Is Mueller "trying" to get fired?

A couple of pundits have started floating the theory that due to a lack of any substantial uncovering of Russian collusion, or anything close to that portion of the investigation... that Robert Mueller will start to push the envelope to the degree that it may actually force Rosenstein to take some sort of action (up to or including firing the Special Counsel), which of course would directly be blamed on President Trump.

The idea, of course, that short of actually being the guy to bring Trump down, Mueller could make take a cue from James Comey and instantly becomes a celebrity martyr, with the ability to sell out book signings and speeches regarding the time spent looking into Donald Trump. Being fired, of course, would probably create the illusion that whatever confidentiality existed within the special counsel agreement, would be null and void. Similar to James Comey, deciding after his firing, that it was okay to leak FBI information to private friends to get it published.

Even it it was later determined that Mueller wanted to expand the investigation into areas that it did not warrant, his fans would ultimately see any push back from DOJ to be paramount to obstruction. He could simply suggest that he was just about the crack the case, when his investigation was brought to a premature end. Sort of like the Adam Schiff rebuttal to the Nunes memo. It's not that we didn't find anything, it's that we didn't look hard and long enough.

On the flip side, imagine that the investigation actually came to an end because Mueller himself ran out of leads. Imagine a report from Robert Mueller that actually declared that there was no actual evidence of Trump/Russia collusion (or at least none worthy of any legal action). Imagine how this would play out with the faithful.

Perhaps being "fired" would be a better political outcome than completing an investigation that comes up short. Well, it's a theory worth considering.

Just a short while ago, federal agents, apparently with guns drawn, raided St. Andrew's Episcopal in Maryland, where the president’s youngest child, Barron, who just turned 12, goes to school. Early reports are confusing, but this is sure to be a major story. Some pundits have expressed skepticism about the heavy-handed behavior of the FBI in this case, but Rachel Maddow expressed the consensus opinion in Washington when she said that the whole future of our democratic society is at stake. “Robert Mueller is a national hero, a real straight arrow,” she said. “It is imperative that we let him follow the evidence wherever it may lead.” Steven Hatfill, the government virologist whom Mueller wrongly fingered for the 2001 anthrax attacks, was unavailable for comment, probably because he is off somewhere enjoying the $5.8 million settlement he won from the government and various media outlets who hounded the poor man on the authority of Robert Mueller.

Trying to get fired, to cash in on the notoriety? I doubt it. Mueller is going for the brass ring, and he won't stop unless or until he can allege criminal wrongdoing by President Trump. That's the only thing consistent with his history as an investigator and the charges he's brought, which have included very "creative" interpretations of penal code to refer, specifically, obstruction of justice.

The only other way that it ends is for Rosenstein, or whoever else Trump replaces him or Sessions with, orders Mueller to wrap it up and present whatever he has.

And that in a nutshell is the problem with special counsels.

Justice is not their goal, getting a head on a trophy is.

The former New York Observer editor has now claimed that Mr Kushner, the former publisher of the paper, informed her that Mr Trump did not believe the “birther” lies he was peddling.

“When I was the editor of the New York Observer, Kushner and I were going back and forth about how the paper should cover him,” Elizabeth Spiers wrote in a post on Twitter.

“I told Jared that I was particularly appalled by his father-in-law’s birtherism stance, which I viewed as cynical and racist.

“He rolled his eyes and said ‘He doesn’t really believe it, Elizabeth. He just knows Republicans are stupid and they’ll buy it’”.

It's a feature, not a bug CS. We need, American jurisprudence depends on, adversarial conflict. One side is looking for guilt, not Justice. The other side is looking to defend, even if his client gets off with something.

Mueller's history is what it is. Based on his past conduct, he's going after an obstruction charge no matter what. At some point, Congress or the Justice Department will end it, Mueller's case will be presented, and then Trump's lawyers (possibly criminal LOL) and his backers in Congress will defend it. That's all as it should be, by design.

The real problem with Special Counsels is the part "at some point ... will end it". That's always the problem, and why there's always an impetus after the fact to make some reform in the statutes that authorize them. What SHOULD happen is, rather than rules on what they can investigate and how they are instituted, are rules on what ends them. Expiration based on time, or some other condition.

It's the prosecutor's job to get to the truth of the matter not to get a scalp.

For example; if Fitzgerald was an ethical prosecutor he would have wrapped up the Valerie Plame investigation just as soon as he learn Richard Armitage was the leaker.

But he needed a scalp so now we know he used deceptive and unethical methods to set a perjury trap for Scooter Libby just so he can have it.

Anyone literate enough to read this blog knows that that is untrue. I'm practically the only person who said, relax there will be no USA war in Syria over this.

BTW the Syrians are celebrating their victory over the USA, due to the fact that the "symbolic" bombing didn't remove Assad's ability to use chemical weapons and didn't impede his military goals at all. Such is the foolishness of bombing symbolic targets to "send a message". Assad (and the Russians) didn't get the "message" the first time, and they're not getting it now.

A truly appropriate and logical response would have been to strike ALL known sites associated with Assad's chemical weaponry. Anything less than that "sends a message" that the USA is powerless to prevent it.

Sending a symbolic message was the goal.

Another, unannounced strike in a day or two, against all of the neglected targets and possibly the air defenses that Syria is so proud off, that would be a brilliant strategic move. Not only would it "send a message" that couldn't be ignored, it would realistically set Assad back as well as call Russia's bluff. But that's not going to happen, not with Trump calling the shots.
