IG Report expected today

There is a great deal of speculation as to why an Inspector General report that has been completed for a couple of weeks now, has been held off from final public release. The explanations range from some giving those mentioned in the report a chance to provide a response, to FBI brass scrubbing embarrassing portions out of the final draft.


I would fully expect to see an "unredacted" version of the report, as the job of the Inspector General is not to give away company secrets. If there is heavy redaction, I might expect some real serious push back from most everyone.

Jeff Sessions has suggested that he is waiting to see the report, and won't hesitate to use the contents to clean more house in the FBI. I guess we will know (sometime today) if such action will be necessary.

UPDATE:  The report is said to be approximately 500 pages, and portions of it are being leaked to a variety of sources. So far nothing unexpected or earth shattering has been reported. That being said, it will probably take some time for all 500 pages to be parsed.

Here is one portion of the report:
In undertaking our analysis, our task was made significantly more difficult because of text and instant messages exchanged on FBI devices and systems by five FBI employees involved in the Midyear investigation. These messages reflected political opinions in support of former Secretary Clinton and against her then political opponent, Donald Trump. Some of these text messages and instant messages mixed political commentary with discussions about the Midyear investigation, and raised concerns that political bias may have impacted investigative decisions.
In particular, we were concerned about text messages exchanged by FBI Deputy Assistant Director Peter Strzok and Lisa Page, Special Counsel to the Deputy Director, that potentially indicated or created the appearance that investigative decisions were impacted by bias or improper considerations. As we describe in Chapter Twelve of our report, most of the text messages raising such questions pertained to the Russia investigation, which was not a part of this review. Nonetheless, the suggestion in certain Russia-related text messages in August 2016 that Strzok might be willing to take official action to impact presidential candidate Trump’s electoral prospects caused us to question the earlier Midyear investigative decisions in which Strzok was involved, and whether he took specific actions in the Midyear investigation based on his political views. As we describe Chapter Five of our report, we found that Strzok was not the sole decisionmaker for any of the specific Midyear investigative decisions we examined in that chapter. We further found evidence that in some instances Strzok and Page advocated for more aggressive investigative measures in the Midyear investigation, such as the use of grand jury subpoenas and search warrants to obtain evidence.
Contrary to the reports from the left, the report clearly does not resolve everyone of political bias. It's clear that the I.G. believes politics played a part in some of the decision making, especially as it pertains to the investigation into Russian Collusion (which of course will be in a later report). What is suggested was that there was no "documentary or testimonial evidence" of such political bias directly effecting decisions (which means that nobody wrote it down or admitted to it).

It is also clear that while the actions were not "unreasonable" - this does not mean that the I.G. felt that the actions reflected the best choice available. I think people will look at the facts of the report and come to their own conclusions. It seems obvious to me that many people will come to the conclusion that two plus two does not equal three or five.

Secretary of State Mike Pompeo told Asian powers on Thursday that President Trump was sticking to demands that North Korea surrender its nuclear weapons, as he sought to hold together a fragile consensus on maintaining tough sanctions against the North despite Mr. Trump’s declaration that it was “no longer a nuclear threat.”

At a news conference in Seoul, South Korea, Mr. Pompeo softened some of the president’s recent comments — but did not retract them — and insisted that United Nations sanctions would remain in place until North Korea had accomplished “complete denuclearization.”

“We are going to get the complete denuclearization,” Mr. Pompeo told reporters. “Only then will there be relief from sanctions.”

His remarks were intended to reassure the American allies Japan and South Korea and refute reports in North Korea’s state media that the United States had agreed to ease sanctions against the North. They were also a clear appeal for cooperation from Beijing, where Mr. Pompeo was set to visit on Thursday night.

Mr. Pompeo huddled with the foreign ministers of South Korea and Japan in Seoul two days after Mr. Trump met North Korea’s leader, Kim Jong-un, in Singapore for the first-ever summit meeting between the leaders of their two countries. In a joint statement signed there, Mr. Kim committed to the vague promise of “complete denuclearization” and Mr. Trump promised equally vague security assurances.

The document was glaringly light on details, including when and how North Korea would dismantle its nuclear program and what it would do with its missiles.

North Korean state media on Wednesday reported that Mr. Trump had agreed to lift sanctions when relations improved and that he had endorsed a “step-by-step” denuclearization process, rather than immediate and total dismantlement. Adding to global confusion were comments by Mr. Trump that the world can “sleep well tonight” because “there is no longer a nuclear threat from North Korea.”

Soboroff was part of a small group of journalists allowed inside the Casa Padre shelter that houses nearly 1,500 boys from 10- to 17-years-old who, for the most part, cross over the U.S.-Mexico illegally to seek asylum. The childcare facilities are run by the non-profit organization Southwest Key Programs and is contracted with the Office of Refugee Resettlement, an umbrella agency of the U.S. Department of Health and Human Services.

