So why is it a constitutional crisis to criticize the Intelligence community...

But perfectly acceptable to criticize a President in order to undercut his credibility? 

The concept that we do not criticize our intelligence community because such criticism can undercut their credibility would be a wonderful argument, if the people making it were willing to engage in prudent restraint for the same reason.

The reality here is that all of this constitutional crisis nonsense starts and stops with people who simply refuse to accept the legitimacy of our duly elected President to be President. When you simply refuse to acknowledge that your side lost and the other side won, you hold no practical high ground in any argument... unless that argument is with a toddler who wants more cake or Labrador Retriever who refuses to give up the chicken bone that they dug out of the garbage.

When you have grown up enough to accept that things don't always go the way that you want them to, and that you still need to live with results, then at that time you would have some standing to make an argument on principal.

The day when you are willing to use "your own" logic about damaging credibility of our national leadership as it pertains to "you" criticizing the President, is the day you can justify the same argument about the previous leadership of our intelligence community.

But until that day arrives, feel free to simply shut the @*$& up.

You're avoiding the problem with Presidential power. Trump is clearly claiming that his power within the intelligence community and the department of justice are unlimited. And the only way to stop him from directing the DOJ to act out even illegally short of impeachment.

DENVER -- An FBI agent allegedly dropped his gun at a bar and another patron was shot in the leg early Saturday. Investigators said it appeared to be an accidental shooting.

Denver police said they were called to a report of a shooting at 2201 Lawrence Street at 12:45 a.m.

A woman who said she witnessed and recorded the shooting with her cell phone said it happened at Mile High Spirits Distillery and Tasting Bar.

In the video, a man can be seen doing a back flip, during which a gun falls out of the back of his waistband. The gun appears to fire when the man picks up the weapon.

"It appears an off-duty Federal Bureau of Investigations (FBI) agent was dancing at a night club when his firearm became dislodged from its waistband holster and fell onto the floor. When the agent retrieved his handgun an unintended discharge occurred, another patron was struck by a bullet in the lower leg," a statement from Denver police said.

The woman who recorded the video, who wanted to only be identified as Julie, said she smelled gun powder and saw a person bleeding.

"Everyone was kind of shocked after it happened because [the agent] kind of put his gun back away and then he walked away," Julie said.

The Constitution provides that every person working in the executive branch does so as an agent of the President. So technically (like it or not) there is no independent authority of the intelligence community. They invariably all answer to the President. Not just this President, but every President, past and future.

All of which is simply red herring, Rog...

The President hasn't fired Special Counsel. The President isn't calling for any criminal prosecution of anyone. He is not sending clandestine paid agents to go follow around his political opponents.

He asked that the FBI Inspector General look into allegations (made by an awful lot of people based on a wide variety of questionable information) that the FBI did not use proper procedures, did not follow the proper rules, follow the proper guidelines in using this particular agent to go make contact with Trump campaign associates.

This is 100% exactly what the Inspector General is supposed to do. Every FBI agent knows that they can be investigated at any time. Heck, a cop shoots someone, and it's automatic that they go on administrative leave, and that someone looks into the shooting. You do something questionable, they know that an IG will look into it. It's supposed to keep them honest.

This is not a request for a criminal investigation. Nobody has to hire any attorneys. Nobody's rights are being violated. There will be no late night raids where crash down doors and wake up people in their pajamas. There will be seizing of Attorney client information.


Why do you see an internal investigation as such a problem, Rog?

Are you that scared of what they will find?


Because I think we both know that the chances of the IG finding wrong doing is probably about 1000% more likely than Special Counsel finding something substantial regarding Trump at this point.

Actually as argued by WP and many others: Even legal actions can be deemed to be illegal if they are done for nefarious reasons. The FBI has the authority to investigate a wide variety of things. But they have specific rules, procedures, and regulations that they are supposed to follow. If they do not follow these rules, procedures, and regulations then they could be subject to a variety of discipline (that they are well aware of). People in the FBI understand that if they break these regulations for reasons that are found to be corrupt, that they will lose their jobs, and possibly face prosecution.

If you have done any reading on this subject (other than with the NY Times and Washington Post) you would know that (just for instance) that FBI regulations provide VERY SPECIFICALLY when a undercover human resource can be used. Their regulations are very clear, that such a resource cannot be used in the preliminary portion of an investigation (when they have suspicion but no evidence). The FBI rules and regulations provide that when there is simply suspicion that only the least intrusive means can be used to further investigate. There is a list of things that they are "not supposed" to do. Those means must product certain results before they can open the second stage of an investigation.

There is every indication (based on what the FBI has provided people) that they were using their "human resource" during the preliminary stages (against their own regulations). That is just "one" of the problems with the investigation so far.


At the end of the day, you simply don't want to know if the FBI followed the rules and regulations. You would prefer that the American public be completely "LEFT IN THE DARK" over the matter.

