9th Circuit gets another one right

Court sides with President Trump supporters in riot civil rights lawsuit


The 9th Circuit Court of Appeals sided with attorney Harmeet Dhillon’s clients in the San Jose anti-President Trump riot civil rights lawsuit filed in 2016. The decision denies qualified immunity to the San Jose police officials who Dhillon says forced Trump supporters to walk into a riot. 
The rally was held on June 2, 2016. Juan Hernandez says he is a proud President Trump supporter but also says his support of then-candidate Trump cost him greatly in June of 2016. Hernandez vividly remembers images as Trump supporters left a rally in San Jose. Hernandez says they found themselves in the thick of a riot. “It was really scary because the cops aren’t doing anything, they were just watching everything happen,” said Hernandez. “They started coming to us and they attacked us, we weren’t inciting anything, we weren’t saying anything to them,” he continued. Hernandez says he suffered a broken nose, bruising, concussion and scratches. “Someone needs to be held accountable for it,” said Hernandez.

This is bad news for the First Amendment under President Trump.

President Trump has sought repeatedly to punish journalists for the way they ask him questions, directing White House staff to ban those reporters from covering official events or to revoke their press credentials, according to several current and former administration officials.

At various moments throughout his presidency, Trump has vented angrily to aides about what he considers disrespectful behavior and impertinent questions from reporters in the Oval Office and in other venues. He has also asked that retaliatory action be taken against them.

“These people shouting questions are the worst,” Trump has said, according to a current official. “Why do we have them in here?”

He wishes he could do what Putin would have handled this. Poison shuts her off.

Trump chairs election security meeting but gives no new orders to repel Russian interference.

President Trump chaired a meeting Friday of his most senior national security advisers to discuss the administration’s effort to safeguard November’s elections from Russian interference, the first such meeting he’s led on the matter, but issued no new directives to counter or deter the threat.

The meeting, which lasted less than an hour, covered all the activities by federal agencies to help state and local election officials, and to investigate and hold accountable Russian hackers seeking to undermine American democracy.

“The president has made it clear that his administration will not tolerate foreign interference in our elections from any nation state or other malicious actors,” the White House said in a statement.

Nothing was specifically discussed on Russian intervention into the November elections.

The concerted application of criminal investigations to this activity, writes Savage, finds its roots in the George W. Bush administration, whose Justice Department commissioned a task force under the direction of prosecutor Steven Tyrrell to pursue leakers. Among its early obsession was tracking down those who assisted Risen and fellow New York Times reporter Eric Lichtblau for their stunning 2005 scoop on Bush’s warrantless wiretapping program.The work of the task force would provide the Obama administration a head start in racking up around ten leak prosecutions — more than the tally of all previous administrations combined.

The Obama adminstration’s aggressiveness on this front mushroomed into a scandal in spring 2013, as revelations surfaced that the Justice Department had subpoenaed two months’ worth of phone records of Associated Press journalists, and that it had named James Rosen, then of Fox News, as a potential co-conspirator in a criminal leak as it pursued his reportorial records.

Which is to say that entangling the media in leak investigations isn’t a Trump-era outrage; there’s nothing here for Trump to “normalize.”

Funny I don't recall any mention of the Popodoplis meeting in the warrent affidavit. And if it did it would be rather unusal since the target was Carter Page not Popodoplis.

However, there was whole lot of references to the dossier. In fact a majority of the application was based on it.

I morning. I’m Paul Thornton, and it is Saturday, July 28, 2018. Apologies to anyone who didn’t catch Friday’s epic lunar eclipse — which should be almost everyone reading this, since it put on a show only over the Eastern Hemisphere. Oh well. Let’s take a look back at the week in Opinion.

Setting aside dishonesty, graft, indecency and a host of other ills, the one consistent theme of the Trump presidency has been its crisis management of problems created solely by the administration. Examples abound: a government shutdown rooted in the administration’s cancellation of DACA; desperate trade talks with the European Union because of tariffs threatened by the president; and of course, Trump clarifying, then re-clarifying his comments on Russian election meddling.

By far the most damaging example is the destruction of countless immigrant families thanks to Trump’s “zero-tolerance” policy aimed at asylum seekers and undocumented border crossers. For weeks, the administration has been scrambling to reunite thousands of children it detained with their parents to comply with Thursday’s court-ordered deadline to do. Of course, the White House was not able to meet that deadline, but it wasn’t because of incompetence. Rather, suggests Sen. Brian Schatz (D-Hawaii) in an op-ed article, this was by the administration’s design:

The separation of children from their parents at the Southwest border is not simply a policy that has resulted in immeasurable harm, but a policy designed to inflict it. The government blew its Thursday deadline to reunite these families because it never intended to do so.

How else can we explain what has happened to these families? Some 14 million checked bags are managed by the Transportation Security Administration — and that’s just during Thanksgiving weekend. Even high school students can manage a coat check for an evening without losing everyone’s coats. They match each coat and owner with corresponding tickets, and do not store the coats outside the building, or even thousands of miles away from the event.

The administration did not take even these basic measures when it began to separate children — not coats! — from their parents. It did not use corresponding numbers for the files of parents and children, or take photos of families together, or hand out hospital-style bracelets. It did not house families near one another, choosing instead to hold mothers in California and daughters in Chicago, fathers in Texas and sons in New York City.

In fact, the administration seems to have taken a comprehensive inventory of confiscated items — sneakers, toothpaste, rosaries — everything except which child belongs to which parent.

These are the actions of a government that intended to separate families but did not intend to reunite them. It meant to inflict so much suffering that other families wouldn’t make the dangerous trek. No matter how bad the violence might be in Central America, surely these families would choose to stay united rather than come and be separated.

Did Papadopoulos trigger FICA warrant or the investigation? Those are two entirely different things.

While I have heard the lame excuse that a multi-million dollar two year old investigation was started because of a drunken conversation with someone who appears to be spreading gossip planted with him by our own undercover agent...

I have not heard that same excuse as it pertained to the FICA warrant (other than coming from you).