Newsweek reported on Tuesday that the childcare facility Soboroff toured was one of 16 Southwest shelters across the state where Texas inspectors found nearly 150 health violations in the past year. At that specific Casa Padre shelter, a child who tested positive for a sexually transmitted disease was not given medial treatment for two weeks. On June 3, Democratic U.S. Senator Jeff Merkley of Oregon was denied access to the same shelter just before staff called police on him.

Soboroff related the inside of the detention center, which was once a Wal-Mart with no windows on the inside, to federal prisons and county jails. He said although the kids are not in cells, they are still incarcerated. A shelter employee asked him and other reporters to smile at hundreds of migrant kids in line for food because “they feel like animals in a cage being looked at.”

The family detention centers the Obama administration has been operating in Texas and Pennsylvania have been an expedient way to handle the soaring numbers of Central Americans, many of them young children, who have arrived at the Southern border since 2014. They give a sense that Homeland Security has the border situation under control, and they supposedly send a message to other would-be refugees not to come.

But these privately run, unlicensed lockups are no place for children. Or mothers. Their existence belies President Obama’s oft-professed concern for the humane treatment of people fleeing crime and violence in Guatemala, Honduras and El Salvador.

And the centers stand on dubious legal ground. Last year, a district judge ruled that the administration was violating a 1997 court-ordered settlement, called the Flores agreement, that governs the treatment of underage migrants who seek asylum or enter the country illegally. The judge said the children were being held for too long, and ordered the administration to release them as quickly as possible to the care of relatives or other guardians as their cases move through the immigration courts.

The administration appealed, saying that the agreement applied only to children who had crossed the border alone, not those who were accompanied by parents or other adult relatives. On July 6, the Court of Appeals for the Ninth Circuit disagreed, upholding the district ruling that Flores covers all children, accompanied or not. But it said the administration could still detain their parents.

Which leaves things pretty much where they were — unsettled, unsatisfactory, unfit for a country that aspires (or once did, anyway) to be an example to the world in its welcome for desperate refugees. The administration hasn’t said whether it will appeal, but it’s hard to imagine that it will use the appeals court ruling to break up families — sending children to foster care, maybe, while continuing to hold their mothers behind bars. On a separate issue not addressed by the Ninth Circuit ruling, plaintiffs have accused the administration of subjecting children to miserable conditions at Border Patrol stations.

If the Obama administration took its principles to heart, it would be closing its family prisons and abandoning its emphasis on border crackdowns in favor of greater efforts to connect Central Americans with pro bono lawyers and to provide family- and community-based alternatives to detention. Much money and effort have been spent to deter and detain them, to speed them through court, to hunt down those who are later found to be deportable.

It would be far better to to score a humanitarian victory by reuniting children and families, especially since data show that Central Americans with asylum claims are far more likely to show up in court — and win their cases — when they have lawyers.

Legislation introduced this month in Congress seeks to attack the problem at its root, with funds for combating human trafficking and resettling refugees within Central America and Mexico. But Congress is unlikely to pass it, which leaves the crisis in the president’s hands. Donald Trump and his Republican Party minions have taken the immigration debate to sickening lows, with disgraceful animus toward Mexicans and Muslims. Mr. Obama has forcefully denounced such nativism. But he can add strength to his words by ensuring greater protection for those who arrived, defenseless, at the Southern border.

For the past year and a half, the inspector general's office has been looking into an array of allegations that the Justice Department and FBI may have allowed political considerations to poison its investigative decisions in the Clinton-related case and other inquiries.

Most controversial was Comey's July 2016 announcement on national TV that Clinton would not face charges because there was no "clear evidence" that she "intended to violate" the law. But, Comey said, the former secretary of state was "extremely careless" in her "handling of very sensitive, highly classified information."

Comey did not consult with the Justice Department at all before making the announcement.

"We found that it was extraordinary and insubordinate for Comey to do so," the inspector general's report released Thursday said. "We concluded that Comey's unilateral announcement was inconsistent with Department policy and violated longstanding Department practice and protocol by, among other things, criticizing Clinton's uncharged conduct."

However, Horowitz said the "judgment calls" made by those investigation Clinton "were not unreasonable," and the ultimate decision not to charge Clinton "was consistent with the Department’s historical approach in prior cases under different leadership, including in the 2008 decision not to prosecute former Attorney General Alberto Gonzales for mishandling classified documents."

