Is Mueller off in left field?

George Nader, a Lebanese-American businessman, has hovered on the fringes of international diplomacy for three decades. He was a back-channel negotiator with Syria during the Clinton administration, reinvented himself as an adviser to the de facto ruler of the United Arab Emirates, and last year was a frequent visitor to President Trump’s White House.
Mr. Nader is now a focus of the investigation by Robert S. Mueller III, the special counsel. In recent weeks, Mr. Mueller’s investigators have questioned Mr. Nader and have pressed witnesses for information about any possible attempts by the Emiratis to buy political influence by directing money to support Mr. Trump during the presidential campaign, according to people with knowledge of the discussions.
As many wise investigators will tell you, the key to proving a case is to find the evidence. They will tell you that generally speaking investigators who spend most of their time trying to get a variety of people to confess to crimes, are doing so because they simply have no evidence.

There are many different stories being painted about the Mueller investigation. On one hand, you have the never ending stories from certain members of the press who continue to tell us that Mueller is closing in, that he is cornering the President, that he is just a line or two away from connecting the dots. On the other hand, you have many who will tell you that Mueller is behaving exactly like an investigator who is becoming increasingly frustrated chasing around in search of a crime he is cannot even be certain exists.

Now, certainly both theories could ultimately be the reality.

Mueller really might have all sorts of evidence piled up in his virtual evidence vault, and he is simply carefully biding his time, lining up his ducks, crossing the t's and dotting the i's.  Perhaps in moving his focus towards a Lebanese businessman he is simply trying to pile on a few extra crimes to charge the Trump team with.

Or, as others suggest Mueller talking to a Lebanese businessman is a sign that he still has nothing to show for his time, and that his hunt for "any" evidence of collusion has been expanded by necessity. These are the ones who see Mueller as frustrated, out to get scalps by any means, and desperate to find something/anything to tie someone named Trump to some sort of crime.

The bigger problem Mueller, and ultimately Rosenstein run into at this point is the so called expansion of the investigation provides plenty of ammunition for critics to allege abuse. Those allegations become more and more real depending on how much Mueller has actually found.

Now provided Mueller does have solid evidence of corruption and crimes, then expanding out to see just how far this corruption goes is warranted. Nobody would (or should) question the decision to check for "more" of the same sort of corruption that Trump (theoretically) engaged in with Russians. Simple logic dictates that if he colluded with the Russians for election help, then he probably colluded with other foreign powers as well.

But imagine for a second that critics are correct and Mueller has no real evidence of collusion between the Trump campaign and the Russians. Considering that many people felt that the entire appointment of special counsel was dubious to begin with, the lack of finding anything confirms their doubts. But it would be a much bigger problem would be if Rosenstein allowed Mueller to keep fishing into other areas without strong evidence that there is some crime involved. You simply don't get to use special prosecutors with unlimited budgets to hunt for crimes without probable cause to believe they have been committed.

Bottom line: The difference between this being a legitimate, thorough investigation by the Mueller team, and it being a problematic witch hunt is entirely based on the hard evidence of criminal activity that Mueller has actually found. If he has hard evidence of criminal conspiracy, then everything he is doing (including expanding this toward other foreign interests) is legitimate and necessary. If he has not found any hard evidence of criminal conspiracy at this point, then it's certainly fair to call an expansion of the investigation as political witch hunt.

At this point... we really don't know for sure the truth.

For reasons I can only speculate about (and believe me, I shall), President Trump decided to show up at the annual Gridiron Dinner. At a fundraiser ahead of the event, he proceeded to use his time to make a few points on policy but do so while weaving in jokes and barbs, some aimed at himself and others targeting his usual list of suspects (mostly the media). Why was this a bad idea? Because, in their usual fashion and just as they do with his Twitter feed, the press decided to interpret one of his jokes as a new policy pronouncement. This time it dealt with the idea of repealing the 22nd Amendment and allowing someone to serve as president for life. (Huffington Post)

Roger -

Obviously you engage in selective reading. Not only does Mueller himself have a reputation for bully tactics, such as threatening indictments (that would cost the target too much $$$ to fight) but several of the people working for him have had serious issues with bad practices.

Andrew Weissmann (arguably his top prosecutors on the probe) obtained pleas or convictions of four different executives in a case against Merrill Lynch. The 5th circuit court overturned all four because of prosecutorial misconduct.

Weissman also had the conviction of a prominent Enron executive overturned by the U.S. Supreme court for misconduct.

