WASHINGTON — An intelligence official with “firsthand knowledge” has provided information related to President Trump’s dealings with Ukraine and is now protected from retaliation as a whistle-blower, lawyers representing the official said on Sunday, confirming that a second individual has come forward in the matter.
Much is unknown about the official, who has been interviewed by the intelligence community’s inspector general but has not filed a formal complaint.
But the individual has hired the same legal team as the first whistle-blower. That, and the claim of “firsthand knowledge,” suggests testimony that might bolster the impeachment case against Mr. Trump and further undermine one of his main defense claims: that the accusations against him are based on inaccurate, secondhand information.
The New York Times reported on Friday that an intelligence official who has more direct knowledge of Mr. Trump’s dealings with Ukraine than the first whistle-blower, and who had grown alarmed by the president’s behavior, was weighing whether to come forward. The second official was among those interviewed by the intelligence community inspector general to corroborate the allegations of the original whistle-blower, one of the people briefed on the matter said.

A federal judge on Monday rejected a bold argument from President Trump that sitting presidents are immune from criminal investigations, allowing the Manhattan district attorney’s office to subpoena eight years of the president’s personal and corporate tax returns.
Lawyers for Mr. Trump were expected to appeal the ruling from Judge Victor Marrero of Manhattan federal court. The president’s lawyers could not immediately be reached for comment.

NEW YORK (AP) — A federal judge rejected President Donald Trump's claim to be immune from all criminal investigations Monday and dismissed his lawsuit challenging a state grand jury subpoena for eight years of his tax returns sought by Manhattan's district attorney.
U.S. District Judge Victor Marrero said in his ruling that he could not grant such a "categorical and limitless assertion of presidential immunity."
Trump's lawyers immediately appealed to the 2nd U.S. Circuit Court of Appeals, also based in Manhattan, meaning the returns are unlikely to be turned over immediately.
Manhattan District Attorney Cyrus R. Vance Jr., a Democrat, asked Trump's accounting firm to turn over his business and personal tax returns as part of an investigation of the Trump Organization's involvement in buying the silence of two women who claimed to have had affairs with the president.
Trump's lawyers have said the investigation is politically motivated and the request for his tax records should be stopped because he is immune from any criminal probe as long as he is president.
In striking down Trump's attempt to block the subpoena, Marrero called Trump's claim of a broad immunity "extraordinary" and "an overreach of executive power."
"As the court reads it, presidential immunity would stretch to cover every phase of criminal proceedings, including investigations, grand jury proceedings and subpoenas, indictment, prosecution, arrest, trial, conviction, and incarceration," Marrero wrote. "That constitutional protection presumably would encompass any conduct, at any time, in any forum, whether federal or state, and whether the President acted alone or in concert with other individuals."
The judge said couldn't accept that legal view, "especially in the light of the fundamental concerns over excessive arrogation of power that animated the Constitution's delicate structure and its calibrated balance of authority among the three branches of the national government, as well as between the federal and state authorities."
Trump's lawyers and the district attorney's office did not immediately comment in response to the ruling.

Either way... Obama called on Ukraine to investigate Trump's campaign manager in the middle of the election. Our Government also worked with both British and Australian intelligence (and possibly others) as they were investigating Trump.