Why? Because if the FBI was engaged in nefarious actions, and an IG finds that they did not follow their own rules and procedures, that it will cast a dark cloud over the entire investigation.

For you this is 100% about Mueller's investigation of Trump. Because in your mind EVERYTHING is about Trump. Anything that would harm that investigation needs to be prevented AT ALL COST... even if that means not doing what everyone deep down understands is the right thing to do.

It also doesn't stop the fact that there was an ongoing investigation into the opposition campaign (that we now know included the knowledge and input of the President himself)... and that every bit of reasoning for it has completely fallen apart.

Every last bit of it was 100% constitutionally factually correct.

I am sorry if you don't like the fact that the President is actually "in charge" of the executive branch (including the intelligence community) but that is the fact, none-the-less.

The letter expresses absolutely nothing that isn't entirely true for any President. The President of the United States can in fact (and have in the past in fact) pardoned people who were under investigation, just to stop an investigation. The President cannot be charged with obstruction for firing the FBI director. The President cannot be charged with obstruction because he talked to the Attorney General about the Special Counsel.

The A.G. and everyone underneath the A.G. answer to the President. Again, sorry if that upsets you, but it's the goddamned constitutional law.


As much as you would like to believe that somehow the President is staking a claim to something he is not entitled to, it's simply not true. The NYT, WaPo, and everyone else is barking at the moon.


Lastly, if you bothered to actually follow the logic of the letter, it states very emphatically (and likely 100% factually) that all of the answers to the questions have already been supplied to Mueller... meaning that a subpoena would likely "not" hold up in court, if the President fought it.


Mueller needs to get back to what he was assigned to do, or he needs to put an end to things. This is not a banana republic where we simply appoint unelected and unconfirmed people to be provided plenary legal powers to do what-ever the hell they want. Simply because they don't like the President who was elected.

Again, the President has not fired Robert Mueller and has no intentions of firing Robert Mueller. The President has endured four different investigations over a two year period.

The President is NOT acting "above the law" by requesting an I.G. look into the possibilities that our former intelligence community leadership didn't follow rules, regulations, and guidelines in their investigation of a Political campaign.

I am okay with both the President, his campaign, and the intelligence community being investigated.

If they violate the law they can be charged and tried and if found guilty they would go to jail.

If the President violates the law or does unconstitutional acts he cannot be charged. If he's indicted it will go to the Supreme Court. But even then the only solution is impeachment. I'm going to repeat the last truth.

I have never stated that the President cannot or should not be held accountable if he broke the law. I have no issue with the fact that a President can be guilty of a crime and be held accountable, as well as anyone who broke the law with in a campaign or administration can also face criminal prosecution.

A President could even obstruct justice, by bribing a witness, by destroying evidence, by lying under oath. But you cannot provide for a "special case" of obstruction for a President simply because a President exercises his authority in a manner which certain people do not like.



SERIOUSLY ROGER... has it escaped your attention that the President has been under investigation for over two years now, and has done nothing to stop the investigation, willingly turned over thousands of requested documents, and allowed pretty much every member of his campaign to talk to the investigators?

Are you really so obtuse as to not see that the President has cooperated in this investigation as much as any President has ever cooperated in any investigation of the White House in spite of no evidence that any crime was committed. Remember the Whitewater investigation and all of those missing Rose Law Firm documents that were subpoenaed but never turned over to Starr?

In a legal settlement that still awaits a federal judge's approval, the IRS "expresses its sincere apology" for mistreating a conservative organization called Linchpins of Liberty — along with 40 other conservative groups — in their applications for tax-exempt status.

And in a second case, NorCal Tea Party Patriots and 427 other groups suing the IRS also reached a "substantial financial settlement" with the government.

Sekulow, who is also on President Trump's personal legal-defense team, said the IRS agreed to stop "the abhorrent practices utilized against our clients."

The Linchpins case, in federal circuit court in Washington, D.C., has no monetary settlement. The two sides agreed to bear their own legal fees.

The consent order says the IRS admits it wrongly used "heightened scrutiny and inordinate delays" and demanded unnecessary information as it reviewed applications for tax-exempt status. The order says, "For such treatment, the IRS expresses its sincere apology."

In the separate NorCal case, plaintiffs' lead counsel Eddie Greim told NPR an IRS apology alone was not sufficient to end the matter. But he declined to reveal the financial settlement amount.

In the NorCal case, plaintiffs allege the IRS violated their constitutional rights by using tax information for improper purposes. The settlement still must be approved by the federal district court in Cincinnati, home of the IRS division on tax-exempt organizations.

The settlements may not put the fierce controversy over IRS conduct to rest, but they mark the most significant resolution so far.

The controversy began in 2013 when an IRS official admitted the agency had been aggressively scrutinizing groups with names such as "Tea Party" and "Patriots." It later emerged that liberal groups had been targeted, too, although in smaller numbers.