The judge at one trial that Weissman prosecuted told one of the defendants as the plea hearing that he was pleading guilty to a crime that didn't exist.

All of these convictions were overturned because Weissmann withheld evidence from the client, intimidated witness with threats of indictments and high legal costs to fight them, and basically created crimes that did not exist.

This were just the highest profile cases for this particular person.

Btw... these allegations against members of the Mueller team seem remarkably similar to what General Flynn went through. Charging someone with a dubious crime (one that the FBI agents said he didn't commit). The withholding of evidence from the defense team. Running the person financially dry till they have no choice but to either ruin their families or accept a plea.

An honest person doesn't put dishonest people at the top of their teams, Roger.

Several of his cases have been tossed out by the courts for prosecutorial misconduct.

That's a significant difference.

And of course you have to hold Mueller accountable for who he picks on his team. It goes entirely to his state of mind.

He is given what amounts to a counterintelligence probe... and the main person he adds to his team is a guy known for bending/breaking the rules in order to garner pleas and convictions.

What does that tell you about Mueller's mindset?

Did he find someone familiar with counterintelligence? Did look for someone with knowledge of international legal cases? No, he looked for a bully (like himself) who attempts to put as many people in jail as he can, by any means (fair, unfairl, legal, illegal) possible.

You simply "choose" not to consider it.

Powerline

POSTED ON DECEMBER 5, 2017 BY PAUL MIRENGOFF IN ROBERT MUELLER, RUSSIA INVESTIGATION
ANDREW WEISSMANN, PROUD MEMBER OF THE RESISTANCE
Andrew Weissmann is Robert Mueller’s top assistant in the Russia probe. He is also a member of the anti-Trump resistance.

This is no longer a suspicion. We know it’s true because Judicial Watch obtained an email Weissmann sent to fellow resistance member Sally Yates after she refused to comply with President Trump’s order to issue a travel ban. Weissmann gushed:

I am so proud. And in awe. Thank you so much. All my deepest respects.

Of course Weissmann was proud. Refusal by a government functionary to carry out a presidential order is a quintessential act of resistance.

Judicial Watch president Tom Fitton calls Weissmann’s email “an astonishing and disturbing finding.” Well, disturbing anyway. I’m not astonished. Weissmann’s praise reflects the view of many liberal lawyers in Washington, D.C. I bet it’s shared widely within Mueller’s team.

In any case, it’s clear that Mueller’s right hand man is a blatant anti-Trump partisan. His presence on Mueller’s team compromises the integrity, if any, of that operation.

To make matters worse, Sally Yates, the resistance member Weissmann holds in awe, figures in the investigation Mueller’s team has conducted. She’s the one who, according to her testimony to Congress, informed White House Counsel Don McGahn that Michael Flynn had made untrue statements about his talks with the Russian ambassador, and discussed with McGahn possible criminal prosecution of Flynn.

Yates’ alleged statement was relevant to Mueller’s investigation of Flynn. He was, after all, prosecuted for making what Yates deemed false statements, just as Yates says she warned he might be.

More importantly, Yates’ alleged report to the White House Counsel might be relevant to an investigation of President Trump. Andy McCarthy has written:

The day after firing Flynn, Trump had the White House meeting at which — according to the testimony of former FBI director James Comey — Trump pressured Comey to drop the Flynn investigation. . . .Thus, if Trump knew that Flynn had lied to the FBI, he was asking Comey to drop a case against someone he knew had committed a crime.

But if Trump didn’t know at that time that Flynn had lied (or that he might have lied) to the FBI, then he wasn’t asking Comey to drop a case against someone he knew (or believed) had committed a crime. Big difference.

Yates, then, might become an important witness in an investigation for alleged obstruction of justice by the president. Her veracity might be pivotal.

It might also be contested. Major Garrett of CBS News reports that “sources with direct knowledge” say that Yates never told the White House Counsel what she testified she told him regarding Flynn’s legal jeopardy.

Yates can take comfort that her veracity will be judged by a team whose number 2 guy (and likely other members) holds her in awe.

Do you realize that the Powerline story is an entirely "different" reason than I gave to discount Weissmann as a legitimate pick to be one of the head prosecutors?

Not only (as I explained) is he a person with a past history of prosecutorial misconduct... but he is also someone who has shown a blantant anti-Trump bias?

Does none of that compute with you?

