Papadopoulos angle collapsing?

So based on what we now know, the Obama intelligence community hired a well established CIA Operative (known for political spying) as an FBI informant to make contact with Trump campaign officials. This was supposedly done in an attempt to find out what the Trump campaign might know about Russian election interference.

Now we can argue all day long about the semantics of how you describe that activity. Spying, investigating, infiltrating, informing. Really doesn't matter how you describe it, the FBI hired a CIA operative to go make contact with and then snoop around into members of the Trump campaign. Just as he had done in previous elections.

But here is the rub. According to what is being divulged at this point, the contacts between the spy/informant and Trump officials predated the Papadopoulos meeting with the Clinton affiliated Australian Diplomat. So without the means for time travel, that would suggest that the Papadopoulos excuse to start a counterintelligence campaign is a pile of bunk. The FBI had already been spying/infiltrating/investigating the Trump campaign.

Moreover, there is now some buzz (unconfirmed at this point) that the information regarding the missing Clinton emails that Papadopoulos allegedly shared with the Australian Diplomat may have been provided to him either directly or through the assistance of the FBI informant in question.

Either way, the reality is now there is absolutely zero excuse for the DOJ/FBI to withhold from Congressional oversight the actual true origin of the counterintelligence probe into the Trump campaign. No more delays, no more redaction, no more excuses.

Back to basics: Russia interfered in our presidential election, perhaps with the assistance or knowledge of the campaign Russia sought to help. Trump does not want that investigated. He wants to distract us by making the issue US government efforts to deal with this interference.

Did the Trump campaign pay a British operative to go to Russia, pay off Russian sources, to dig up dirt on Hillary and her campaign? You know, like Hillary did with Richard Steele? Paying for dirt seems much more incriminating that being receptive to it.

Trump does not want that investigated.

Trump has allowed this investigation to go on for his entire Administration, turned over tens of thousands of documents to the FBI/Special Counsel. Nearly everyone of his campaign members (including some of his family members) have openly agreed to talk to investigators, and even Trump himself is said to be negotiating a sit down with Robert Mueller.

The only people here afraid of a little investigation appears to be the FBI/Democrats and their faithful followers.

President Donald Trump's North Korea summit with Kim Jong Un increasingly looks doomed.

Trump has often talked up his work on North Korea, crediting himself with creating the conditions for talks through a hardline policy, but those self-congratulatory tweets could come back to haunt him.
But he's reportedly ill-prepared for the summit and worries it could blow up in his face as an embarrassment.

South Korea may have misled Trump a bit before the talks, and North Korea is almost certainly misleading him.

North Korea experts fear that failed talks could lead the US to an even more militaristic path, possibly even to war against Kim.

President Donald Trump stands less than one month away from making history as the first sitting US president to meet a sitting North Korean leader — but it's increasingly looking like he's ill-prepared and sailing towards embarrassment.

Trump has of late talked up his work on North Korea, crediting himself with creating the conditions for talks through a hardline policy. But that self-congratulation could come back to haunt him.

Throughout 2018, North Korea has pursued diplomacy with its neighbors on the back of a vague promise to denuclearize. Pyongyang's apparent wish to make peace with South Korea after Trump's nuclear brinkmanship throughout 2017 shocked much of the world and has generated Nobel Peace Prize buzz for the president.

But now Trump worries his meeting with Kim Jong Un "could turn into a political embarrassment," The New York Times' David Sanger reports, citing administration officials.

In mid-May, with only weeks until the historic summit, North Korea flipped on the US and South Korea, blasting them both with a series of complaints that seemed like a tantrum.

Sanger reported that Trump questioned whether or not he should even go through with the summit and hastily spoke by phone to South Korean President Moon Jae-in for reassurance.

Trump has so far stayed the course with the summit, which represents a a major part of his foreign policy accomplishments as president. For Kim, meeting a US president is a legitimizing win, lending his country previously unattainable international credibility.

But instead of Kim hoping the US grants him the legitimacy of a meeting, it now appears Trump is the one trying to hold on to a meeting North Korea appears willing to ditch.

Additionally, Trump is reportedly not thrilled about preparing for the summit, which will cover not only the narrow issue of nuclear weapons on the Korean Peninsula, but also virtually every major flash point in East Asian geopolitics.

Trump "doesn’t think he needs to" prepare for the summit with Kim that much, a senior administration source told TIME.

But if Trump is ill-prepared for the summit, and it does blow up in his face, he can share some of the blame.

"It increasingly looks like the Moon administration overstated North Korea’s willingness to deal," North Korea expert and political science professor Robert Kelly tweeted.

"Moon likely exaggerated this to tie Trump to a diplomatic track to prevent him from backsliding into last year’s war-threats which scared the daylights out of South Koreans. If Trump were less vain and had allowed his national security staff to vet the NK offer, he might have learned this," Kelly added.

It had been reported that Trump came dangerously close to striking North Korea last year. In doing so, he may have scared South Korea, not North Korea, into negotiations.

South Korea has reasons to push for diplomacy with North Korea, not least of which is that its citizens would likely bear the brunt of the suffering and death if war broke out.

