Clapper lays the seeds to his defense!

It's all Obama's fault!

This all sounds reasonable, if that is really what happened. If all you did was attempt to determine what the "Russians" were doing, then there would have been no reason to garner FISA warrants against Trump campaign officials, or to use foreign operatives to reach out to Trump campaign officials, or to monitor the Trump campaign in any way.

But this has been the excuse by our intelligence for some time. The working backwards from an assumption that after three plus years they were never able to show any proof of. If there was never any "assumptions" made by our law enforcement, they would have worked in the correct direction. They would have monitored the Russians (who they believed committed the actions) and then looked at whom "they" were interacting. Then they could have followed that information to where it lead them. If it lead them back to Trump, then there you go. If it didn't, then it didn't. But that is generally the way you work these things. You monitor the criminals themselves.

Instead they picked their political opponents here in the United States and decided to monitor them, I guess on the off chance that they were actually conspiring. According to James Clapper, the responsibility for that judgement starts at the top.

Obama made me do it!

Trump Calls Impeachment Unconstitutional
October 8, 2019 at 9:52 pm EDT

Jonathan Chait:
“Advising President Trump on the law, and formally expressing his views thereof, is a pitiable task. Trump’s worldview is almost wholly incompatible with the law. The latter is premised on neutral rules, mediated by precedent and constructed with the goal of some notion of abstract fairness. The latter is rooted in an entitlement to absolute domination regardless of circumstance.

“The White House letter rejecting the House impeachment inquiry is an effort to reconcile the irreconcilable. At the level of tone, it reads like an extended Trumpian rally diatribe lightly edited by an attorney. At the level of substance, it is almost pure, uncut Trump. It repeats a series of immaterial, laughably false claims, surrounding the audacious thesis that impeaching Trump is literally illegal.”

Turkey Poised for Imminent Attack
October 9, 2019 at 6:44 am EDT

“Syrian Kurds issued a ‘general mobilization’ call in northeastern Syria along the border with Turkey on Wednesday, as Ankara poised for an imminent invasion of the area in the latest major escalation in the war-ravaged country,” the AP reports.

“Turkey has long threatened an attack on the Kurdish fighters in Syria whom Ankara considers terrorists allied with a Kurdish insurgency within Turkey. A Syrian war monitoring group, the Britain-based Syrian Observatory for Human Rights, reported Wednesday that people were fleeing the border town of Tal Abyad, which Turkey is expected to attack first.”

A Weak Argument Against Impeachment
October 9, 2019 at 7:05 am EDT

The AP on the White House letter yesterday declaring no cooperation with the House impeachment probe: “The White House document lacked much in the way of legal arguments, seemingly citing cable TV news appearances as often as case law. And legal experts cast doubt upon its effectiveness.”

Washington Post: “The White House letter, which lacked substantive legal arguments and echoed Trump’s political broadsides, capped a day of defiance and challenges as House Democrats have tried to force recalcitrant administration officials to divulge potentially incriminating information over Republican objections.”

Trump Basically Guarantees He’ll Be Impeached
October 9, 2019 at 7:06 am EDT

Playbook:
“OK, so now we see for sure what the White House strategy is. It’s not only to refuse to cooperate in the impeachment probe, but it’s also practically to deny that Congress has any legitimate right to impeach President DONALD TRUMP — period. This shouldn’t be surprising. We’ve been headed in this direction for a while now. It basically ensures the president will be impeached for interfering with the work of Congress.”

New York Times: “But in refusing to cooperate with what Mr. Trump on Tuesday called a ‘kangaroo court,’ the president risked ensuring the very outcome he would rather avoid.”

Anti-Trump Whistleblower Attorney Worked Directly For James Clapper

One of the attorneys representing the anonymous “whistleblowers” accusing President Donald Trump of conspiring with foreign leaders to interfere in the next U.S. presidential election used to report directly to former director of national intelligence James Clapper.

Charles McCullough, an attorney now representing the whistleblowers with Andrew Bakaj, a former staffer for Sens. Chuck Schumer and Hillary Clinton, was previously the inspector general of the intelligence community (ICIG) at the height of the Clinton email scandal.

rump’s Burn Down the House Plan
October 9, 2019 at 9:01 am EDT

Jonathan Swan: “President Trump, while nervous about the historic stain of impeachment, is throwing everything he has into this fight: refusing all cooperation, running ads to profit politically, and torching every person who stands in opposition to him.”

“When it all boils down, Trump really only trusts his own instincts. And his instincts here are the same as they were with the Mueller investigation: Fight like hell.”

The strategy: “No nuance or apology — not a hint of it. Turn the leader of the investigation (in this case, House Intelligence Chairman Adam Schiff) into a conservative media villain. Condemn Trump enemies in the most incendiary and exaggerated language possible (treason, traitors, coup, etc.).”

C.H. Truth said...

Well James, there is precedent and there is the constitutional protections provided for everyone who is accused of crimes (treason, bribery, high crimes and misdemeanors).

Now the House can play this however they want... and they do not have to follow any precedents if that is how they want to play it. The don't have to allow the President to be represented. They don't have to allow the Republicans to call or question any witnesses. They don't have to provide anyone any transcripts of their secret testimony of their secret witnesses.

