Because certain people don't know how to read...

Administration's request for expedited hearing declined 
The U.S. Supreme Court on Monday declined to hear the Trump administration's appeal of a federal judge's ruling that requires the government to keep the Deferred Action for Childhood Arrivals program going.

The court's denial was expected, because the justices rarely accept appeals asking them to bypass the lower courts.

The Justice Department said it would contest that ruling before the 9th Circuit Court of Appeals in California. But government lawyers also asked the Supreme Court to take the highly unusual step of agreeing to hear the case, bypassing the appeals court.

The Supreme Court has agreed only about a dozen times in the past century to immediately take a case and bypass the federal appeals courts, and those case usually involve a national emergency, such as nationwide strikes in the steel and coal industries.

So the reality of this is that the Administration's plea to bypass the 9th circuit court and have the USSC move ahead with an expedited hearing was not expected to succeed. There is no reason to believe that the USSC will not hear the case should the 9th circuit court actually agree with the lower court decision.

The count rendered absolutely no opinion on the merits of the case.

By almost all legal accounts, the Administration is expected to eventually win the court case.  There is little merit to the idea that an executive action by one President would be legal because a District Judge agreed with the reasoning, while the executive action by a different President on the same topic is illegal because a District Judge did not agree with the reasoning for it. There is no legal precedent for any law or executive action to be "justified" to a District Judge before taking place.

If anyone truly expected the Courts to be able to overrule the President on this issue in the long run, then Democrats in Congress would not have been negotiating for a legislative fix for the issue.

“The Supreme Court on Monday delivered a blow to the Trump administration by refusing to hear the government’s challenge to a lower court ruling that has temporarily blocked the administration from winding down the Obama-era Deferred Action for Childhood Arrivals program,” The Hill reports.

Washington Post: “Federal district court judges in California and New York have issued nationwide injunctions against ending the program, siding with states and organizations challenging the administration’s rescission. The court orders effectively block the Trump administration from ending the program on March 5, as planned.”

Axios: “The decision essentially makes the March 5th deadline meaningless, and there will be much less incentive for lawmakers to reach an agreement soon. Until a final decision on the case, which experts say isn’t expected for another year, current DACA recipients will be able to continue to renew their DACA protections.”

The March 5th deadline was artificial. If you were living here "technically illegally" and had a temporary protection from deportation that you knew was likely going to be overturned by the Courts...

Donald Trump suggested Monday that he would have run into the high school in Parkland, Florida, during the mass shooting, “even if I didn’t have a weapon.”

The president made those remarks ahead of a meeting with state governors, referencing reports that an armed sheriff’s deputy waited outside for minutes as gunman Nikolas Cruz opened fire within Marjory Stoneman Douglas High School on February 14.

“You know, I really believe — you don’t know until you test it — but I really believe I’d run in there, even if I didn’t have a weapon,” Trump said. “And I think most of the people in this room would have done that, too, because I know most of you. But the way they performed was really a disgrace.”


The president’s comments about the deputy come as he’s promoted the idea of training and arming teachers to defend against shooters, a controversial proposal to which prominent Democrats and Republicans have voiced opposition.

White House press secretary Sarah Huckabee Sanders later modified Trump’s suggestion that he would have rushed into the school.

“I think he was stating that as a leader he would have stepped in and hopefully been able to help, as a number of the individuals that were in the school,” Sanders said. “The coach and other adults, and even a lot of the students stepped up and helped protect other students. I think the point he was making was that he would have wanted to play a role in that as well.”


This isn’t the first time Trump has alluded to his own heroics
Trump isn’t alone in his rightful criticism of the failures in responding to the school shooting in Parkland, Florida. But Trump’s brash comments stand out — especially since this isn’t the first time he suggested he could face down a gunman.

In 2015, then-candidate Trump rallied a crowd at a campaign stop in Tennessee in the aftermath of a mass shooting at Umpqua Community College in Oregon, that left 10 people dead, including the shooter.

Trump told the crowd that, as holder of a permit to carry a handgun in New York, an attacker would be “shocked” if he encountered him, and that he would act like Charles Bronson in the 1970s action film Death Wish. In the movie, a New York City architect exacts vigilante justice after a man murders his wife and sexually assaults his daughter.

“I have a license to carry in New York, can you believe that?” Trump said at the 2015 rally in Tennessee. “Somebody attacks me, they’re gonna be shocked.”

According to the Guardian, he egged the crowd to chant “Death Wish.” He also said that “today you can’t make that movie because it’s not politically correct.” (There’s actually a reboot set to premiere this week.)

Trump also boasted about his permit to carry in New York at an early GOP debate, when responding to a question about that Oregon shooting. “I have a permit, which his very unusual in New York — a permit to carry,” he said during a CNBC debate in October 2015. “And I do carry on occasion. Sometimes, a lot. But I like to be unpredictable.”

But Trump’s promotion of the idea that “a good guy with a gun” (or without, in the case of Monday’s comments) can stop a “bad guy with a gun” is problematic. Additionally, the legislation bans the sale, transfer, production, and importation of semi-automatic shotguns with features such as a pistol grip or detachable stock, and ammunition feeding devices that can hold more than 10 rounds.

Almost every semi-automatic pistol has a “detachable magazine.” They have detachable magazines because they don’t have cylinders, which is what revolvers use. You have to detach the magazine to load ammunition into it, even if you only own one magazine per pistol. The only qualifier on this prohibition is that it applies to firearms “with a military-style feature,” which is left undefined.


That's pretty much 95% of the guns on the market today.

This bill will be tremendously popular in the urban-coastal cores, which Democrats already hold. It’s not going to be popular at all outside of those progressive enclaves, where most of the 60-million-plus gun-owning households exist, and where voters know what a “detachable magazine” actually is. This bill and the Democratic hysteria getting whipped up behind it isn’t about fixing the problems that led to the Parkland school massacre — it’s a gun grab, pure and simple. It’ll be easy for “Republicans to play that up in a lot of districts” that Democrats need to win for a majority because it’s true.

Between “crumbs” and gun grabbing, Democrats really have set themselves up to snatch defeat from the jaws of victory in this midterm. If this bill goes nowhere, Democrats will likely run on the message that only a Democratic majority can get this bill passed. And you know what? Republicans will run on the exact same message. Good luck with that, Mrs. Pelosi.
