Committee votes through Kavanaugh

Apparently Flake votes "yes" but thinks there should be a "one week FBI investigation" into Kavanaugh's sexual harassment allegations.

Now the ball is squarely in McConnell's court. Obviously McConnell nor Flake have authority to order the FBI to do an investigation. They would require the White House to step in on that one.

What would be the point of a "one week investigation" by the FBI? What could the FBI do in one week that the Judicial committee "could not" do in several months?

The answer, of course, is to delay the vote for another week without providing anything new.

Meanwhile at least two Democrats (Manchin and Heitkamp) are wavering and said to be leaning towards a "yes" vote. A recent poll shows Manchin winning by 12 if he votes "for" Kavanaugh, but slightly behind if he votes "no". He's in a very tough spot.

Something tells me that a "compromise" is brewing with some of these undecided moderates. Let them say there was an FBI investigation (which would not conclude "anything" new) and then it provides them cover to vote "yes".

Will Trump and McConnell go for it, or will they call down the bet?

UPDATE: Perhaps Flake inadvertently did the GOP a favor here. Already there are Democrats coming out and rejecting the one week timeline as arbitrary and ineffectual. Of course a one week investigation is silly and will not accomplish anything. But neither would a one month investigation or any other investigation.

The committee had plenty of time to investigate. They choose not to.

By rejecting the Flake offer, it would seem politically that the Democrats won't take yes for an answer.

Perhaps the White House and McConnell would be smart to order it to start tomorrow and schedule the vote in eight days.

Great news is that the FBI should be able to get hold of those therapist notes the Democrats have been sitting on, look into why Ford or her council was lying about travel abilities and also root out the polygraph test. Hopefully her hotel room has two front doors while she waits there, hopefully safe from her lawyers. I suspect cocaine Mitch will get this process rolling quickly regardless.

A supplemental backround check is the only investigation the FBI can do. If you want a criminal investion the victim would have to file a criminal complaint.

However, they would have to use the law as it was in 1982. Then attempted sexual assult was a misdemeanor with a statue of limitations of one year.

so here's what happens next -

the FBI comes back with nothing, and the democrats figure out a way to charge kavanaugh with a crime in order to open a criminal investigation. maybe they get dr. cray cray to file the complaint or maybe they find some other mentally ill sap to do it, but either way that's where this very well could go. at that point we're into the full swing of the mid terms and the whole fucking thing just falls apart at that point, and perhaps even kavanaugh throws in the towel.

If The FBI Is Investigating These Allegations, They Absolutely Must Investigate Ford's Credibility

Questions that must be asked of Ford, and her lawyers, and Democrats -- under oath.

1. Democratic staffers, particularly those of Diane Feinstein, must be asked under oath and under penalty of felony if they leaked Ford's name and/or her letter to friendlies in the media.

2. Ford must be asked, under oath, which therapist notes she gave to the Washington Post. She was asked this yesterday, but suffered one of her notorious memory lapses and said she didn't know and would have to ask her lawyers. Which she then proceeded to not ask them.

3. Obviously, any time she claims she doesn't know and that only her lawyers would know, her lawyers must be asked under oath.

Her lawyers, by the way, cannot invoke lawyer-client privilege regarding notes they gave to a third party. Information given to a third party is not a confidential lawyer-client communication and not shielded by privilege.

There is no such thing as "Lawyer-Feinstein privilege," and Ford's political operators with legal licenses should not be permitted to invent one.

4. Her therapist's notes must be taken up by the FBI. Literally nobody in America believes that Ford and her husband were at a marriage counselor about a disagreement about adding a second door to the house.

What were they really in therapy for? People have been known to lie in therapy if it's needed to keep themselves out of trouble from their spouse.

5. Why did she lie when she claimed she could not fly? Did her lawyers tell her to say that? The parties can invoke privilege here, but their invocation of privilege -- refusing to answer questions in an investigation they demanded -- should be noted and publicized.

6. Did her lawyers inform her that Republicans had offered to fly to California or did they hide that from her? Or did they just tell her to lie about it?

7. All correspondence between her lawyers and Diane Feinstein and other Democrats must be submitted to the FBI. We suspect coordination, and if there's going to be an investigation, we want it all investigated.

8. Her personal polygraphologist must explain how he conducted the test, how long he took to prep her, etc.

And who paid him. And whether or not a certain result was expected.

9. And a big one -- how many other people has Ford accused of sexual harassment or assault? Perhaps this is her first and only time. If so, that adds to her credibility.

But if she has a history of making claims -- that detracts from it.

Were that the case, I would imagine they would have shot that arrow from their quiver.

So I assume, tentatively, that that arrow is not in their quiver.

I would like to know if she made other allegations, who she reported them to, and what the final disposition was in any investigations into any prior allegations.

Between the lines: Such a delay presents both peril and promise for Kavanaugh. On the one hand, it means investigators will likely talk to Mark Judge. On the other hand, if a probe doesn't turn up new evidence, it gives senators on the fence an easier time voting yes.

Chief Wray isn't going to limit the scope of the investigation despite what the President wants.

Chiefs? There are cheifs at the FBI now.

Director Wray has already stated they don't do criminal investigations beyond their normal jurisdiction and since this is an expanded backround check they will not go beyond their charge from the President.

It's becoming more apparent that Judge Cavanaugh had a serious problem with alcohol when he was younger. Extreme inebriation can cause people to act out in many ways that they normally would do. The description by his college roommate described him as frequently to the point where he was slurring and acting aggressively towards women.

