Explain this to me like I am a six year old

So everyone knew that Donald Trump paid hush money to Porn Star Stormy Daniels and that some deal was brokered to purchase a story regarding an alleged Trump affair with Playboy Bunny Karen McDougal. The only real recent revelation (at least to me) is that the deal to purchase the story rights to the whole Karen McDougal saga fell through.
(I had been under the assumption that that payment had also been made).

Both the Stormy Daniels and the Karen McDougal revelations surfaced about four days before the election. While Trump denied these affairs (and I believe he still does), I think most everyone believed that Trump had the affairs and that he was the one who ultimately paid the hush money. To most people the idea of having affairs with porn stars and playboy bunnies, and then paying hush money is an unseemly concept; but not necessarily unexpected when it comes to Donald Trump.

Bottom line and reality check: He was elected with full public knowledge of the allegations of both the affairs and hush money payoffs. 

So naturally it begs the question. What is it about the Cohen revelation that makes people demand that we suddenly should change our opinion about all of this? The Cohen revelations literally provide nothing new. The story hasn't changed (again, other than the second payoff never apparently happened).

The only thing that is changes is we now have some sort of argument over whether the behavior violated campaign laws, which are laws that 99 out of a 100 times would be considered a civil (not criminal) violation.

In fact, the Obama campaign violated those laws by accepting $1.3 million in donations from people who were over the limit, accepting foreign donations, not reporting the actual source of over $1.8 million in donations (that were $1000 or larger), and hedging donation dates on official documents for donations totaling $85 million. All in all, they were fined 375,000 dollars (or about double what Trump paid Stormy Daniels).

The reality here is that the actions of Donald Trump haven't changed. Our understanding of the events haven't really changed. The only thing that is changed is that some people would now like to describe it as criminal behavior. Of course, that description doesn't matter because the President isn't going to be indicted and he will not be removed from office over this.

So  explain it to my like I am a six year old: why should anyone change their mind about any of this?

WASHINGTON — The National Enquirer kept a safe containing documents on hush money payments and other damaging stories it killed as part of its cozy relationship with Donald Trump leading up to the 2016 presidential election, people familiar with the arrangement told The Associated Press.

The detail came as several media outlets reported on Thursday that federal prosecutors had granted immunity to National Enquirer chief David Pecker, potentially laying bare his efforts to protect his longtime friend Trump.
Trump's former lawyer Michael Cohen pleaded guilty this week to campaign finance violations alleging he, Trump and the tabloid were involved in buying the silence of a porn actress and a Playboy model who alleged affairs with Trump.

Several people familiar with the National Enquirer's parent company, American Media Inc., who spoke to the AP on the condition of anonymity because they signed non-disclosure agreements, said the safe was a great source of power for Pecker, the company's CEO.

The Trump records were stored alongside similar documents pertaining to other celebrities' catch-and-kill deals, in which exclusive rights to people's stories were bought with no intention of publishing to keep them out of the news. By keeping celebrities' embarrassing secrets, the company was able to ingratiate itself with them and ask for favors in return.
But after The Wall Street Journal initially published the first details of Playboy model Karen McDougal's catch-and-kill deal shortly before the 2016 election, those assets became a liability. Fearful that the documents might be used against American Media, Pecker and the company's chief content officer, Dylan Howard, removed them from the safe in the weeks before Trump's inauguration, according to one person directly familiar with the events.

It was unclear whether the documents were destroyed or simply were moved to a location known to fewer people.

American Media did not immediately respond to a request for comment.

Pecker's immunity deal was first reported Thursday by Vanity Fair and The Wall Street Journal, citing anonymous sources. Vanity Fair reported that Howard also was granted immunity.

Court papers in the Cohen case say Pecker "offered to help deal with negative stories about (Trump's) relationships with women by, among other things, assisting the campaign in identifying such stories so they could be purchased and their publication avoided."

The Journal reported Pecker shared with prosecutors details about payments that Cohen says Trump directed in the weeks and months before the election to buy the silence of McDougal and another woman alleging an affair, porn star Stormy Daniels. Daniels was paid $130,000, and McDougal was paid $150,000.

While Trump denies the affairs, his account of his knowledge of the payments has shifted. In April, Trump denied he knew anything about the Daniels payment. He told Fox News in an interview aired Thursday that he knew about payments "later on."

In July, Cohen released an audio tape in which he and Trump discussed plans to buy McDougal's story from the Enquirer. Such a purchase was necessary, they suggested, to prevent Trump from having to permanently rely on a tight relationship with the tabloid.

"You never know where that company — you never know what he's gonna be —" Cohen says.

"David gets hit by a truck," Trump says.

"Correct," Cohen replies. "So, I'm all over that."

While Pecker is cooperating with federal prosecutors now, American Media previously declined to participate in congressional inquiries.

