The Office of Legal Counsel was Mueller's full excuse for Volume II of his report.
But I would suspect those who thought it was binding law in that case will think it's irrelevant partisanship in this case.

"I believe the whistleblower is operating in good faith," Maguire said when asked by House Intelligence Committee Chairman Adam Schiff if the director believed “the whistleblower is a political hack.”
“They couldn’t be in good faith if they were acting as a political hack, could they?” Schiff asked, a reference to President Trump’s characterization of the official whose Aug. 12 letter to the heads of the House and Senate Intelligence committees touched off the probe that is evolving into an impeachment inquiry. Trump has called the person, whose identity he says he does not know, a “partisan whistleblower” and described the complaint as “just another political hack job.”
The complaint against Trump over his repeated calls for Ukraine to investigate former Vice President Joe Biden and his son Hunter was made public on Thursday morning. In it, the unnamed whistleblower cited conversations and details provided by "more than half a dozen U.S. officials,” alleging that Trump is “using the power of his office to solicit interference from a foreign country in the 2020 U.S. election.”

Nice "strawman" question. I don't think anyone has accused him of being a Russian spy. Just a partisan who likely worked with the Democrats "prior" to coming forward with his complaint.
What has become interesting is when you go through this entire process, it seems that these members of the intelligence community are upset because they are not being given access to these telephone conversations. The complaint talks about how the President was covering up the conversation and not allowing anyone to see it.
Now what is ironic is that the intelligence community actually has no authority to review or inspect his telephone conversations with foreign leaders. Those are diplomatic calls and there is no legal reason he has to allow anyone outside of the White House see them.
What has happened is that the President has been moving the transcripts and recording of these phone calls to a double secret probation area where only those who are actually "supposed" to see them have.

The funny thing is that this whistle blower is blatantly upset by this and otherwise went around the process with second or third hand information in order to "leak" this call (which is why he got it so wrong).
What this does is simply reinforce that the President is absolutely right to move these conversations off line and prevent those who are not supposed to see them from seeing them (thus reducing he leaks).
Had this guy actually seen the call, he may not have actually filed a complaint.
Oh... and for the record.
The people who provided this information to the whistle blower likely broke the law in doing so. They provided classified and privileged information to someone not authorized to have it.
We know I’m not a fan of Trump, that being said it’s a really sad day for our country. This administration has so many involved in the latest scandal. We are heading rightfully so to impeachment. If Obama or any other democrat had involved a foreign country like this, you all would be outraged. I am sad and outraged. This is as bad as it gets. It’s not sexual conduct, it’s much worst. The DNI was being asked if he thought that the whistle blower was some sort of foreign spy and if he concocted this whole thing.
Nobody believes that.
I do believe that this guy wanted to get this out. He probably did everything he could to be "by the books". He probably thought he was doing the right thing.
But at the end of the day he is still a Partisan anti-Trumper who is represented by DNC attorneys, and more likely than not consulted with Democrats prior to releasing his complaint.
He didn't see the phone call because he wasn't authorized to see the phone call. That pissed him off because he is probably one of the people who spent a great deal of time leaking crap that he wasn't supposed to be seeing and everything dried up on him.
So look for the President to ramp up the guard even higher. The people who originally listened in on this call will never listen in on another one. I promise you that.

In 8 years I disagreed horribly with most of what Obama did. I thought he acted with reckless disregard for the law and overstepped his authority more often than any other President (which is proven by the amount of times his actions were shot down by the courts).
But never once did I call for his impeachment.
Never once did I suggest his constitutional actions as President were criminal because of some lazy partisan idea that you can decide someone else's "corrupt intent".
Have you "really" thought about all of the things that Democrats are now declaring to be illegal actions? How many of them were perfectly okay when Obama was President? I also stated that the whistle blower appeared to have help and probably consulted with both the Democrats and his attorneys (who are DNC attorneys) prior to doing anything.
So I am quite certain that they believed that they did this "by the books" which is why Democrats seemed so surprised and upset that the complaint wasn't handed back to them as they felt it should have been.
I argued (even before the official explanation came out) that the whistle blower was trying to report on something outside the authority of his job (which was proven true).
That doesn't make it illegal, just outside of his authorization.

A whistleblower is a person who exposes information or activities that are unlawful, unethical or in violation of a company's policy. Federal whistleblower protection laws and most states' laws make it illegal to retaliate against an employee who reports employer violations or misconduct.

A whistleblower is a person who exposes information or activities that are unlawful, unethical or in violation of a company's policy.
Sure... and this guy worked for the CIA - which means that he was legally able to expose information or activities within the CIA that are unlawful, unethical, and in violation of CIA policy.
The President isn't part of the CIA, and his diplomatic calls to foreign leaders are not part of the CIA's oversight. More to the point, the whistle blower had no first hand knowledge of anything.