House Democrats launched an impeachment inquiry against President Donald Trump after discovering he had urged Ukrainian President Volodymyr Zelensky to investigate former Vice President Joe Biden, a potential challenger in the 2020 presidential election.
Kirk, Trump and other conservatives have tried pinning allegations of wrongdoing back on Democrats. During a Sept. 25 press conference, Trump charged that Democratic senators "have actually done what they’re accusing me of doing, which I didn’t do."
But what are the facts about these claims?
We decided to break Kirk’s tweet down and see how each of his three claims stacked up to the facts. Put simply, all three are oversimplified and misleading.
"Barack Obama asked Ukraine to investigate his political rival's campaign manager"
This claim is unproven. We found no evidence that former President Barack Obama asked Ukraine to investigate Paul Manafort, Trump’s former campaign manager.
In a statement to PolitiFact, a spokesperson for Kirk pointed to opinion pieces in the Washington Post, Fox News and The Hill. According to one such article by The Hill’s John Solomon, investigators from Ukraine’s National Anti-Corruption Bureau (NABU) met with U.S. officials in January 2016 to discuss coordinating their anti-corruption efforts.
Andrii Telizhenko, a former Ukrainian embassy official, told Solomon that Obama’s Justice Department asked the NABU officials during that meeting to revive a closed 2014 investigation of payments to Manafort by former Ukrainian President Viktor Yanukovych, an ally of Russian President Vladimir Putin who fled Ukraine in 2014 amid protests.
But Telizhenko — who worked at the embassy for less than a year, per the Washington Post — also said he could not remember if Manafort was specifically mentioned at the meeting.
Solomon also quoted Telizhenko and another Ukrainian official drawing a link between the January 2016 meeting and the release months later of a ledger showing off-the-books payments from Yanukovych’s political party to Manafort.
Serhiy Leshchenko, the member of Ukraine's parliament and investigative journalist who revealed the existence of the ledger in a press conference, wrote in a recent Washington Post op-ed that he was not working with the intent of helping Democrats.
"This was Leshchenko coming forward," said Steven Pifer, a senior fellow at the Brookings Institution and the former U.S. ambassador to Ukraine under President Bill Clinton. "Nothing I have seen suggests that he did so at the request of the Obama White House."
John Herbst, director of the Eurasia Center at the Atlantic Council and the former ambassador to Ukraine under President George W. Bush, said the release of the ledger was not unusual: "When the ledger came out, as someone who’s been watching Ukraine very closely for the last five years, that seemed to be an absolutely normal development given Ukraine’s own politics."
Ukrainians were already attentive to Manafort because of his connections to Yanukovych, Herbst said. They became more interested once Manafort became part of the Trump campaign.
"I am a bit skeptical about the notion that you had Ukrainians meeting with the Justice Department to plot strategy on this thing," Herbst said. "I can’t flatly tell you it’s wrong."
Whatever was said, it’s also important to note that the alleged discussion happened in January 2016, while Trump didn’t hire Manafort to work on his campaign until March 2016. Manafort was named campaign chairman in May 2016.
Solomon did not respond to a request for comment but defended his work on Twitter. A spokesman for Obama declined to comment.
"3 Democrat senators asked Ukraine to investigate Trump" This claim distorts what happened.
In May 2018, Sens. Dick Durbin of Illinois, Patrick Leahy of Vermont and Bob Menendez of New Jersey wrote a letter to Yuriy Lutsenko, prosecutor general of Ukraine, urging him to cooperate with former special counsel Robert Mueller’s investigation on Russian election interference.
Citing an article from the New York Times, the senators noted that Ukraine had reportedly stopped four investigations related to the Mueller probe for fear that the country’s cooperation could have jeopardized its ability to secure financial and military aid from the United States.
"If these reports are true, we strongly encourage you to reverse course and halt any efforts to impede cooperation with this important investigation," they wrote.
The senators also asked if the Trump administration had encouraged Ukrainian officials to impede Mueller’s investigations in Ukraine. But they never asked Ukraine to investigate Trump, as Kirk falsely claimed. The senators clarified their intentions in a recent press release.
"This wasn’t about asking for an investigation, but to follow up on the New York Times report that the Ukraine prosecutor was ending his own ongoing investigations and not cooperating with queries from Mueller concerning Manafort," Leahy spokesman David Carle told PolitiFact.
"And the DNC solicited Ukraine's help to dig up dirt on Trump"
This claim is misleading. It has its origins in a 2017 Politico report, which we’ve looked at before.
According to the report, a Ukrainian-American consultant for the Democratic National Committee looked for compromising information about Manafort and revealed some findings to officials at the Ukrainian embassy and the DNC.
But Kirk’s claim overstates the report’s findings. There’s no evidence that the DNC was working directly with Ukraine’s government.
The consultant, Alexandra Chalupa, told Politico that she had taken it upon herself to research Manafort’s connections to Yanukovych, the ousted former Ukrainian president. As Trump’s campaign surged, she started researching Trump’s ties to Russia, as well.
Chalupa shared some rumors and findings with officials from the DNC and Hillary Clinton’s presidential campaign, the report said. The day after Trump hired Manafort, she told the DNC’s communications team about Manafort, Trump and their ties to Russia. Hacked emails also show her telling a DNC official a few months later that she had more information on Manafort.

