Let me get this straight?

So Democrats are proposing a ceiling on the amount of illegal immigrants who can be arrested in our country, based on the fact that many of those arrested have only committed misdemeanors (rather than felonies).

But are passing laws in New York and California which could garner a $250,000 fine or a five year prison sentence for using the wrong "pronoun" to describe the sex of someone who identifies with another sexual "pronoun".

To be clear, many types of assaults, thefts, burglaries, drug possession, and even some domestic/sexual transgressions fall in the range of misdemeanors. But because the person who committed the assault or burglary is not a legal U.S. citizen, we are supposed to let them go.

Meanwhile, if you are a bona-fide U.S. Citizen, you can be roped into financial ruin, or a hefty prison sentence for calling a biological male "he" or "sir" if they prefer to be called "she" or "ma'am".

Is it just me... or is this royally fucked up?

1. Failing To Use the Name or Pronouns with Which a Person Self-Identifies

The NYCHRL requires employers and covered entities to use the name, pronouns, and title (e.g., Ms./Mrs./Mx.)15 with which a person self-identifies, regardless of the person’s sex assigned at birth, anatomy, gender, medical history, appearance, or the sex indicated on the person’s identification.

Most people and many transgender people use female or male pronouns and titles. Some transgender, non-binary, and gender non-conforming people use pronouns other than he/him/his or she/her/hers, such as they/them/theirs or ze/hir.16 They/them/theirs can be used to identify or refer to a single person (e.g., “Joan is going to the store, and they want to know when to leave”). Many transgender, non-binary, and gender non-conforming people use a different name than the one they were assigned at birth.

All people, including employees, tenants, customers, and participants in programs, have the right to use and have others use their name and pronouns regardless of whether they have identification in that name or have obtained a court-ordered name change, except in very limited circumstances where certain federal, state, or local laws require otherwise (e.g., for purposes of employment eligibility verification with the federal government). Asking someone in good-faith for their name and gender pronouns is not a violation of the NYCHRL.

Covered entities may avoid violations of the NYCHRL by creating a policy of asking everyone what their gender pronouns are so that no person is singled out for such questions and by updating their systems, intake forms, or other questionaires to allow all people to self-identify their name and gender. Covered entities should not limit the options for identification to male and female only.



IV. PENALTIES IN ADMINISTRATIVE ACTIONS
The Commission can impose civil penalties up to $125,000 for violations, and up to $250,000 for violations that are the result of willful, wanton, or malicious conduct. The amount of a civil penalty will be guided by the following factors, among others:
• The number of violations;
• The severity of the violation;
• The existence of previous or subsequent violations;
• The willfulness of the violation;
• The employer’s size, considering both the total number of employees and its revenue;
• Any efforts the employer has made to promptly remedy violations; and
• The employer’s actual or constructive knowledge of the NYCHRL.

These penalties are in addition to the other remedies available to people who successfully resolve or prevail on claims under the NYCHRL, including, but not limited to, back and front pay, along with other compensatory and punitive damages. The Commission may consider the lack of an adequate anti-discrimination policy as a factor in determining liability, assessing damages, and mandating certain affirmative remedies.

Washington — After hours of deliberations, Republican and Democratic appropriators said Monday night they have reached "an agreement in principle" on legislation to fund the government past the Friday deadline and avert another shutdown.

Lawmakers were scrambling to flesh out an agreement and have a budget measure ready before the current continuing resolution (CR) expires Friday.

Over the weekend, talks between a bipartisan group of House and Senate negotiators, largely made up of appropriators with experience on committees with oversight of Department of Homeland Security (DHS), had broken down over the number of Immigration and Customs Enforcement (ICE) beds in detention centers — which Democrats want to cap and reduce.


"For far too long, the Trump administration has been tearing communities apart with its cruel immigration policies," Rep. Lucille Roybal-Allard, the lead House Democratic negotiator, wrote in a statement. She argued, "A cap on ICE detention beds will force the Trump administration to prioritize deportation for criminals and people who pose real security threats, not law-abiding immigrants who are contributing to our country." A government data clearinghouse run by Syracuse University notes in an analysis of ICE data that most ICE detainees have no criminal conviction and almost 75 percent have no serious convictions.

But President Trump and his Republican allies in Congress have slammed Democrats for demanding a cap, accusing them of trying to hinder ICE's ability to detain violent criminals. "The Democrats do not want us to detain, or send back, criminal aliens! This is a brand new demand. Crazy!" the president wrote on Twitter Monday morning.

Thomas K. Norment Jr., the powerful Republican majority leader in the Virginia Senate, was a top editor of a 1968 college yearbook that included several photographs of students in blackface as well as racist slurs.

Mr. Norment, 72, a longtime fixture and political broker in the State Legislature, is the first Republican to be swept up in Virginia’s ongoing political crisis over racist behavior in the past. The Virginian-Pilot newspaper first reported on the photos and material on Thursday.

As a senior at Virginia Military Institute, then an all-male college that was sometimes called “the West Point of the South,’’ Mr. Norment was managing editor of the 1968 edition of the Bomb yearbook. That edition included students in blackface and slurs aimed at African-Americans, Asians and Jews, according to a copy viewed by The New York Times.