But we all know that this was not the procedure that our Founding Fathers were allowing for with impeachment, and we know that no other impeachment has been done behind closed doors with only one of the Political Parties taking part.

So at best, they can claim that the impeachment process is a whatever they want it to be, but at worst we know that they are not following any of the decorum or precedent provided by previous impeachment proceedings and doing so because they want to keep it secret and they want to simply control the narrative.

But that being the case, then I see no good reason for the White House or anyone in the executive branch to take part.

I don't believe that reasonable people would expect that someone can be expected to be brought into this sort of situation where they quite literally are being stripped of all of their constitutional rights.

All they are asking for is a fair process where they can be represented, cross examine witnesses, and actually see the transcripts.

I hate the fact that I have to continue to point this out, but this will not fly in the Senate. If the House impeaches, then the "trial" will happen in the Senate.

And that will work like a trial.

What do you supposed the General Public will remember out of all of this.

The behind the scenes cloak and dagger release nothing to anyone House impeachment. Where all you get is a vote.

Or the actual out in the open, call your witnesses, cross examinations, and the sitting USSC Chief Justice proceeding over everything trial taking place in the Senate.

I can tell you this. The Democrats are going to have a much bigger problem not wanting to participate in the Senate Trial (not wanting their star witness to testify, being upset that the President gets to call witnesses, and having to listen to DOJ experts tell them they are wrong about the law)... than the President not wanting to participate in this.

Pelosi is counting on a quick vote with few or possibly no public hearings prior.

She is hoping that McConnell decides to dispose of it quickly in the Senate, possibly even getting the Chief Justice to dismiss it or having a majority of the Senate vote to dismiss it.

Pelosi is smarter than Ocasio-Cortez, Rashida Tlaib and the rest of the impeachment crazies. Pelosi knows that the last thing that the public will remember isn't going to be what they did in the House, but what happens in the Senate.

She also knows that what comes around goes around. The more that the Democrats refuse to allow Republicans and the President to have a say in their process, the more justification there is for McConnell to do the same in the Senate.

The Senate Republicans will come with the legal documents from the Office of Legal counsel stating for a fact that the witness is not a legal whistle blower and is not provided any of the legal protections that Democrats insist this person (or people) have. They will call the witnesses, and these witnesses will not show.

Then what?

Chief Justice is not going to allow secret transcripts to be used in an impeachment trial. Especially one where Democrats themselves have declared it a "political process" rather than a legal one. A political process demands that the public is informed. They will need to know who the complainants are and what their ties to the Democratic Party is and whether or not they were motivated by politics.

Because there were many people on that call, and so far none of them have publicly stated that they had any problems with it.

As for the President having a chance to defend himself, why of course, that will come later.

Meanwhile, he is digging his own grave by trying to keep the investigation from even happening.

Keep digging, Mr. President. Keep refusing to let important people, many of them your own supporters, answer any questions.

They chose the latter.

“I happen to agree with that strategy, if one assumes that you only have one shot at this. But, I also propose another scenario: Do both.

"Draw up articles of impeachment on the narrow case of Ukraine, but don’t close the impeachment inquiry. Keep it open and ready to draw up more articles as new corruption is uncovered. Impeach Trump repeatedly if necessary.”

It Took a Long Time For GOP To Abandon Nixon
October 9, 2019 at 10:23 am EDT

Amelia Thomson-DeVeaux:
“Support for impeachment had grown slowly over the course of 1974, but there still wasn’t an overwhelming public consensus behind it until right before Nixon left office in early August. And Republican support for Nixon had remained mostly strong, even in the face of a scandal that consumed his second term. As the truth about the scope of Nixon’s misconduct emerged, though, impeachment became increasingly popular and the president lost even his most fervent defenders in Congress.

“Of course, there are many differences between the Nixon impeachment and the Democrats’ current inquiry, which is still in its early stages, and each impeachment investigation will unfold differently. But as today’s Republicans are scrutinized for signs that they might turn on Trump, it’s important to remember that even in Watergate, it took more than a year of investigation — and a lot of evidence against Nixon — to reach the point where Republicans like Hogan were voting for impeachment.”

The House impeachment inquiry is not a real impeachment inquiry because no vote has been taken. But just in case you think you can get around this by taking a vote, forget it.

1:The inquiry is also invalid because Democrats “have not established any procedures affording the President even the most basic protections demanded by due process under the Constitution and by fundamental fairness.”

2:The impeachment inquiry is nothing more than a “naked political strategy” to overturn the 2016 election. It’s totally invalid.

3:There’s no legitimate basis for the inquiry because President Trump’s call to the president of Ukraine was “completely appropriate” and everyone knows it.

This is batshit insane. Due process is for the impeachment trial, not the initial inquiry. The political motivation for impeachment is irrelevant. And the whole point of the inquiry is to establish whether Trump did anything wrong. The fact that Trump himself says he did nothing wrong is hardly conclusive evidence.

It provided talking points.

On a legal basis it's just a steaming pot of bullshit.