On Friday, a powerful Republican senator indicated to the Wall Street Journal that he had been concerned this summer that President Trump was creating a quid pro quo with Ukraine by holding up military aid. But he appeared to regret sharing something so potentially damaging and immediately tried to walk back his statements.
It was probably not a coincidence then that on Sunday, Sen. Ron Johnson (R-Wis.), chairman of the Homeland Security and Governmental Affairs Committee, went on TV to try to defend the president. But arguably, he did more damage to the president’s cause by showing just how difficult it is to defend Trump.
In his interview on NBC’s “Meet the Press,” Johnson refused to answer basic questions about why he was concerned about Trump, instead bringing up a completely unrelated conspiracy theory about a former FBI official. “Answer the question that I asked you instead of trying to make Donald Trump feel better here that you’re not criticizing him,” an exasperated host Chuck Todd says at one point.

NEW YORK (AP) — A federal judge rejected President Donald Trump's claim to be immune from all criminal investigations Monday and dismissed his lawsuit challenging a state grand jury subpoena for eight years of his tax returns sought by Manhattan's district attorney.
U.S. District Judge Victor Marrero said in his ruling that he could not grant such a "categorical and limitless assertion of presidential immunity."
Trump's lawyers immediately appealed to the 2nd U.S. Circuit Court of Appeals, also based in Manhattan, meaning the returns are unlikely to be turned over immediately.
Manhattan District Attorney Cyrus R. Vance Jr., a Democrat, asked Trump's accounting firm to turn over his business and personal tax returns as part of an investigation of the Trump Organization's involvement in buying the silence of two women who claimed to have had affairs with the president.
Trump's lawyers have said the investigation is politically motivated and the request for his tax records should be stopped because he is immune from any criminal probe as long as he is president.
In striking down Trump's attempt to block the subpoena, Marrero called Trump's claim of a broad immunity "extraordinary" and "an overreach of executive power."
"As the court reads it, presidential immunity would stretch to cover every phase of criminal proceedings, including investigations, grand jury proceedings and subpoenas, indictment, prosecution, arrest, trial, conviction, and incarceration," Marrero wrote. "That constitutional protection presumably would encompass any conduct, at any time, in any forum, whether federal or state, and whether the President acted alone or in concert with other individuals."
The judge said couldn't accept that legal view, "especially in the light of the fundamental concerns over excessive arrogation of power that animated the Constitution's delicate structure and its calibrated balance of authority among the three branches of the national government, as well as between the federal and state authorities."
Trump's lawyers and the district attorney's office did not immediately comment in response to the ruling.

House Democrats launched an impeachment inquiry against President Donald Trump after discovering he had urged Ukrainian President Volodymyr Zelensky to investigate former Vice President Joe Biden, a potential challenger in the 2020 presidential election.
Kirk, Trump and other conservatives have tried pinning allegations of wrongdoing back on Democrats. During a Sept. 25 press conference, Trump charged that Democratic senators "have actually done what they’re accusing me of doing, which I didn’t do."
But what are the facts about these claims?
We decided to break Kirk’s tweet down and see how each of his three claims stacked up to the facts. Put simply, all three are oversimplified and misleading.

