Smart money is on a woman to be the Trump nominee...

So the key here for Trump is to pick someone that fits into the same mold as Alito and Gorsuch. Young, reliably conservative, but not so extreme as to upset the apple cart. With only 51 Senators (and McCain incapacitated), Trump cannot really afford any Republican defectors. Susan Collins has already suggested she might balk at certain names on the President’s list of 25, because they are seen as hostile to Roe v Wade. Trump will quite obviously have to run any potential name past Collins, Murkowski, and a handful of other moderates. This is why I believe he will end up picking one of the three women on the list (Amy Coney Barrett, Allison Eid, or Joan Larson).  



Besides the obvious fact that it would be much harder for a conservative woman to vote against another conservative woman, it would take away the obvious “another white conservative man” argument that is almost certain if Trump nominates someone like Brett Kavanaugh.  Moreover, all three of these women faced confirmation votes within the past year, and all three garnered the full support of the Republican Senators, as well as a handful of Democratic defectors. Certainly Susan Collins would not vote against someone she just voted for a few months ago. Likewise Joe Manchin and Joe Donnelly both voted for all three of these women, and would face tons of election pressure to make the same vote again representing red states. Heidi Heitkamp and Bill Nelson are other Democrats who voted for one or more of these Judges within the past year, making it hard for them to reverse positions in the heat of an election season.

On the flip side, Brett Kavanaugh was confirmed back in 2003 as part of a larger “deal” struck by Republicans and Democrats. Even if some of these Senators may have voted for him back in 2003, there is less of a guarantee that they would stick to that vote again.

Trump is nothing, if not pragmatic when it comes to cutting a deal. While some may believe he will attempt to bully his way through this situation, I suspect that he will have all of the ducks in a row before announcing his decision. I would be shocked (and horribly disappointed) if the Trump nominee ended up being someone that caused problems with the Collins’ and Murkowski’s of the Party.

On a less than happy note: There is no guarantee that McCain will still be in office by the time a vote comes around. The prognosis for his type of disease puts him near the end of the rope. Even as it stands, he is not effectively acting as a Senator representing Arizona. While he obviously deserves wide latitude in making his retirement decision on his time, there may not be much time left for him to do so. I find it hard to imagine a situation where a USSC nominee has 49 votes, McCain is unable to vote, but still demands that he keeps his seat. He is a man of principle, and certainly would not place himself above something this important to the conservative movement.

I haven't yet looked closely at the potential nominees. I will be surprised if he doesn't nominate a (clone) of Scalia.

Pragmatism isn't one of his characteristics.

They have been trying to get the swing state Senators in line.

But given the fact that his campaign message, including the interview with Matthews on (penalties) I don't think he will be pragmatic in his selection.

We shall see.

Roger - according to sources, two of the three women I mentioned are on his short list of five. If you were paying any attention (were you?) - then you would understand that if he chooses one of these two women, that it will be a nominee that has already been confirmed once (for a lower court) in the past year.

In other words, these women fit the bill of someone who should be confirmed, likely with some support from Democrats.


Keep in mind that Collins voted to confirm Neil Gorsuch. So if your idea of "extreme" is someone like Gorsuch, then you have a completely different understanding of "extreme" than someone like Collins does.

The progressives’ attitude toward Kennedy is one of ingratitude because their attitude toward the Supreme Court (among many other things) is one of entitlement. Under the progressive vision of judges as politicians in robes, progressives had no entitlement to anything from a Republican appointee like Kennedy. Yet the Left expected Kennedy to not only write and join progressive decisions, but also to chain himself to his chair like a protester until a Democrat won the presidency.

As Ed Whelan, president of the Ethics and Public Policy Center, put it: “it’s a version of the Brezhnev Doctrine. What the Left has wrongly seized, it thinks it’s entitled to keep.” The Left’s ungrateful reaction to Kennedy’s retirement should serve as a lesson to everyone else about progressivism. It should also be a particular lesson to two people.

He’s about the only one. As the Trump administration readies a report on imported cars that could be the pretext for new tariffs, economists and industry officials warn of soaring costs for car buyers, a drop in overall sales and a net loss of jobs. Trump said recently that if trading partners don’t agree to his demands, “I’m going to tax their cars coming into America, and that’s the big one.” Big blunder might be more likely.

Trump’s idea is to impose a 20% tariff on imported cars, to encourage more domestic auto production. Imports would become more expensive, so consumers, in theory, would buy more domestic models, and more automakers would build cars in America to escape the tariffs.

In reality, the most certain outcome is that prices would shoot up as soon as the tariffs went into effect. The policy is nuts; virtually all experts, both in trade and in foreign policy, believe global trade is very good for the U.S.
In fact, according to Swan’s reporting, almost everyone in the White House thinks the bill “is unrealistic or unworkable.”
Why does it exist, then? Because Trump ordered it, and sometimes the best way to mollify a president is to give him what he wants — very slowly, and without anything actually happening. Apparently this thing has been kicking around for months.
The bill has virtually no chance whatsoever of being enacted into law.
The draft bill has a title, the United States Fair and Reciprocal Tariff Act, which yields an acronym that had every Twitter wag making fart jokes Sunday night.

On that last point, political scientist Brendan Nyhan made the crucial point: There are actually two perfectly plausible explanations. So to summarize: The president ordered something inept; he’s not going to get what he wanted; and everyone in the administration and Scott have eggs in their faces.

Claire McCaskill, one of the most politically vulnerable incumbents in the country, did not vote on her confirmation.

Barrett, a professor at the University of Notre Dame law school, excites conservatives for the very same reason liberals are wary of her: a possible battle over her Catholic faith and whether it would inform her decision-making on abortion and other social issues.

Larsen, 49, serves on the 6th U.S. Circuit Court of Appeals, having won Senate confirmation, 60-38, last year. Eight Democrats, including home-state Sens. Debbie Stabenow and Gary Peters of Michigan, voted to confirm her after an effort to stop her nomination from getting to a vote.

She previously clerked for Justice Antonin Scalia, the conservative icon who died in 2016, and worked as a lawyer in President George W. Bush's White House.
Like Grant, she doesn't have many decisions under her belt, and she won over more of the Senate than Barrett did.

The 60-year-old Sykes stands out for the fire she's drawn from some conservative activists for sentencing anti-abortion activists to jail and ruling against an Indiana law that defunded Planned Parenthood.

I2004, at a time before confirmation votes were such political footballs, Sykes won the support of 70 senators, including 21 Democrats, to serve on the 7th U.S. Circuit Court of Appeals. But only three of those Democratic senators are still serving: Maria Cantwell of Washington; Tom Carper of Delaware; and Senate Minority Leader Chuck Schumer of New York.

A man is accused of threatening to chop up U.S. Sen. Rand Paul and his family with an ax.

The man has been arrested. He allegedly called in the threats to Paul's Bowling Green office.

Paul mentioned the attack publicly at an event in Leitchfield, Kentucky, on Monday.

"Capitol Police have issued an arrest warrant for a man who threatened to kill me and chop up my family with an axe," Paul said. "It's just horrendous that we have to deal with things like this."

Capitol Police declined to comment because the investigation is ongoing."
