CNN plays Cohen Tape...

Cohen tape more muddled than smoking gun 
“I need to open up a company for the transfer of all of that info regarding our friend David,” Cohen said in the recording, likely a reference to American Media head David Pecker. When financing comes up again later in the conversation, Trump interrupts Cohen asking, “What financing?” according to the recording. When Cohen tells Trump, “We’ll have to pay,” Trump is heard saying “pay with cash” but the audio is muddled and it’s unclear whether he suggests paying with cash or not paying. Cohen says, “no, no” but it is not clear what is said next…
To be (pun intended) "clear" here, we have two versions of these events.

The first is an argument that this was specifically about paying off Karen McDougal. The problem is that the tape never mentions McDougal or any specific payment to her. While some may want to make that assumption, it's not actually what the tape states.

The second assumption is that the what you hear on the tape is what the conversation was about. That they were talking about opening up a company (presumably to garner the story rights), and discussing whether or not the funding for the company would come from financing (loan) or if they would pay cash outright. In cases of financing business deals, cash does not necessarily mean you buy a company with a bag full of $100 bills.

Those are going to be the several "competing story lines" here. Occam's razor suggests that when presented with the competing hypothesis, that the one with the least amount of assumption is likely the correct one.

You can all decide for yourself. I am sure most of you already have.

Trump was aware that there was an effort to silence the Playboy model. He suggested cash or a check. He knew that if it came out in public it would have had a negative impact upon the election.

1: He didn't say that affair didn't happen. He has repeatedly denied the affair.

2: They were trying out how to get the money to her. The use of a false company to conceal the source of the money was discussed.

3: It's unclear if a check would be used .

4: He suggested cash. No no no.

The total damage to the already damaged support will be seen. It's certain that he did have an affair with her. It's just another lie that won't bother you. Trumpism demands intellectual dishonesty.

It's clear that you are upset because I only posted what was heard, rather than what it was you wanted to hear. What wasn't revealed in this conversation is more important than what was:

- It was not revealed that any "payoff" was made directly to McDougal as originally suggested.
- It was not revealed that any campaign funding was used as originally suggested. In fact, it would appear that this company was going to be funded by Trump himself.


As it stands, there is no "there there". There is no crime. No impeachable offense. Nothing other than people grossly overstating what they believed happened.

To be perfectly clear... other than to watch the reaction from people like yourself, none of this matters one bit to me.

Summing up: the Clean Air Act enacts national standards for things like cars' exhaust. But it contains a provision which states that any state may be granted a waiver permitting them to enact even more stringent regulations, so long as they're "necessary" for that state.

California has sought such a waiver and has been granted that waiver for as long as the Clean Air Act has existed.

California is the country's largest auto-market, so car manufacturers just build for California. It would be more costly to set up factories to produce some cars that are California-legal and some others that are legal everywhere else. So the waiver permits California to essentially set the nation's car-exhaust policies.

This, of course, forces the rest of the country to subsidize California's environmental occultism, as the costs of these unnecessary abatement schemes are lowered in cost because their R&D costs are shared by a nation which doesn't need them, and California gets the savings of a massive economy of scale only by drafting unwilling Americans to be forced into being consumers of the products that they demand but which few others want.

Trump's EPA seems ready to end this special perpetual waiver.

A federal judge on Wednesday rejected President Trump’s latest effort to stop a lawsuit that alleges Trump is violating the Constitution by continuing to do business with foreign governments.

The ruling, from U.S. District Judge Peter J. Messitte in Greenbelt, Md., will allow the plaintiffs in the case — the attorneys general of Maryland and the District of Columbia — to proceed with their case, which says Trump has violated the Constitution’s little-used emoluments clause.

The plaintiffs now want to interview Trump Organization employees and search company records to determine which foreign countries have spent money at Trump’s hotel in downtown Washington.

The Justice Department and Trump’s attorneys did not immediately respond to requests for comment. They could try to appeal the decision to a higher court and ask Messitte not to allow the attorneys general access to Trump Organization employees and books until the appeal is decided.

The lawsuit, filed last year by D.C. Attorney General Karl A. Racine (D) and Maryland Attorney General Brian E. Frosh (D), cleared an initial hurdle in March. Back then, Messitte settled one legal question, ruling that the plaintiffs had legal standing to sue the president in the first place.

He also limited the scope of the case to Trump’s Washington hotel; previously, the plaintiffs had also wanted to search for foreign-government spending at other Trump properties as well.

The next unsettled questions: What, exactly is an emolument?

That was a question that remained unanswered for more than 200 years.

The Constitution bars federal officials from taking emoluments from any “King, Prince, or Foreign State.” The Founding Fathers’ intent had been to stop U.S. ambassadors overseas — emissaries from a new, poor, fragile country — from being bought off by jewels or payments from wealthy European states.
