The Oregon Court of Appeals on Thursday upheld a $135,000 fine against two Christian bakers who refused to make a wedding cake for a same-sex couple.

The case began back in January 2013, when Aaron and Melissa Klein, owners of the since-closed Sweet Cakes by Melissa bakery just outside Portland, Oregon, cited their religious beliefs when declining to make a wedding cake for Rachel and Laurel Bowman-Cryer.

Following the incident, the Oregon Bureau of Labor and Industries found the Kleins in violation of a 2007 state law that protects the rights of LGBTQ people in employment, housing and public accommodations. In 2015, the couple was ordered to pay the Bowman-Cryers emotional distress damages.

CS. We have a separation of church and state. They violated the state law that the courts have upheld repeatedly. The bakers were discriminating against the rights of two women, who were born gay. Its not a choice CS. You would have the state enforce your particular beliefs because they are gay.

He could order the arrests of Hillary Clinton and would have to, by the Constitution, charge her with a crime within 72 hours. But if he's in charge, he could order the department to ignore any court ruling that demanded her release.

Either way, this case is irrelevant as a similar case has been heard by the USSC and a decision will be made this summer. According to most every legal analysts it's another 5-4 decision with Kennedy delivering the key vote.

Which way he goes is a mystery, but those on the side of the baker are feeling better than those on the side of the gay couple. Kennedy openly suggested that "tolerance" is a two way street, and the State in that case was not being very "tolerant" of the religious views of the baker.

The historical legal standards of the religious objection arguments has never been a matter of absolute, but always a matter of balancing both views and making sure that every consideration is taken on behalf of avoiding the conflict (which is why a pharmacist is allowed to refuse to provide birth control, as long as another pharmacist is available to do so... but in some cases where another pharmacist is not available, the courts have looked at it differently).

Kennedy also made some key statements during the gay marriage decision, where many people were critical of the "slippery slope" argument that making gay marriage legal, would open up those personally opposed to legal and civil actions. Kennedy rejected the slippery slope argument, and probably feels some obligation to strike a balance.

bottom line. An appeals court decision on a similar case will have no bearing on how the USSC will rule, or what the long standing legal standard will end up being.


But it is another glaring example of how intolerant you are of people you disagree with. It must suck to be angry 99% of the time with those you disagree with. If I was as angry as you all the time, it would probably lead me to drink or take up opioids.

and get this - while you were strung out on narcon not long ago, trump actually fired the very crooked and corrupt director of the FBI. he derived that power from the fact that the FBI rolls up under the DOJ.

The Supreme Court does cite precedent from lower courts, but is not bound to them. Arguments before the Supreme Court are replete with references to lower court decisions. The Oregon Appeals decision will be relevant to the similar case that is to be heard by the Supreme Court later this summer.

Communion with the wafers, or I guess you could use little slices of cake, is a religious ceremony. The wafers are blessed, and deemed holy. Eating them is supposed to mean something. Refusing to sell the blessed wafers to a non-practitioner IS a legitimate practice of religion.

The cake, to be on that same level, has to have the same religious significance. The only way, and I mean literally there is no other way, is if the bakers hold their cakes to be holy, not only to them but to their entire religion. It is ridiculous because THEY are ridiculous.

I went through he worst flash flood in the history of the United States on June 9 1972, The Rapid City flood was a 500 year flood. 238 people died, several I knew. Thousands of houses were destroyed, every power line was knocked out, the polls and all the wiring was destroyed. We got power back within 30 days. Rapid City is divided by a mountain ridge, and every single bridge that provided access to the city was destroyed. Until the national guard installed temporary bridges, we could not get across town. The city was about 45000 at the time but it was not densely populated, and the surrounding non incorporated areas were powerless too.

Nancy, although not my choice, will be the speaker of the house next January. Not the one in two days, I knew the k'putz would have claimed I am stoned and missed it by a year. But the house will change hands.

The Senate, it could be closer than most think. Even my old home for eight years, in Montana, the Republican holds a 4% lead.

Despite the economy, the President, who is not going to change, is going to remain deeply disliked. The women and the millennial are going to be more motivated to vote contrary to Trump in most cases. Even in some of the deep red parts of the country, if they have decent sixed middle class, and / or higher educated voting blocks, the Democrats are goiing to do better than they have in about 11 years.

There is a an #imppeachment movement, but I just don't see it taking into effect, unless we see something huge coming out of the Mueller investigation. Then all things are open. And no folks, they are not going to "lock her up".

Yeah, it's not an island with 3 million people, but the resources were provided in an incredibly short tie. IT's more than 3.5 miles x 3.5 miles across, idiot.

The entire electrical system was on power polls, nothing underground. So the power companies from the surrounding states and the National Guard engineering unit that was based there did incredible work.

Look also for more blatant and extended deadlocks between the Senate and the Executive in the future over nominations when these are in opposing parties' control (i.e. Garland's treatment will become the norm, rather than an anomaly).
We, the people, also lose from the shifting of the tax burden towards towards the middle class in the recent tax bill, both in the short term (by giving the wealthy and corporations the bulk of the immediate tax benefits) and the long term (by ending many of the middle class tax breaks after several years while making the tax breaks for corporations and the wealthy permanent).
There are many other ways we, the people, have lost this year (e.g. threats by the Executive to shut down news outlets such as NBC that don't kowtow to the Executive). These losses are real and will be realized more fully over the longer term, no matter one's personal view is of the specific issue(s) involved in 2017.