Last March, in response to a letter from a group of House Democrats about the Daniels and McDougal payments, American Media general counsel Cameron Stracher declined to provide any documents, writing that the company was "exempt" from U.S. campaign finance laws because it is a news publisher and it was "confident" it had complied with all tax laws. He also rebuffed any suggestion that America Media Inc., or AMI, had leverage over the president because of its catch-and-kill practices.

"AMI states unequivocally that any suggestion that it would seek to 'extort' the President of the United States through the exercise of its editorial discretion is outrageous, offensive, and wholly without merit," Stracher wrote in a letter obtained by The Associated Press.

Former Enquirer employees who spoke to the AP said that negative stories about Trump were dead on arrival dating back more than a decade when he starred on NBC's reality show "The Apprentice."

In 2010, at Cohen's urging, the National Enquirer began promoting a potential Trump presidential candidacy, referring readers to a pro-Trump website Cohen helped create. With Cohen's involvement, the publication began questioning President Barack Obama's birthplace and American citizenship in print, an effort that Trump promoted for several years, former staffers said.

The Enquirer endorsed Trump for president in 2016, the first time it had ever officially backed a candidate. In the news pages, Trump's coverage was so favorable that the New Yorker magazine said the Enquirer embraced him "with sycophantic fervor."

Positive headlines for Trump, a Republican, were matched by negative stories about his opponents, including Hillary Clinton, a Democrat: An Enquirer front page from 2015 said "Hillary: 6 Months to Live" and accompanied the headline with a picture of an unsmiling Clinton with bags under her eyes.

A state investigation would center on how the company accounted for its reimbursement to Mr. Cohen for the $130,000 he paid to the actress, Stephanie Clifford, who has said she had an affair with President Trump, the officials said.

Both officials stressed that the office’s review of the matter is in its earliest stages and prosecutors have not yet made a decision on whether to proceed.

Cohen arranged for a friendly tabloid publisher to give McDougal a $150,000 contract for her story (not that it would publish it). Then, he set up a shell company to pay Daniels $130,000. The pressure was on. Daniels got her money less than two weeks before Election Day. Now even more disturbing is that the National Enquirer owner has a safe full of shit.

In court, Cohen said he did all of this at Trump's direction. He was later reimbursed and generously compensated by the Trump Organization.

2. What makes these payments illegal?

It's not complicated. The publisher's contract amounted to a corporate campaign contribution, but corporations cannot contribute to campaigns. Cohen's payment to Daniels amounts to a personal contribution from him to the campaign. But it was for $130,000; the legal limit is $2,700.

The case would revolve around how President Trump’s company accounted for reimbursing the disgraced lawyer for $130,000 he paid to Daniels in exchange for her silence in the lead-up to the 2016 presidential election, according to The New York Times.


The paper cited two anonymous sources describing the probe as being in “its earliest stages” and the district attorney, Cy Vance, has not yet signed off yet.
The Trump Organization logged the money as a legal expense, according to the Times, but Cohen pleaded guilty on Tuesday to making the payment to Daniels in exchange for her silence.

“On its face, it certainly would be problematic,” an official in-the-know told the Times.
The ledger entry could be just a misdemeanor, unless it can be proven that the false entry was made to cover up another crime. It that case the crime could rise to the level of a felony.
Cohen pleaded guilty on Tuesday to eight counts of tax evasion and campaign finance violations, stemming from the payments.
The difference between this probe and federal investigations is that the President does not have the power to pardon state level convictions.

Certainly hush money is paid by politicians all the time. Both Cohen and Pecker have been involved with these NDAs for multiple people, and they are not exactly the only players in town. Congress has a slush fund to pay off people who otherwise want to give up the goods on a variety of politicians. To deny that this happens, would be to deny that politicians are politicians, and ultimately deny reality.

The reality is that not one of them has ever been put in jail for campaign contribution violations. It's just another attempt to make a legal action by Donald Trump into a crime, because he is Donald Trump.

So you can continue to argue that it's a crime till your varicose veins explode. It will only further convince me that you are blinded by TDS.


The question is still the question.

Donald Trump had affairs and paid hush money.
It was known before the election.
People elected him in spite of that knowledge.

Federal prosecutors charged 26-year-old Winner last summer with violating the Espionage Act. Court documents show Winner used her security clearance to smuggle out a classified document that was later used as part of a story in The Intercept.

That story detailed Russian cyberattacks and spear-fishing attempts on elections officials ahead of the 2016 election.

The Intercept Editor-In-Chief Betsy Reed released a statement Thursday saying in part: "The information in The Intercept story on the NSA report played a crucial role in alerting local election officials who had been in the dark about the cyberattack — a public service that was implicitly acknowledged in a recent report from the Senate Intelligence Committee," and that Winner should be "honored, not punished."

In late June, Winner took a plea deal after spending more than a year in prison without bond.
