As if Trump had some specific knowledge of everything that happened to Stormy Daniels in Las Vegas. Which maybe he did ... if his lawyers had hired a goon to keep track of her ... which would kind of lend credence to her story, wouldn't it?

"Internet lawyers" should be taken with a grain of salt.

You continue to own all content and information, including photos, that you post on Facebook. You grant Facebook non-exclusive transferable license to use it. So it is absolutely INCORRECT that "you no longer own it".

It may be true that you can expect other people to use whatever you've posted, including photos, but you do retain rights and control to it.

Personally IANAL, if I wanted a site to remove an unauthorized photo of myself, I'd send them a DMCA take-down notice. You can use a form from the DMCA site (IANAL) although just sending a registered letter carries enough threat.

Not that you should IMHO, if you have voluntarily uploaded a photo or similar photos to the offending site already. Just sayin' a notice is more effective than carping in blog post. Take it in good nature, as it is apparently intended.

I saw that story, where the conservative vlogger (who is black) demanded and received his free Starbucks coffee. "I heard you were prejudiced, so I came for my reparations free coffee."

I still don't think Cruz has much to worry about though. Just political instinct ... because I think that voters are lying when they say that supporting or opposing Trump won't be a factor. WP once you grant facebook a non-exclusive transferable license to use it then you lost control of how it is used, and you have no legal recourse to say where and when it is used. In every legal and usual sense you cease to own it.

The pictures are not taken from Facebook. They have all been downloaded (by Roger) at one time or the other onto this particular website for the numerous posts where he believes people want to see him.

All previous photos downloaded to posts are stored on blogger for future use.

If there even was such as thing as an "internet lawyer" I am sure he would say that I have the rights to re-post pictures that were previously posted by Roger on a blog that I allowed him to post to.

CH that would actually depend on the terms of service that he agrees to when uploading the images. Absent any terms transferring rights, technically he could claim copyright and demand that you remove them, even though he uploaded them himself. He won't have any enforceable privacy concerns though, or anything like that.

Blogspot.com TOS doesn't count, unless the TOS is easy to find from your blog. It's all a moot point however, because no lawsuit on something like this is ever going to achieve more than taking the photo down, while on the other hand no site owner with any sense is going to mess with fighting a DCMA takedown order, because it will shut the site down and subject the site owner to penalties. It is therefore, IANAL, completely and utterly pointless to talk about legal rights, privacy, damages etc. If someone wants his picture off, the takedown notice does that. A lawsuit won't, threats won't do it, there are no potential damages.

It just bugs me when someone is irresponsibly spouting off "legal" pronouncements at someone else that has a problem, and it's obvious that he doesn't have a clue, but someone taking him seriously might be harmed.

For those who don't recognize the acronym, IANAL means "I am not a lawyer". It is a shorthand way of saying, this is not legal advice and should not be construed as such. If you take action based on this personal opinion, you are doing so at your own risk.

That said, Roger, I made a living for a decade with an internet site, under my sole administration and control, and utilizing other internet sites, involving creating and publishing thousands of photos, design and text copy (my own property) monthly. I have dealt with IP on a professional basis during that time, and subsequently for corporate entities, and I have direct experience with DMCA and have needed to respond to DMCA notices. I have dealt personally with all of the legal concerns, including those necessary for an internet based business and also inside the courtroom. So you can take my opinion for what it is, or listen to random ignorance from blog commentary. It's entirely up to you. (IANAL)

1. It is an opinion not legal advice.

2. I'm not worried about being sued. If anyone procedes based on an internet blog post without hiring an actual lawyer then they get what they deserve.

But for your education this would be what it take to sue me.

1. I would have had to misrepresent myself as an actual practicing lawyer.

2. I would actually have to accept payment for legal services rendered.

You assumption that someone can sue because he took advice from an internet blog post is pure fiction.