Below are some of the most gobsmacking lines in the letter:

Characterizing the impeachment inquiry as a “dangerous path”
"
Never before in our history has the House of Representatives — under the control of either political party — taken the American people down the dangerous path you seem determined to pursue. "
2. Accusing House Democrats of attempting to “overturn” Trump’s 2016 win

"
Put simply, you seek to overturn the results of the 2016 election and deprive the American people of the President they have freely chosen. "
3. Reiterating the White House’s talking point that Trump’s now-infamous July call with Ukrainian President Volodymyr Zelensky was a “perfect” conversation, despite how its own “memorandum” showed Trump pressuring Ukraine to dig up bogus allegations on the Bidens.

"
The record clearly established that the call was completely appropriate and that there is no basis for your inquiry "
4. Theorizing that the Democrats’ impeachment inquiry risks “deepening divisions in the country”

"
Precisely because it nullifies the outcome of the democratic process, impeachment of the President is fraught with the risk of deepening divisions in the country and creating long-lasting rifts in the body politic. Unfortunately, you are now playing out exactly the partisan rush to judgment that the Founders so strongly warned against. The American people deserve much better than this "
5. Asserting that the President was left with “no choice” but to refuse to comply with the impeachment process

"
Because participating in this inquiry under the current unconstitutional posture would inflict lasting institutional harm on the Executive Branch and lasting damage to the separation of powers, you have left the President no choice. "
6. Arguing that the Democrats’ “constitutionally illegitimate proceedings” are a distraction to Trump

"
For the foregoing reasons, the President cannot allow your constitutionally illegitimate proceedings to distract him and those in the Executive Branch from their work on behalf of the American people. "
The White House took issue with the House not holding a floor vote to initiate the impeachment inquiry. But a senior administration official declined to say whether the White House would cooperate with the probe if such an action were taken.

“I am not going to try to provide particular red lines or things like that,” the official said. “The letter, I think, speaks for itself about flaws — we’d have to see what the House wants to do try to remedy them.”

The inquiry is also invalid because Democrats “have not established any procedures affording the President even the most basic protections demanded by due process under the Constitution and by fundamental fairness.”

If they followed the same procedures that the GOP followed during the Clinton impeachment, then none of this would be a problem. There were House committee votes to make it official, and Clinton was provided with the same due process that President Trump is asking for.

All of the cards were on the table, everyone knew the witnesses, and the actual articles of impeachment were clearly written out as they pertained to how Clinton would have been charged in court had he not been President. There was no pretense that impeachment was "political" and didn't require any "real crime" as defined.

So perhaps one of you can tell us what the justification ACTUALLY IS for treating it differently than other impeachment processes?

Why is it that absolutely EVERYTHING associated with this President seems to prompt Democrats to change the rules, change the game, change the protocol, change the way they see the law, etc... etc...

What possible reason is there for the 2019 115th Congressional Democrats not to act the same way that the first 114 Congresses acted? Why can't they just follow the same damned rules as every other Congress?

The President may be unconventional at times, but an Administration calling on foreign leaders and requesting assistance for an investigation has probably happened hundreds, if not thousands of times in our nation's history. Never before has it been question.

Certainly not when our previous administration secured help from at least three different countries while they investigated the 2016 GOP candidate for President and his campaign staff.

without subpoena power lil schitt has effectively hamstrung himself, and also as a result, has rendered his inquiry to something of a cartoon status. a status that is most certainly not meant to be taken seriously by anyone other than the low information democrat base, and Stage IV TDS sufferers like yourself.

simply put, this is a fucking joke. and trump has absolutely no obligation, legal or otherwise, to participate in this fucking clown show.

Man, I tell ya. When Roger fails he does so in spectacular fashion .
"Due process is for the impeachment trial, not the initial inquiry. "

You want the Police in the US to conduct themselves as you saction?

"...and arguing that House rules don't require a vote."

poli-grip pelosi is engaging in semantics. and her low-info base like the alky are just stupid enough to accept it.

the INQUIRY in and of itself doesn't require a vote.

actual impeachment DOES however. and this is where the effort falls through its own ass.

would you like a loved one investigated and charged by the rule The Speaker in Name Only Polosi is using?

Yeah James...

Well Richard Nixon actually committed real crimes and talk of his impeachment were not a partisan issue. Both sides believed he committed crimes because he actually committed crimes that were actual real crimes you can find in our Statutes.

You didn't have to change reality to make your case.

You know where an "investigation" becomes "digging up dirt" or "election interference".

We have been a nation for over 240 years and nobody has ever suggested that it's a crime to investigate someone, simply because they happen to be running for Political office. Hell, I will bet that investigations into politicians once they declare or start a run probably run into the hundreds, and NOT A SINGLE TIME was anyone charged with election interference for those investigations.

FOUR MAJOR POLLS SHOW AMERICANS BACK IMPEACHMENT INQUIRY

Ch, Ch, Ch, calm down. Your precious President is not being impeached. Investigations are just going on to determine whether he will be impeached.

He must be very afraid of being legitimately impeached since he is trying to interfere with the mere investigation.
