Daniel McGraw, our reporter in the courtroom, reports that in addition to the $11.2 million compensatory damages awarded last Friday, the jury awarded a total of $33 million in punitive damages, which will probably be reduced by the court to $22 million because of the state law cap at twice compensatory (it’s not an absolute cap, but probably will apply here). That brings the total damages to $33 million. We will have the breakdown soon. The jury also awarded attorney’s fees, to be determined by the judge.So now we get into appeals, and possibly some "real" press coverage, and maybe even an interview or two with people associated with the case. But it's a clear signal being sent by a jury that nobody (including high profile learning institutions) are above the law. This is a great overall ruling that reinforces quite few things that Oberlin college believed (or at least argued) to be true:
- That the School (not local authorities) should be allowed to decide what punishment their students get for breaking laws.
- That the School is not held legally liable for anything that happens by either their student body or their faculty.
- That there is no such thing as defamation, libel, or slander. All speech is protected.
The most aggravating stance for me is the idea that in 2019, everything is just an "opinion" and every "opinion" (even blatantly untrue and hurtful opinions aimed at destroying the lives of people you don't agree with) is protected under free speech. Unless, of course, that opinion happens to be a conservative political opinion, then it's considered physically harmful hate speech, and cannot be condoned.
The bigger problem here is that the school is still not accepting any responsibility for this. If the school hasn't learned anything, then how can the students? Because I promise you this, once these students graduate from Oberlin, then are going to find out that the real world is the local authorities, not campus security (and one free get out of jail free card). They are going to find out what you say and do to others has dire consequences in the real world, and that you can (and will) be held accountable for your actions.
My guess is that the only lesson most of these students will have learned here is that they ended up as the victims (not the Gibsons).