This claim is unproven. We found no evidence that former President Barack Obama asked Ukraine to investigate Paul Manafort, Trump’s former campaign manager.
In a statement to PolitiFact, a spokesperson for Kirk pointed to opinion pieces in the Washington Post, Fox News and The Hill. According to one such article by The Hill’s John Solomon, investigators from Ukraine’s National Anti-Corruption Bureau (NABU) met with U.S. officials in January 2016 to discuss coordinating their anti-corruption efforts.
Andrii Telizhenko, a former Ukrainian embassy official, told Solomon that Obama’s Justice Department asked the NABU officials during that meeting to revive a closed 2014 investigation of payments to Manafort by former Ukrainian President Viktor Yanukovych, an ally of Russian President Vladimir Putin who fled Ukraine in 2014 amid protests.
But Telizhenko — who worked at the embassy for less than a year, per the Washington Post — also said he could not remember if Manafort was specifically mentioned at the meeting.
Solomon also quoted Telizhenko and another Ukrainian official drawing a link between the January 2016 meeting and the release months later of a ledger showing off-the-books payments from Yanukovych’s political party to Manafort.
Serhiy Leshchenko, the member of Ukraine's parliament and investigative journalist who revealed the existence of the ledger in a press conference, wrote in a recent Washington Post op-ed that he was not working with the intent of helping Democrats.
"This was Leshchenko coming forward," said Steven Pifer, a senior fellow at the Brookings Institution and the former U.S. ambassador to Ukraine under President Bill Clinton. "Nothing I have seen suggests that he did so at the request of the Obama White House."
John Herbst, director of the Eurasia Center at the Atlantic Council and the former ambassador to Ukraine under President George W. Bush, said the release of the ledger was not unusual: "When the ledger came out, as someone who’s been watching Ukraine very closely for the last five years, that seemed to be an absolutely normal development given Ukraine’s own politics."
Ukrainians were already attentive to Manafort because of his connections to Yanukovych, Herbst said. They became more interested once Manafort became part of the Trump campaign.
"I am a bit skeptical about the notion that you had Ukrainians meeting with the Justice Department to plot strategy on this thing," Herbst said. "I can’t flatly tell you it’s wrong."
Whatever was said, it’s also important to note that the alleged discussion happened in January 2016, while Trump didn’t hire Manafort to work on his campaign until March 2016. Manafort was named campaign chairman in May 2016.
Solomon did not respond to a request for comment but defended his work on Twitter. A spokesman for Obama declined to comment.
"3 Democrat senators asked Ukraine to investigate Trump"
This claim distorts what happened.
In May 2018, Sens. Dick Durbin of Illinois, Patrick Leahy of Vermont and Bob Menendez of New Jersey wrote a letter to Yuriy Lutsenko, prosecutor general of Ukraine, urging him to cooperate with former special counsel Robert Mueller’s investigation on Russian election interference.
Citing an article from the New York Times, the senators noted that Ukraine had reportedly stopped four investigations related to the Mueller probe for fear that the country’s cooperation could have jeopardized its ability to secure financial and military aid from the United States.
"If these reports are true, we strongly encourage you to reverse course and halt any efforts to impede cooperation with this important investigation," they wrote.
The senators also asked if the Trump administration had encouraged Ukrainian officials to impede Mueller’s investigations in Ukraine. But they never asked Ukraine to investigate Trump, as Kirk falsely claimed. The senators clarified their intentions in a recent press release.
"This wasn’t about asking for an investigation, but to follow up on the New York Times report that the Ukraine prosecutor was ending his own ongoing investigations and not cooperating with queries from Mueller concerning Manafort," Leahy spokesman David Carle told PolitiFact.
"And the DNC solicited Ukraine's help to dig up dirt on Trump"
This claim is misleading. It has its origins in a 2017 Politico report, which we’ve looked at before.
According to the report, a Ukrainian-American consultant for the Democratic National Committee looked for compromising information about Manafort and revealed some findings to officials at the Ukrainian embassy and the DNC.
But Kirk’s claim overstates the report’s findings. There’s no evidence that the DNC was working directly with Ukraine’s government.
The consultant, Alexandra Chalupa, told Politico that she had taken it upon herself to research Manafort’s connections to Yanukovych, the ousted former Ukrainian president. As Trump’s campaign surged, she started researching Trump’s ties to Russia, as well.
Chalupa shared some rumors and findings with officials from the DNC and Hillary Clinton’s presidential campaign, the report said. The day after Trump hired Manafort, she told the DNC’s communications team about Manafort, Trump and their ties to Russia. Hacked emails also show her telling a DNC official a few months later that she had more information on Manafort.
The Politico report also said the DNC encouraged Chalupa to ask Ukrainian embassy staff if former Ukrainian President Petro Poroshenko, Yanukovych’s successor, would be willing to take a question from a reporter on Manafort’s hire and ties to Yanukovych.
But a former DNC staffer told Politico the DNC was "not directing or driving her work."
Chalupa took issue with the Politico article in a Facebook post. She told CNN she was not an opposition researcher and that the DNC never asked her to seek dirt from Ukraine. Multiple DNC and Clinton campaign officials also denied working with the Ukraine government.
Kenneth Vogel, one of the reporters behind the Politico story, clarified on Twitter that the "DNC consultant was not repping DNC" in her communications with Ukrainians.
Adrienne Watson, spokeswoman for the DNC, told PolitiFact that Chalupa was a part-time consultant hired to help the DNC "engage in outreach to American ethnic communities."
"The DNC’s contract with Chalupa permitted her to have other clients and/or engage in activities not on behalf of the DNC, which she presumably did," Watson said.

