This is wonderful...

Joe Biden: (Late August)  “Every single American should be wearing a mask when they’re outside for the next three months, at a minimum.  Let’s institute a mask mandate nationwide starting immediately, and we will save lives." Later Biden suggested if a scientist told him it would help to do a national shutdown that “I would shut it down.”

Joe Biden: (a week later) Claims he would neither institute a mask mandate or shut anything down, suggesting that: “I’m a constitutionalist. You can’t do things the Constitution does allow you the power to do.”

For a second consider how the press would have treated such an about face had the President (not the Democratic Candidate) flipped flopped on something this obvious. Certainly there would have been nobody giving Trump any benefit of any doubt, and certainly nobody would have allowed the sudden about face to be reported as just a clarification. They would demand that he lied and the NYT would report that anonymous sources close to the campaign concluded that it was due to a coup of ranking advisors, the media would clam conspiracies and underhanded motives... all culminating with the conclusion that Trump is a racist.  

But this is dementia Joe and the media has assigned itself to be the protector of all things Democrat and Joe Biden. So he was just clarifying what he meant to say originally when he said something totally the opposit.

One has to wonder, however, whether slow Joe had forgotten what his speechwriters had written for him, or if internal polling showed that people didn't like the concept of a national mandate on either mask wearing or shutting down the economy. 

The reality here is that team Biden seems reactive right now. They certainly do not appear over the past few days here to be supporting a candidate who is on pace to win the election in a rout. After literally spending months hiding Joe away, he has suddenly come out of hiding and is almost campaigning... like he actually believes he needs to do something other than hide?

Russia Amplifying Trump Allegations on Mail Voting

Russia has sought to “amplify” concerns over the integrity of U.S. elections by promoting allegations that mail-in voting will lead to widespread fraud, according to an intelligence bulletin obtained by ABC News, again echoing a frequent and unfounded complaint raised by President Trump.

From the bulletin: “Russian state media and proxy websites in mid-August 2020 criticized the integrity of expanded and universal vote-by-mail, claiming ineligible voters could receive ballots due to out-of-date voter rolls, leaving a vast amount of ballots unaccounted for and vulnerable to tampering.”

It plans to target GOP voters in the states of Arizona, Texas, Florida, North Carolina and Pennsylvania.

The 10th Amendment provides that “the powers not delegated to the United States by the Constitution, nor prohibited by it to the states, are reserved to the states respectively, or to the people.” Implicit in this amendment, according to the Supreme Court, is a doctrine known as “Anti-Commandeering,” which typically prevents the federal government from giving orders directly to state officials such as state and local police.


As the Court explained in Murphy v. NCAA (2018), “conspicuously absent from the list of powers given to Congress is the power to issue direct orders to the governments of the States.”

But, while the federal government may not directly order local police to take certain actions — it cannot, for example, order those police to crack down on protests that the president disapproves of — the federal government can place conditions on federal grants that states must comply with if they wish to keep that money.

The Dole decision, however, lays out several limits on the federal government’s power to attach conditions to grants — a few of which are relevant to Trump’s memo.


First, as mentioned above, the power to impose conditions is vested in Congress, not the president, so unless Trump can convince Congress to pass a law targeting “anarchist jurisdictions,” he may not impose new limits on existing federal grants.

Second, when Congress does impose a condition on a federal grant to a state or local government, it “must do so unambiguously” so that states are not surprised by unexpected obligations. In the Supreme Court’s words, grant recipients must be able to “exercise their choice knowingly, cognizant of the consequences of their participation.” If they don’t want the conditions, they don’t have to accept the money in the first place.

Thus, if the Trump administration wants to argue that an existing federal law permits it to strip federal funding from “anarchist jurisdictions,” it faces a heavy burden. It must find an existing law that clearly imposes specific policing obligations on states and localities. It is, to say the least, unlikely that Congress has already enacted a law that unambiguously permits Trump to strip federal funds due to a personal disagreement over local policing strategy.

Tuesday's report was the committee's final, and long-awaited, chapter in its more than three-year investigation into Russia's 2016 election interference, marking the conclusion of what was held up as the last and arguably only bipartisan congressional investigation into the matter. Spanning 966 pages, it concluded, as have other assessments of Russia's efforts, that Moscow "engaged in an aggressive, multifaceted effort to influence, or attempt to influence, the outcome of the 2016 presidential election."


The report, redacted in parts, detailed extensive contacts between Trump campaign chairman Paul Manafort and Konstantin Kilimnik, a Russian national who worked closely with Manafort for years. The report labeled Kilimnik a "Russian intelligence officer," and said Manafort, for reasons the committee could not determine, sought on numerous occasions to "secretly share internal Campaign information with Kilimnik." It also said the committee obtained "some information" linking Kilimnik to Russian intelligence services' efforts to hack and leak information to damage Hillary Clinton and the Democratic Party.
