Second Circuit Court of Appeals Puts Subpoena on Trump’s Tax Returns on Hold
The Second Circuit Court of Appeals put on hold a subpoena issued by a federal that demanded President Donald Trump turn over his tax returns.
Earlier on Monday, U.S. District Court Judge Victor Marrero of the U.S. District Court for the Southern District of New York gave the Manhattan District Attorney’s office to subpoena the returns from Mazars USA, an accounting firm.
Trump lawyer Jay Sekulow said Trump and the team “are very pleased that the U.S. Court of Appeals for the Second Circuit has issued a stay of the subpoena issued by New York County District Attorney Cy Vance.”
Now Vance wants the Second Circuit to fast-track the hearing before Friday.

I doubt very seriously whether the 2nd Circuit will be willing to fast-track this hearing for this week. Seems like rather odd request. Moreover, this particular DA is actually "trying again" to implicate Trump in the Stormy Daniels case.

Previously the Southern District of New York (Federal Court) was ordered by the judge to close the case that suggested Trump and Trump Organization employees violated Federal Campaign laws with their payment of Stormy Daniels. The Judge also ordered that prosecutor to "unseal" all of the sealed documents, which basically revealed that there was not (as speculated) a sealed indictment of the President.

Now there is a local New York State DA who is wanting to charge trump with a violation of New York law for calling the non-disclosure agreement a "legal fee".

Vance opened a new investigation in September over Cohen’s latest allegations. The district attorney wants to know if “the Trump Organization falsely listed its reimbursement of Cohen for the $130,000 payment to Daniels as a legal expense, which would be illegal under New York law.” Vance wants Trump’s tax returns from January 2011 to the present.

I think the problem with this logic is that the Federal Court did not find that Trump or anyone in the Trump organization violated any Federal laws, Not sure (in this case) why it would be illegal for the Trump campaign to have listed the non disclosure agreement as a legal fee, How, otherwise, do you list a payment to an attorney who negotiates, writes, and executes a legal non-disclosure agreement? Seems like you are legally putting the cart before the horse here. You must first prove that the criminal action took place (by the person being accused) before you can prove that he/she engaged in a cover up. According to the law at this point, Michael Cohen simply negotiated, prepared and executed a non-disclosure agreement.

This one will go to the Second Circuit on the merits of whether or not a sitting President can be investigated by a State Court (when generally they cannot be investigated at a Federal level).  It may also dive into whether or not the District Attorney in this case actually has a reasonable cause to believe that there is a real case against the President. Is there really a New York Law that was on the books back in 2016 that stated there was a special manner in which you must list the payment of an attorney who handles an non-disclosure agreement?

It was no great surprise that a federal court Monday morning rejected President Trump’s argument that, as a sitting president, he is immune even from being investigated by the Manhattan district attorney. Nor that the court of appeals swiftly granted a stay of the order, thus preserving its ability to hear an appeal.
But the district court’s scathing assessment of the implications of Trump’s argument is telling, and the tale it tells should greatly concern the White House in the looming impeachment battle.
Recall that Trump brought the action in federal court to prevent Manhattan District Attorney Cyrus Vance Jr. from subpoenaing Trump’s accountants for his tax returns as part of Vance’s criminal investigation. (This is the same case that the Justice Department recently entered, on behalf of Trump.)

The court’s technical ruling Monday is that it would abstain from entering the fray based on a general court-made doctrine — it’s known as the Younger abstention — that instructs federal courts not to meddle in pending state criminal prosecutions. Trump (and the Justice Department) had argued that fundamental questions of presidential immunity justified ignoring that doctrine here. The court’s rejection of the president’s position could not have been more emphatic.
Notably, the 75-page opinion by U.S. District Judge Victor Marrero came just two weeks after oral arguments, blindingly fast by litigation standards. Its length and complexity suggest that the court was already working on the opinion from the time Trump filed his hyperaggressive claim.
Most important, Marrero, who could have made quick and summary work of Trump’s argument, went on at substantial length to explain just how lawless and brazen the position was.

You just spent a whole cut and paste talking about the ruling that the 2nd circuit stayed a day later.

The "Obama Judge" (which basically in plain English means the Judge who will be overturned on nearly every decision) is basically arguing that the idea that sitting Presidents are not subject to investigation isn't valid for Donald Trump... or something like that.

Whether the criminal prosecution comes from State or Federal Courts, the Office of Legal Counsel had concluded (and eventually the courts will agree) that Presidents should not be subjects of criminal investigations while sitting in office.

The idea that a "State" court doesn't have to oblige by that basic fundamental and can just go ahead and start investigating and charging the President is absurd.

By suggesting that the Trump Organization (and not Trump himself) is under investigation flies in the face that they actually need "Trump's personal tax returns" rather than corporate tax returns.

Either way, they lose and the only way they were going to win was to find a rogue "Obama Judge" who would quickly rule against Trump and hope that Trump wouldn't get the appeal in fast enough to stop it.

In a scheduled phone call on Sunday afternoon between President Trump and President Erdogan, Trump said he would withdraw U.S. forces from northern Syria. The phone call was scheduled after Turkey announced it was planning to invade Syria, and hours after Erdogan reinforced his army units at the Syrian-Turkish border and issued his strongest threat to launch a military incursion, according to the National Security Council official to whom Newsweek spoke on condition of anonymity.

The U.S. withdrawal plays into the hands of the Islamic State group, Damascus and Moscow, and the announcement left Trump's own Defense Department "completely stunned," said Pentagon officials. Turkey, like the United States, wants regime change in Syria. Russia and Iran support the Assad regime.

"President Trump was definitely out-negotiated and only endorsed the troop withdraw to make it look like we are getting something—but we are not getting something," the National Security Council source told Newsweek. "The U.S. national security has entered a state of increased danger for decades to come because the president has no spine and that's the bottom line."
Newsweek granted the National Security Council official anonymity because they were not authorized to discuss the matter publicly. The source said it would not be surprising to see a Turkish incursion in the next 24 to 96 hours.

During the 2016 presidential election, one of the two major candidates labored under the shadow of a criminal investigation by the F.B.I. That candidate was Hillary Clinton. As we now know, though voters had little reason to apprehend it at the time, there were actually two investigations underway — and, while the probe into Clinton’s mishandling of emails played out in public, the more serious probe of Donald Trump’s secret political and financial connections with Russia remained largely unknown until well after the voting had concluded.

In “Deep State,” James B. Stewart, a columnist for The New York Times and the author of “Blood Sport” and “Den of Thieves,” among many other books, tells the story of both investigations. His account produces few new facts, nor a bold new thesis, that would dramatically alter our understanding of either. Instead, his contribution is to combine the two accounts into a single chronological narrative. He shows how the twin investigations turn out to be closely linked, and not just because an election pitted their subjects against each other.

The F.B.I. agents investigating Clinton’s use of a personal email account realized early on that they would never have a prosecutable case. While Clinton had violated laws pertaining to the handling of classified material, she had apparently done so out of a combination of technical ineptitude and convenience, and the government had never charged an offender without establishing nefarious motives. As a result, the bureau concluded it didn’t “have much on the intent side.”