Sought to obtain evidence whenever possible t hrough consent but also used compulsory process, including grand jury subpoenas, search warrants, and 2703(d) orders (court orders for non-content email information) to obtain various evidence. We found that the prosecutors provided justifications for the preference for consent that were supported by Department and FBI policy and practice; • Conducted voluntary witness interviews to obtain testimony, including from Clinton and her senior aides, and did not require any witnesses t o testify before the grand jury. We found that one of the reasons for not using the grand jury for testimony involved concerns about exposing grand jurors to classified information; • Did not seek to obtain every device, including t hose of Clinton’s senior aides, or the contents of every email account through which a classified email may have traversed. We found t hat the reasons for not doing so were based on limitations the Midyear team imposed on the investigation’s scope, the desire to complete the investigation well before the election, and the belief that the foregone evidence was likely of limited value. We further found that those reasons were, in part, in tension with Comey’s response in October 2016 to the discovery of Clinton emails on the laptop of Anthony Weiner, t he husband of Clinton’s former Deputy Chief of Staff and personal assistant, Huma Abedin; • Considered but did not seek permission from t he Department to review certain highly classified materials that may have included information potentially relevant to the Midyear investigation. The classified appendix to this report describes in more detail the highly classified information, its potential relevance to t he Midyear investigation, the FBI’s reasons for not seeking access to it, and our analysis; • Granted letter use immunity and/or “Queen for a Day” immunity to three witnesses in exchange for their testimony after considering, as provided for in Department policy, the value of t he witness’s testimony, the witness’s relative culpability, and the possibility of a successful prosecution; • Used consent agreements and “act of production” immunity to obtain the culling laptops used by Mills and Samuelson, in part to avoid the uncertainty and delays of a potential motion to quash any subpoenas or search warrants. We found that these decisions were occurring at a time when Comey and the Midyear team had already concluded that there was likely no prosecutable case and believed it was unlikely the culling laptops would change t he

outcome of the investigation; • Asked Clinton what appeared to be appropriate questions and made use of documents to challenge Clinton’s testimony and assess her credibility during her interview. We found that, by the date of her interview, the Midyear team and Comey had concluded that the evidence did not support criminal charges (absent a confession or false statement by Clinton during t he interview), and that the interview had little effect on the outcome of the investigation; and • Allowed Mills and Samuelson to attend the Clinton interview as Clinton’s counsel, even t hough they also were fact witnesses, because t he Midyear team determined that the only way t o exclude them was to subpoena Clinton to t estify before the grand jury, an option that we found was not seriously considered. We found no persuasive evidence that Mills’s or Samuelson’s presence influenced Clinton’s interview. Nevertheless, we found the decision t o allow them to attend the interview was inconsistent with typical investigative strategy.

Contrary to the reports from the left, the report clearly does not resolve everyone of political bias.


The text messages between the two, who were in a romantic relationship, suggest that they were deeply, and inappropriately, biased against Trump. But they did not have the authority to make major decisions about the Clinton investigation. And the one who was still involved in the Russia investigation was removed from the case once his supervisor learned of his attitude.

I think people will look at the facts of the report and come to their own conclusions. It seems obvious to me that many people will come to the conclusion that two plus two does not equal three or five.

Your predetermined beliefs that the two FBI employees influences on the investigations add up to zero.

“My father was a Korean War veteran who would be 90 today,” Maureen McFadden, a TV reporter, wrote on Twitter. “His parents were long gone during the election, as was he.”

Angus Johnston, a US historian, said: “An 18-year-old parent of an 18-year-old soldier killed on the last day of the Korean War would have been 99 years old in 2016. Trump says ‘so many’ of them reached out to him personally during the campaign.”

Three weeks later, some of the juicier numbers from last month’s primary have begun rolling in.
Chris Huttman is a Democratic operative now crunching numbers on behalf of Lucy McBath of Marietta, one of two Democratic candidates in the Sixth District congressional runoff. She faces Kevin Abel, a Sandy Springs businessman, in the July 24 runoff.

Huttman sent over a spreadsheet on Wednesday that broke down the GOP and Democratic primaries by race, voting history, and the 14 congressional districts. Some of his findings:

-- African-Americans made up 29 percent of the voting universe on May 22, counting both Republican and Democratic ballots. Which means that Stacey Abrams, the Democratic nominee for governor, still has turnout work to do. Thirty percent of the 6.1 million registered voters statewide are African-American, an area in which Abrams must overperform if she’s to have a chance in November.

-- On the other hand,102,330 participants in the Democratic primary, who cast 21 percent of the ballots, were new or had not voted in a primary at least since 2010. On the GOP side, 50,533 were likewise new or infrequent voters – making up 8 percent of Republican ballots cast. A 2-to-1 ratio when it comes to new voters is good news for Democrats.

-- If Huttman’s figures are correct, the May primary produced some evidence of white voter dissatisfaction with the GOP brand among new or infrequent voters. On the Democratic side, 60 percent of all votes were cast by African-Americans. (Black voters made up 1 percent of the GOP electorate.)

But when looking only at the new or infrequent voters who participated in the Democratic primary, we find that 52 percent are African-American, which indicates an uptick in white participation.