Paul Manafort had done nothing new or unusual in any recent times. He had been audited by the IRS every year and all of his banking transactions had been turned over to the SEC (as they are by law). Twice, the US held deeper probes into his finances and twice they came back without recommending any charges. At least once the Ukrainian government did the same. The IRS never recommended tax crimes and the SEC never recommended financial crimes.
Within weeks of Paul Manafort becoming Trump's campaign manager, a joint effort was coordinated by President Obama to reopen these investigations into Paul Manafort. Even the original Judge who oversaw the trial criticized the state for the obvious political implications of it, and stated on the record that he thought that it was a Government attempt to "squeeze" him for information on Trump (and that they were not really interested in the old financial issues that they were charging him with).
Nothing he was charged with was new. In fact, much of it was coming up to the point of being past the statute of limitations.
At this point we don't know what transpired to put Hunter Biden on the board of Burisma Holdings in the Ukraine. What sort of quid quo pro might have been offered. Nor do we know how Hunter Biden was able to secure 1.5 billion in a Chinese Government Subsidy investment. Because if he did it with the help of his dad, that would be a crime.
Moveover, whether or not Joe did or didn't have the prosecutor fired, what we know is that this investigation never completed (based on the on record statements from both the Prosecutor overseeing it and the Investigation actually conducting it).

Because prior to the whole "we need to impeach the bad orange man" deal, nobody thought there was anything particularly illegal or impeachable about a President and his Administration calling for an investigation (even if it was an investigation of Trump's campaign manager and it helped the President's Party). Just three short years ago, such behavior by a President might have been called unfair and a bit sleazy, but nobody thought it was actually a crime.
So yeah... The United States and Ukraine held a joint investigation into Paul Manafort. That is an indisputable fact. This is no "an opinion".
That sort of investigation is nearly always spearheaded by a the President, as it was in this case. Nobody is denying that Obama coordinated these efforts. This is not "an opinion".

Paul Manafort was investigated by The United States and Ukraine (no matter how you believe it started). The investigation itself did not start until after he was hired to become Trump's campaign manager.
By their own books, our intelligence community at the time suggests that they reopened the Paul Manafort investigation based on some "leaked information" regarding his financial dealings. By all accounts, Ukrainians were working with our intelligence as a joint effort. By all accounts that was coordinated at the top.
So the reality isn't whether or not someone was "asked" to do something. However a bank robbery was "planned" or who asked who makes no difference once that bank robbery was committed.
In this case, the joint US/Ukrainian investigation into Trump's campaign manager did happen.
In this case, the Joint US/British/Australian/etc... investigation into other members of Trumps campaign staff did happen.
The fact that it did happen is more incriminating that asking about it. Just like the action of actually attempting to rob a bank is more incriminating that talking about it.
