If the 2020 presidential election goes to court and is not settled by December 14th...

Then the odds are that Donald Trump will remain President

Let's assume for a second that with all of the mail in ballots and everything going on that lawsuits are filed if the election is close. Let's also assume that neither Party will be quick to concede and that either Party will be quick to file up appropriate lawsuits if they feel that the ballots have not been counted properly (either too few or too many counted).



Let's also assume that it takes a week or more for everything to be counted, and that these lawsuits would not start until the following week at best. Given that most of these would start with lower courts and work their way up to the highest court, it's not inconceivable that some of these lawsuits may not be completed prior to the December 14th meeting of the electorates.

Moreover, the legal battleground would likely also be the larger battleground states that determine the election. If, for some reason or the other, there were not enough certified results to provide either candidate the 270 electoral college votes necessary to win, then the 12th amendment to the constitution tasks the House of Representatives to elect a President.

Now here is where it takes an interesting turn. Most people assume that if the vote for President goes to the House, that Biden would become President due to a fairly significant advantage (of nearly 40 more congressional seats). But it isn't as simple as that. It actually is determined by a state by state vote. In that situation, Republicans control the congressional majority in 26 states, giving them enough votes to elect Donald Trump as President, assuming most votes are cast by Party line.

Many Democrats have openly talked of legal battles, and it would appear that the left is bound and determined to take anything and everything they can to court. After all, that is what Democrats do when they don't like what the people tell them. But they have to be careful that these sorts of legal battles don't drag out too long, or it could end up inadvertently providing the President with a second term.

It's literally just a map showing which states have more Republicans holding congressional seats and which states have more Democrats holding congressional seats.

The only chance this has of meaning anything is if there is no certified winner by December 14th.

I left my criticism of Obama to his policies. I never felt the need to attack his family, question what he did in his spare time, or make up shit about him in order otherwise demand he was a bad person.

Obama spend eight years in office and accomplished almost nothing other than sowing the seeds of racial unrest that we are seeing coming to fruition today. The economy was stagnant, he demanded that there was no magic wand that would allow us to see 3% growth again. They worked tirelessly for accords that had no bi-partisan support.

Does anyone believe that the recent agreements in the Middle East or in the Soviet Bloc countries are not fully supported by most everyone? The United States didn't give away the store to accomplish any of this. Just hard work and negotiations.

Ironically, while we heard about the Iran deal and Paris accords as they were happening, like we were getting ready for a Super Bowl, we didn't hear anything about these recent agreements till they were signed.

The difference between accomplishing something "political" and partisan vs accomplishing something tangible and not controversial.

This is just plain stupidity on Harris's part. If a vaccine is ready before the election it will be given to first responders, hospital and medical personnel first. It will likely not be available to the general public until after the election and then it will be high risk category patients first.

Well Roger.... that isn't Congress's call to make. The 12 Amendment of the Constitution requires them to choose a President from the field... based on the voting as I put forward.

If Congress were somehow to becomes deadlocked 25-25 - the Vice President would assume office until that tie was broken.



Pelosi only becomes President if the chain of command is not longer able to perform the duty (either through death or some other reason).

If no candidate receives a majority of electoral votes, the Presidential election leaves the Electoral College process and moves to Congress.

The House of Representatives elects the President from the 3 Presidential candidates who received the most electoral votes. Each State delegation has one vote and it is up to the individual States to determine how to vote. (Since the District of Columbia is not a State, it has no State delegation in the House and cannot vote). A candidate must receive at least 26 votes (a majority of the States) to be elected.

The Senate elects the Vice President from the 2 Vice Presidential candidates with the most electoral votes. Each Senator casts one vote for Vice President. (Since the District of Columbia is has no Senators and is not represented in the vote). A candidate must receive at least 51 votes (a majority of Senators) to be elected.

If the House of Representatives fails to elect a President by Inauguration Day, the Vice-President Elect serves as acting President until the deadlock is resolved in the House.

Riddle me this... if there is a disagreement about who won the Presidency - how could we have a Vice President elect?



Roger... unless Nancy Pelosi is one of the top three candidates in Electoral College votes, she is not a choice for the Congress as President.

Furthermore, the existing Congress (not the Congress-elect) would be the ones taking the vote.

Lastly - it's not one vote per Congressmen, it's one vote per state with that Stats's congressmen voting for a President. So the fact that you have a million Democratic Congresspeople from California only gets you one vote for President.

The same as Wyoming or Montana.