North Korea has measurably gained from its diplomatic offensive by forging closer ties with China — and, as Trump has acknowledged, seemed to get Beijing to ease off sanctions. Trump's main achievement on North Korea thus far has been getting China to adhere to international sanctions.

Kim unwinding Trump's main win on the North Korean front with a sophisticated diplomatic ruse could prove embarrassing to Trump before the midterm elections, when he looks for a boost for the Republican Party.

North Korea experts fear that failed talks could lead the US to an even more militaristic path, possibly even to war against Kim.

Trump's newly appointed national security adviser, John Bolton, has long advocated for war with North Korea. And he has been partly blamed for the recent collapse in diplomatic progress.

Under the Constitution an individual commits treason if the nation is at war and the person provides aid and comfort to the enemy. This is an impeachable offense, committed by word or deed. It's one that individuals need to start grappling with seriously because it is not some far-fetched liberal fantasy to conclude that Donald Trump may have committed treason.

In fact, the case is fairly simple to make.

The U.S. intelligence community’s assessment of Russian activities in the 2016 presidential election concluded that Russia tried to influence the outcome through the dissemination and weaponization of information stolen from the Clinton campaign and the Democratic National Committee. The thirteen Russian operatives indicted by the Special Counsel for waging a disinformation campaign through our social media platforms and other internet media, described their activity as “information warfare against the United States of America.”

The question we must now ask is were these Russian cyber attacks merely crimes on a massive scale, or, as cyber expert George Lucas asks, do they represent something different — acts of war? And if a state of war existed between the two nations, could the actions and comments of Donald Trump and his campaign officials therefore be considered treasonable?

The first question is highly technical. International IT security experts have developed several analytical models to assess whether or not the damage caused by a cyber attack rises to the level of an armed attack. They have developed an “effects-based” approach, a model which gives consideration to the overall effects and consequences of a cyber attack on a victim state. For example, a cyber manipulation of information across a state’s banking and financial institutions that significantly disrupts commerce would be viewed as an armed attack.

Another model is one of “strict liability” that would automatically deem any cyber attack against a state’s critical national infrastructure to be an armed attack based on its potential for severe consequences. The validity of these models has been confirmed by the Pentagon’s usage of them in its recent draft recommendations on how the U.S. would respond to significant foreign cyber attacks.

Based on either one of these models, Russia’s cyber attack was an act of war. They significantly disrupted and damaged our Constitutional infrastructure in an attempt to undermine the foundation of U.S. democracy. They were of sufficient scope, duration and intensity to deem them armed attacks. Clearly, they meet the international criteria of an armed attack and an act of war against the United States.

First of all you have to have a recognized state of war or rebellion.

In this case the Russians are not a declared enemy of the US.

Second the person has to commit an overt act of war or providing aid and comfort to the enemy that must be witnessed by at least two persons.

You cannot have Treason by construction or conspiracy (See US v Burr).

There a reason why Treason is the only crime that is narrowly defined in the Constitution.

The founding fathers did not want to return to the star chamber days of Tudor England were people were executed at the King's whim.

1. So a few important points on that new NYT "Hurricane Crossfire" piece. A story that, BTW, all of us following this knew had to be coming. This is DOJ/FBI leakers' attempt to get in front of the facts Nunes is forcing out, to make it not sound so bad. Don't buy it. It's bad.

2. Biggest takeaway: Govt "sources" admit that, indeed, the Obama DOJ and FBI spied on the Trump campaign. Spied. (Tho NYT kindly calls spy an "informant.") NYT slips in confirmation far down in story, and makes it out like it isn't a big deal. It is a very big deal.

3. In self-serving desire to get a sympathetic story about its actions, DOJ/FBI leakers are willing to provide yet more details about that "top secret" source (namely, that spying was aimed at Page/Papadopoulos)--making all more likely/certain source will be outed. That's on them.

4. DOJ/FBI (and its leakers) have shredded what little credibility they have in claiming they cannot comply with subpoena. They are willing to provide details to friendly media, but not Congress? Willing to risk very source they claim to need to protect?

5. Back in Dec., NYT assured us it was the Papadopoulos-Downer convo that inspired FBI to launch official counterintelligence operation on July 31, 2016. Which was convenient, since it diminished the role of the dossier. However

6. Now NYT tells us FBI didn't debrief downer until August 2nd. And Nunes says no "official intelligence" from allies was delivered to FBI about that convo prior to July 31. So how did FBI get Downer details? (Political actors?) And what really did inspire the CI investigation?

7. As for whether to believe line that FBI operated soberly/carefully/judiciously in 2016, a main source for this judgment is, um . . .uh . . . Sally Yates. Who was in middle of it all. A bit like asking Putin to reassure that Russia didn't meddle in our election.

8. On that, if u r wondering who narrated this story, note paragraphs that assure everybody that hardly anybody in DOJ knew about probe. Oh, and Comey also was given few details. Nobody knew nothin'! (Cuz when u require whole story saying u behaved, it means u know you didn't.)

Welcome to the central organizing principle of the Trump White House. As the Russia investigation burrows closer to the Oval Office, the president, his staff, his collaborators in Congress and his defenders in the right-wing media are sparing no institution in their quest to undermine it. Look, a mole!

