Obama judge rules against Trump (again)

In other words, Gilliam has been overruled at least twice now after ruling against Trump
Gilliam, an Obama appointee, has sided against the Trump administration a number of times over the past two years, including Trump’s emergency declaration for the border wall and rollback of contraception requirements under the Affordable Care Act.
So, we have to consider what good it does when these Judges make rulings that they probably know are going to be eventually overturned. Is it just to "delay" the process as a display of political partisanship or is it something else.

I certainly understand what certain Judges will have different legal theories, but all these cases boil down to the constitution and the laws involved. If you know that your decision is going to be overruled (because the constitution and law demands it) then are you being honest in your judgement?

This is one of many cases (so far all have eventually been overturned at some level) where district court Judges have determined that Trump is not allowed to use either an executive order or an executive guidance to overturn previous executive orders or executive guidances provided by Obama.

This is both flawed on a fundamentally legal and fundamentally logical basis. You cannot declare that one President has executive powers to make decisions, but that the next President does not. Unless of course the constitution or laws have changed. But obviously they haven't.

This is simply a rogue Judge who believes that one President was correct and another is incorrect. That is not their job under the constitution, and it never will be. But for whatever reasons, there are Judges who either don't care about the constitution, or are willing to cast it aside for political purposes.

His comments at a Senate Appropriations subcommittee hearing broke from Attorney General William Barr, who has described as "spying" FBI surveillance during its investigation into potential collusion between the Trump campaign and Russia. Barr has not said such surveillance was necessarily improper, but Trump nonetheless seized on those comments to suggest his campaign was spied on in an illegal and unprecedented act.

Asked by Sen. Jeanne Shaheen, D-N.H., if he would say that the FBI is "spying" when it investigates suspected terrorists and mobsters while following "investigative policies and procedures," Wray replied, "Well, that's not the term I would use."

He added: "I believe that the FBI is engaged in investigative activity, and part of investigative activity includes surveillance activity of different shapes and sizes. And to me, the key question is making sure that it's done by the book, consistent with our lawful authorities. That's the key question. Different people use different colloquial phrases."