That doesn't mean that he is an alcoholic. If he doesn't drink to excess anymore. But the actions of a highly intoxicated man can often result in aggressive sexual behavior. Especially when the man is young.

Doctors Ford's description of his aggressive sexual behavior sounded very credible.

What happens to the person when his or her blood alcohol level is very high? Are there personality or biological differences that emerge through very heavy drinking?

I would like to focus on the statement by the judge’s former roommate at Yale, James Roche. As quoted in the Huffington Post, Roche stated that the two of them would talk in evenings. “It is from this experience,” he said, “that I concluded that although Brett was normally reserved, he was a notably heavy drinker, even by the standards of the time, and that he became aggressive and belligerent when he was very drunk.”

As an expert on alcoholism, a former alcoholism counselor and co-author of Addiction Treatment (2018, Cengage Publishing Co.), I find this description very significant. There are certain drugs closely associated with violence—these are cocaine, meth, and alcohol. This statement by the Yale roommate gives us a clue toward understanding some of the contradictions expressed in the media concerning the judge’s ethics and character.

One of Kavanaugh’s supporters interviewed on CNN, seemed sincerely perplexed by Professor Ford’s accusation. She disclosed that as Kavanaugh’s colleague, she had seen him drink wine and beer and he had never gotten aggressive. This is probably true, because it would take a lot more than one or two drinks before one’s personality was altered in any way. It could be that the personality is not really altered, but instead that when inhibitions are lowered through intoxication, unconscious drives and feelings come to the surface and are revealed. These actions and emotions often shock friends and family members who have not seen this side of the person previously.

i used to work with a guy whose wife was being considered for employment with the FBI. he described the background check he went through, and it went all the way back to his youth on long island. people he hadn't talked to in fucking years were interviewed and the breadth and scope of the investigation was huge. and that was just on HIM as the spouse of a potential employee.

The FBI has been under attack by the President from day one. He is trying to limit the depth of the investigations into alleged sexual abuse.

If the report concludes that the charges against Judge Kavanaugh are valid the President will not accept the findings. And everyone of you will agree with the President.

If the report shows no evidence in either case that proves the case either direction we will be facing a historical event in either direction.

There are Senators who are facing elections from both parties who will have to decide. Given the circumstances surrounding this situation I suspect that the Coldheartedtruth about the women's vote in November will favor the Democrats so the one or two wavering Republicans will probably vote against the nomination of Brett Kavanaugh.

But given my history in projections who the hell knows.

The FBI has begun contacting people as part of an additional background investigation of Judge Brett M. Kavanaugh, including a second woman who alleges that the Supreme Court nominee sexually assaulted her, according to people familiar with the unfolding investigation.

The bureau has reached out to Deborah Ramirez, a Yale University classmate of Kavanaugh’s who alleges that he shoved his genitals in her face at a party where she had been drinking and become disoriented. It was not clear that agents had yet interviewed Ramirez. But the FBI is moving quickly to contact people as part of the new background investigation, which President Trump ordered on Friday under pressure from key members of his party.

The FBI director will not necessarily limit the scope of the investigation as the President wishes. He doesn't have the authority to intervene directly into investigations. If he tries to limit it we may face a Constitutional crisis. He can't use the FBI for his own political purposes but he probably doesn't understand that, or wants to expand his authority.

Liz Swisher, a former Yale classmate of Supreme Court nominee Brett Kavanaugh, told CNN that she believes he lied under oath when testifying about his drinking to the Senate Judiciary Committee this week.

The day after Christine Blasey Ford gave an emotional testimony, Republican Sen. Jeff Flake voted to advance Brett Kavanaugh's Supreme Court nomination. It came with a stipulation: that a full vote in the Senate be delayed until the FBI can investigate the sexual assault allegations against him.

"I tried to yell for help. When I did, Brett put his hand over my mouth to stop me from yelling," said Christine Blasey Ford in her testimony.

Since then, President Donald Trump has ordered the FBI to conduct a supplemental investigation to "update Judge Kavanaugh's file." A statement from the White House says, "As the Senate has requested, this update must be limited in scope and completed in less than one week."

Kavanaugh's childhood friend Mark Judge, who Ford says was in the room at the time of the incident, has agreed to cooperate with investigators.

In a letter to the Senate Judiciary Committee, Judge responded to additional claims from Julie Swetnick. She's accused Kavanaugh and Judge of "abusive" behavior toward women and of being present at a party where she was raped. Judge said in the letter he doesn't know Swetnick and denied her allegations.

The FBI is also looking into accusations made by at least one other woman — Deborah Ramirez, who says Kavanaugh exposed himself to her while drinking their freshman year of college. As far as Kavanaugh's role in the investigation, he says he "will continue to cooperate."

Instead of investigating Swetnick's claims, the White House counsel's office has given the FBI a list of witnesses THEY ARE PERMITTED to interview, according to several people who discussed the parameters on the condition of anonymity. They characterized the White House instructions as a SIGNIFICANT CONSTRAINT on the FBI investigation and caution that such a limited scope, while not unusual in normal circumstances, may make it difficult to pursue additional leads in a case in which a Supreme Court nominee has been accused of sexual assault.

The FBI works for the President. They are not an elected body that works for the people. The only way they could otherwise investigate this issue would be with the direct request of the DOJ or the President, and then only within the scope that they are entitle to. In this case a back ground check.

The FBI has no authority to otherwise just randomly investigate citizens of the United States over political causes. It wouldn't matter if 99.99% of the people wanted them to, they are still not allowed to.

The FBI has been asked to reopen a background check to gather more information on these alleged issues.

If anyone believes that they have authority to do anything else, then they have been seriously mislead.
