Needless to say, the green justice warriors went forward with suits against the construction based on the old permitting. Now, in a decision that may shock many here, a 9th U.S. Circuit Court of Appeals panel nullified a key barrier to the construction of the project, arguing that it no longer applies after the Trump administration replaced a permit earlier this year.
The court ruled Thursday night in favor of the Trump administration and TransCanada Corporation’s motion to dismiss.
So there are apparently Judges within the 9th Circuit Court so anti-Trump that even the full Circuit Court of Appeals finds their anti-Trump rulings wanting. This is actually the second time in the past couple of months that the 9th Circuit Court of Appeals has ruled in the Administration's favor. Perhaps, they are a bit tired of having their rulings overturned at the Supreme Court level.
Meanwhile, the environmental group that filed the original complaint has vowed to continue to fight this, but just not as you might suspect. Their strategy (it would appear) is to start over and see if they cannot find another District Court Judge to halt the building of the pipeline. Seems odd, but probably a much better bet than appealing to the USSC. They claim that the overlying legal issue here is "saving the earth" and that there is some sort of legal responsibility for the Administration to "pay attention to the science".
We'll see where this goes, but it cannot bode well for an environmental group, when you cannot get a favorable ruling at the 9th Circuit Court of Appeals.