Or do you simply discount anything you read that doesn't some from WaPo, NYT, Politico or some other left wing site???

C.H. Truth said...

Like the other day where you didn't believe a legitimate news story that was covered by everyone... simply because the link provided was from Breitbart.

It's embarrassing for you to simply discount factual information because the person who provides it is conservative.

Weissmann's legal issues are a matter of public record. Those court cases are not in dispute. They are not reported from "anonymous sources" or part of some opinion piece.

It's one thing to challenge an opinion, or not believe a "source" that has no verification to back it up.

But it's entirely another for you to discount facts because you don't like the author who provides it to you.

Coldheartedtruth Teller said...

The Australian diplomat whose tip in 2016 prompted the Russia-Trump investigation previously arranged one of the largest foreign donations to Bill and Hillary Clinton’s charitable efforts, documents show.

Former Australian Foreign Minister Alexander Downer’s role in securing $25 million in aid from his country to help the Clinton Foundation fight AIDS is chronicled in decade-old government memos archived on the Australian foreign ministry’s website.

Downer and former President Clinton jointly signed a Memorandum of Understanding in February 2006 that spread out the grant money over four years for a project to provide screening and drug treatment to AIDS patients in Asia.

[...]

Downer, now Australia’s ambassador to London, provided the account of a conversation with Trump campaign adviser George Papadopoulos at a London bar in 2016 that became the official reason the FBI opened the Russia counterintelligence probe.

But lawmakers say the FBI didn’t tell Congress about Downer’s prior connection to the Clinton Foundation. Republicans say they are concerned the new information means nearly all of the early evidence the FBI used to justify its election-year probe of Trump came from sources supportive of the Clintons, including the controversial Steele dossier.

“The Clintons’ tentacles go everywhere. So, that’s why it’s important,” said Rep. Jim Jordan (R-Ohio) chairman of a House Oversight and Government Reform subcommittee that has been taking an increasingly visible role defending the Trump administration in the Russia probe. “We continue to get new information every week it seems that sort of underscores the fact that the FBI hasn’t been square with us.”

Spokesman for the FBI and Russia special counsel Robert Mueller declined comment.

the fact is, you want trump gone by any means necessary. impeachment, 25th amendment removal, obstruction of justice...anything. you've made that much clear. when presented with overwhelming evidence that mueller's lead prosecutor is as crooked as a dog's hind leg, you look the other way and dismiss the charge as " a leap of faith. Not backed by cold hearted evidence."

so like most liberals, this has become personal for you. you sit there oozing hatred for trump, demanding his removal from office, not for any legitimate reason, but simply because your side lost an election. and fwiw, i get the fact that clinton's loss was especially painful. your side, which includes the media, did everything in their power to rig it for her to win. fawning news stories, leading polls predicting a landslide victory; for chrissakes you even had the FBI let her off the hook after having her dead to rights on over a dozen criminal charges. she lost a fixed fight to a loudmouth asshole from queens.

so anyway, don't insult our intelligence by telling us you're being objective, analytical, or seeking the truth. you have a singular goal - the removal of trump. legally, illegally.... shit, you would even applaud his death. especially if it came at the hands of a guy like the nutbag who almost took out steve scalise.

that's how much you hate the man. it is that which you have made crystal fucking clear.

Your argument is based upon racism.

no alky, my argument is based upon my desire for our nation to retain its sovereignty.

today is march 6th. your beloved -

Democrats
Against
Citizen
Americans

- has expired.

so now we have to figure out what to do with the 1M+ criminals who have invaded our once sovereign nation.

.Justice Robert Jackson, the great champion of due process and the dissenter in the Korematsu case, said that "due process does not invest any alien with a right to enter the United States, nor confer on those admitted the right to remain against the national will" (Shaughnessy v. Mezei, 1953).

This conclusion reigned supreme in our body politic and the court system from the founding of our country... Even as they were concocting one BS right after another for Americans, they all understood the concept of national sovereignty - that courts cannot create rights for aliens to immigrate or remain in the country against the national will. This is reflected in an uninterrupted stream of caselaw that has been regarded as the most settled area of law.