President Trump sank to a new low on Sunday, tweeting, “I hereby demand, and will do so officially tomorrow, that the Department of Justice look into whether or not the FBI/DOJ infiltrated or surveilled the Trump Campaign for Political Purposes — and if any such demands or requests were made by people within the Obama Administration!”

Putting aside the cartoonish language (“I hereby demand”? Really?), consider the seriousness of the threat posed by a president ordering federal law enforcement officials to investigate the people who are investigating him.

On Monday, Mr. Trump persuaded the Justice Department to ask its inspector general to look into his accusations, hoping that these countercharges make the public forget the broader context of the Russia investigation. So let’s look at what we already know.

First the facts: There was a sophisticated, multiyear conspiracy by Russian government officials and agents, working under direct orders from President Vladimir Putin, to interfere in the 2016 presidential election in support of Donald Trump. The American law enforcement and intelligence communities warned the Trump campaign and asked it to report anything suspicious. The campaign didn’t do this. To the contrary, at least seven Trump campaign officials met with Russians or people linked to Russia, and several seemed eager to accept their help. As the F.B.I. became aware of these contacts, it began to investigate. And yet the bureau went to great lengths to shield this investigation from becoming public before the election, even as James Comey, then the F.B.I. director, spoke openly about the investigation into Hillary Clinton’s private email server.

These facts aren’t disputed. The intelligence community confirmed Russia’s efforts on Mr. Trump’s behalf in January 2017, and last week Richard Burr, the Republican chairman of the Senate Intelligence Committee, said he saw “no reason to dispute” those findings.

Do these sound like the actions of government officials intent on bringing down a presidential candidate?

What about the law? It is a federal crime to lie to federal authorities, obstruct justice, launder money, fail to register as a foreign agent and conspire with a foreign power to influence the outcome of an election. Top officials in Mr. Trump’s campaign and administration have already been indicted on or pleaded guilty to some of these charges. This is just the start; the special counsel, Robert Mueller, appears to have gathered a great deal more evidence with the help of cooperating witnesses. And we haven’t even talked about Michael Cohen yet.

Meanwhile, Republicans in Congress compound their shame daily, either by standing by in silence or by working actively with the White House and conservative media to help expose the identity of an F.B.I. informant. Was it just a year ago that these same people professed outrage at the supposed “unmasking” of American citizens caught up in duly-authorized surveillance?

This self-interested assault is doing incalculable damage to the integrity of American law enforcement. It’s up to those people who have devoted their lives to the nation and to the rule of law, like Deputy Attorney General Rod Rosenstein and the F.B.I. director, Christopher Wray — both Republicans and Trump appointees, don’t forget — to stand up to the president and defend these institutions.

One doesn’t have to agree with the particulars of every investigation to see the fundamental difference here: The members of our law enforcement and intelligence communities are trying to protect the country. Donald Trump and his supporters are simply trying to protect Donald Trump.

President Trump is right to order that action be taken. And unlike in the last brouhaha over FISA surveillance, the president did not imply that a referral to the inspector general would be problematic. As we observed in the March 1 editorial, Horowitz “has earned a reputation for probity and fact-driven independence.” As we await his much-anticipated report on the FBI’s performance in the Clinton-emails investigation, it should be noted that, since our editorial, Horowitz has issued a comprehensive report on the misconduct of the FBI’s former deputy director, Andrew McCabe, which resulted in a criminal referral. (See my April 21 column, here.)

Predictably, knee-jerk Trump critics are exercised over the president’s giving an order to the Justice Department, claiming political interference in law-enforcement. Quite apart from the fact that the Justice Department is subordinate to the chief executive in our constitutional system, the criticism overlooks two distinctions we have repeatedly stressed, between (a) counterintelligence and criminal investigations, and (b) official misconduct and ordinary crime.

Though carried out by executive officials (i.e., investigators and prosecutors), criminal investigations are governed by congressional penal statutes and overseen by the courts. By contrast, counterintelligence is an investigative activity undertaken entirely in support of the president’s constitutional responsibility to protect the nation from foreign threats. It is not “interference in law-enforcement” when the president directs the Justice Department and FBI to take action in connection with their counterintelligence mission, and to ensure that this mission is being conducted properly. If counterintelligence authorities were exploited to spy on a political campaign in the absence of strong evidence that the political campaign was in a traitorous conspiracy with a hostile foreign power, that would be a major abuse of power. The buck stops with the president, and he has a duty to see that this question is investigated.

Well let's start with the fact that these organizations are all people with political opinions. They were either for Hillary or for Trump?

CIA under Brennan - CIA leadership were full go for Hillary. People working there said they had campaign propaganda around the office Not in dispute.
FBI - Peter Strzok, Andrew McCabe? Comey kept Clinton out of jail?
The DNC - Well I hope they wanted Hillary to win. Although they were probably not real good at it.
The DOJ - Of course Loretta Lynch wanted to keep her job. Do you really believe Lynch met with Slick Willie to discuss grandchildren?
The Obama White House - Of course Obama wanted a Democrat to win. He campaigned for her?
