. “This is the first time ever that, under Republican control, we’re taking up this issue. … Had we not stood firm, there’s no way that Leader McConnell would be taking up DACA.”

President Donald Trump has signed into law a bill that ends the government shutdown, and provides congressional negotiators with additional time to hammer out an immigration reform package capable of passing both the House and Senate.

Hundreds of thousands of federal employees are expected to return to work on Tuesday morning, after spending the day Monday on furlough.

The bill funds the government for 17 days, and it funds the popular CHIP children's insurance program for six years. It does not include a permanent fix for the Obama-era DACA program, which Senate Democrats had originally demanded.


Negotiations over the bill took place almost entirely in the Senate, where on Friday night, Majority Leader Mitch McConnell had been unable to reach the 60 vote threshold required to keep the government open.

But on Monday morning, the first official day of government employee furloughs, McConnell said he intends to bring DACA and other immigration issues up for debate before Feb. 8. Later, Senate Minority Leader Chuck Schumer confirmed an agreement to reopen the government and tackle immigration within three weeks.

Trump had been largely absent from negotiations for the past three days, speaking to congressional Republicans by phone, but refusing to speak with Democrats.

Following an initial Senate vote on Monday, the president issued a statement saying he was "pleased that Democrats in Congress have come to their senses."

Trump also pledged, "once the Government is funded, my administration will work toward solving the problem of very unfair illegal immigration. We will make a long-term deal on immigration if, and only if, it is good for our country."

How such a deal might be structured, so as to have a chance of passing the Republican controlled House, is fast becoming the thorniest question in Washington D.C.

Democrats need to accept that a government shutdown "last stand" is not the way to go about it, even if it was a political net positive. Most Americans blamed the Republican stubbornness for the short shutdown, approve of the Democrats' aims with DACA, yet disapprove of shutting the federal government down, so a short stall is the best they can hope for, and still come out looking better than the Republicans. Not that it will matter either way in two months.

As far as DACA itself, the Democrats need to stick to their guns and if so they will prevail. It will probably help when McConnell inevitably reneges on his deal - even if tries to honor it in good faith, his own members are certain to balk at honest debate let alone a vote. The Democrats will leverage that, and if it comes to a shutdown showdown again they will be seen as having more reasonable justification for it.

That's pretty much how I see it as well, WP. The longer a shutdown continued, the more the Democrats would be blamed for it. They did a good job of blaming Republicans (especially Trump and his staff) for precipitating the shutdown, but weren't going to get any real concessions at this point.

This wasn't a victory for the President. He had little or no impact on the vote. He was silenced by the staff.

The Democrats knew it was a no win situation. Nine months from now, it won't have an impact on the blue wave in November.

McConnell knows that he can't believe anything coming from the President. He said that DACA will be addressed. They will fund the wall that he promised Mexico would pay for. But the immigration reform bill might just get passed in the Senate. But in the house, the anti-(freedom caucus) may again block it from even taken to the floor.

Net negative is likely, because even though it won't impact the blue wave in November. But unless they can avoid another shut down this one will be the Trump government shutdown.

I don't think that the President is going to be a major factor, because he doesn't have a clue on how to govern. And his staff will keep him under a tight rein.

Here is a another example of the chaos in the White House.

Attorney General Jeff Sessions — at the public urging of President Donald Trump — has been pressuring FBI Director Christopher Wray to fire Deputy Director Andrew McCabe, but Wray threatened to resign if McCabe was removed, according to three sources with direct knowledge.

Wray's resignation under those circumstances would have created a media firestorm. The White House — understandably gun-shy after the Comey debacle — didn’t want that scene, so McCabe remains.
Sessions told White House Counsel Don McGahn about how upset Wray was about the pressure on him to fire McCabe, and McGahn told Sessions this issue wasn’t worth losing the FBI Director over, according to a source familiar with the situation.
Why it matters: Trump started his presidency by pressuring one FBI Director (before canning him), and then began pressuring another (this time wanting his deputy canned). This much meddling with the FBI for this long is not normal.

“Undocumented immigrants are at least 142 percent more likely to be convicted of a crime than other Arizonans. And it’s worse for DACA-aged illegals.

For example, he wrote, “while undocumented immigrants from 15 to 35 years of age make up about 0.81 percent of the Arizona population, they make up almost 8 percent of the prison population.”

According to his estimates in Arizona:

DACA-age immigrants represent 71.2 percent of the undocumented immigrants in prison.

DACA-age eligible undocumented immigrants are 884 percent more likely to be convicted of crimes than their share of the population.

DACA has become so central to the Democratic base that it risks fracturing the party unless Schumer and others get some substantial concession from Trump. If they don’t, and Democrats accept a water-down DACA deal that doesn’t create a million new citizens, plus preserve chain migration so that million becomes several million, the Democrat base will flip out.

Trump could fracture the Democrat Party by permitting DACA recipients to stay in the country — something he has said he wants to allow — but insisting on such other terms and limitations as to present Democrats in Congress with an impossible choice between no DACA deal and a “bad” DACA deal.

That assumes, of course, that Trump holds the line. If Trump does hold the line, the result could be a Democrat Party torn apart with recriminations.

Shutdown Battle Is Only on Pause

“Washington will be back on the brink in less than three weeks. Lawmakers may have pulled themselves out of a debilitating government shutdown Monday, but the fight over immigration and spending that’s ground virtually all congressional business to a halt is far from over. And the fundamentals of the debate haven’t changed at all.

“Republican leaders are under increasing pressure from their own members to reach a long-term budget agreement by Feb. 8, when the government next runs out of money. Their defense hawks are desperate to increase defense spending, a key 2018 priority for President Donald Trump. And their members are sick of voting on short-term funding bills that they say cripple the military.