Yet here we are, on March 5, when the president promised to terminate Obama's illegal amnesty, and the citizenry of this country is now forced against our will to accept foreign nationals into our society.

he's an intellectual clod and fraud. weissmann is a piece of shit on par with sid blumenthal or the prosecutors in wisconsin's 'john doe' witch hunts. every bit of objective evidence supports this fact. yet the asshole thinks he's wp jr. or something with his horseshit objective "analytical analysis."

terry schiavo on her worst day was a deeper thinker than the alky.

he's the CHT embodiment of the invincible ignorance fallacy:

The invincible ignorance fallacy[1] is a deductive fallacy of circularity where the person in question simply refuses to believe the argument, ignoring any evidence given. It is not so much a fallacious tactic in argument as it is a refusal to argue in the proper sense of the word, the method instead being to either make assertions with no consideration of objections or to simply dismiss objections by calling them excuses, conjecture, etc. or saying that they are proof of nothing; all without actually demonstrating how the objection fit these terms (see ad lapidem fallacy).

Now that Gallup has quit the field, Rasmussen Reports is the only nationally recognized public opinion firm that still tracks President Trump's job approval ratings on a daily basis.

I just don't believe that because a prosecutor who worked for Muller had several of his cases have been tossed out by the courts for prosecutorial misconduct, just doesn't convince me that Muller is pursuing the investigation into the Russian intervention into the election of Trump because of political bias. That's a leap of faith. Not backed by cold hearted evidence.

Apples and oranges.

The fact that he chose a white collar prosecutor with a history of bending and breaking the rules to garner convictions... to sort of head up his staff does not provide evidence of "bias"...

It provides evidence that his main concern is not information gathering, but rather his main concern is to prosecute as many "crimes" as he can find, right wrong or indifferent.

The logic from the article from Powerline (and other evidence that he picked mostly anti-Trump pro-Hillary people to fill out his staff) IS evidence of bias.

Anyone with a normal amount of intelligence would see the obvious. As someone who suggests he is a "genius" - this should be a no-brainer.

and this is why the alky is such a weissmann fan. ol' rog wants a conviction by any means necessary. it could be the most illegal conviction in the history of modern jurisprudence. if it gets trump removed from office it works for him.

The double standard here has a breathtaking scope. Trump's staff, who cares about financial crimes, long passed, I'm told again and again. That was before the election - it's your go-to defense. Agent of a foreign enemy, no problem, that was before and this is now. Trump and his family partnered with foreign mob bosses, (with convictions I'll add), just business. Obstructing justice by lying to investigators, that's just a trivial "gotcha" you say.

But a prosecutor "bending or breaking rules" for a conviction that gets thrown out, my God!! It's "obvious" evidence of bias, not just the prosecutor's but the guy who hires him, obvious to "anyone with a normal amount of intelligence". WooHooo, by GUM that's dastardly. Hiring evil minions like that, who he can bend to his craven political will. That's 'obvious proof' of it.

Trying to garner the viewership of Trump supporters, I wager. Combine the prurient angle with the hint of "get Trump fake news" and it's dead certain. Heck, you're already advertising it for them. Kind of brilliant if you asked me.

if you're seeing even a single parallel between the accused and the lead prosecutor you're delusional, or in the midst of a below average troll.

this is something roger would say after downing a fistfull of narcotics.

wphamilton said...

A: One (or more) of Mueller's prosecutors, prosecutorial misconduct in the past. The reasoning is that by employing them Mueller has shown his bias and other malfeasance.

B. Several of Trump's staff charged with multiple felony counts from the past. The reasoning is that it has nothing to do with Trump, because the criminal actions were before he was elected.

You don't see the parallel, rrb, nor the irony of someone holding both views? You think that someone who notices it is delusional???

If it WAS a troll, the fact that RRB has already spent three posts calling it "delusional", a "fistfull of narcotics" dream, and trolling (x3) would show that he's already fallen for it.

However, my post provides clarity to a befuddled position held by the Trump camp, so it's hardly trolling. He simply has no answer to it.

Well a few of things here, WP...

1) Quite obviously, people like Paul Manafort had never been charged with any crimes when he was hired by Donald Trump. In fact, the FBI was well aware of Manafort's business dealings, but never chose to charge him with any crimes. On the flip side, Weissmann's misdeeds were known and taken into consideration by Mueller.

2) Those who have been found to have been skirting the law, have been removed from the Trump administration. Weissmann is still employed by Mueller.

3) I am not advocating that Trump "should have" hired anyone who skirted the law, nor do I believe that Trump "should have" kept them around. Quite obviously, you have no issue with Mueller hiring someone with a checkered ethical prosecutorial past... and you have no issue with Mueller keeping him on.

You, WP... are the hypocrite here. Thanks for pointing that out.
