Offer and Counteroffers

This is what will happen (if something does happen)
  • There will be a hearing next Wednesday.
  • The hearing will have one camera (assume a shared feed to media).
  • The hearing will only include committee members.
  • Ford will testify first. Kavanaugh will testify second.
  • Neither will be present while the other testifies.
  • The GOP will use a woman attorney to do the questioning.
  • No other witnesses will appear.

To be clear, Grassley and the GOP will have the votes if Ford refuses to testify under these conditions. So for all practical purposes, it's put up or shut up, shit or get off the pot, speak now or forever hold your peace. 

I suspect that a woman attorney questioning Ford will not provide the "old white male" narrative that Ford was hoping for when they requested only a judiciary committee hearing. I suspect that a women attorney questioning Ford on the details of these allegations is more than a bit scary for Ford. Certainly Ed Whelan was not the only one researching her claims and finding all of the holes in her story. 

On the flip side, Kavanaugh has been through the ringer multiple times. There isn't going to be anything that Ford, Katz, and Seidman will uncover between now and then that the FBI and congressional investigators have not. They will more have their work cut our for them, prepping Ford for the inevitable questions about the inconsistencies that will not go unasked. 

I suspect if Kavanaugh defends himself forcefully and is believable that he will be confirmed. I have yet to run across any conservative I know who believes this should derail his confirmation.

Roughly 40 years ago, I showed up at a prominent music executive’s office for an appointment that had been scheduled suspiciously late in the workday. But I wasn’t suspicious. I was instead eager to try to place some of my original songs with artists he represented. One of my songs had appeared on the Eagles album “One of These Nights,” and I was hoping to turn songwriting into a career.

I brought along a cassette tape of my material, but I don’t remember what the executive said about the songs. Nor do I recall what we talked about. I remember the sky turning dark outside the window behind his desk. I remember sensing that people had left the building and we were there alone. I remember his face, his hair and what he was wearing. When he pulled a vial of cocaine out of his desk drawer and started chopping up lines on a small mirror, I’m 90 percent sure I declined his offer to do some with him, not because I didn’t do drugs — I definitely did in those years — but because I was starting to feel uncomfortable. My memory of the discomfort is sharp and clear, but my memory of declining the coke is, as I said, about 90 percent.
What happened next, though, is indelible. He crossed the room. There was a dark-green carpet, but his footsteps seemed loud, hard. He was against me, on top of me — so quickly — with his hands under my skirt and his mouth on mine, that I froze. I lay there as he pushed himself inside me. The leather couch stuck to my skin, made noises beneath me. His breath smelled like coffee and stale bread. He didn’t use a condom. I remember leaving afterward, driving home, the night around me glittered with streetlights and alive with people out at dinner or bars. I felt alone, ashamed and disgusted with myself. Why didn’t I get out of there? Why didn’t I push him off? Why did I freeze?

I don’t remember what month it was. I don’t remember whether his assistant was still there when I arrived. I don’t remember whether we said anything to each other when I left his office.

I never told anyone for decades — not a friend, not a boyfriend, not a therapist, not my husband when I got married years later.

It doesn’t surprise me one bit that for more than 30 years, Christine Blasey Ford didn’t talk about the assault she remembers, the one she accuses Supreme Court nominee Brett M. Kavanaugh of committing.

It’s important to understand how memory works in a traumatic event. Ford has been criticized for the things she doesn’t remember, like the address where she says the assault happened, or the time of year, or whose house it was. But her memory of the attack itself is vivid and detailed. His hand over her mouth, another young man piling on, her fear that maybe she’d die there, unable to breathe. That’s what happens: Your memory snaps photos of the details that will haunt you forever, that will change your life and live under your skin. It blacks out other parts of the story that really don’t matter much.
Ford wants the FBI to investigate so that some of the details she doesn’t remember can be established. It’s a brave request. Perhaps the aging men who are poised to interrogate her, unless they hide behind surrogates, should pause for a moment and think about the courage it takes for a woman to say: Here is my memory. It has haunted me for decades. It changed my life. You need to know about it now because of what is at stake for this country.

Requesting an investigation into the incident isn’t a big ask. Unless they just want her to go away. Which is, by the way, one reason that women are scared to speak up.

Roger - guilty of what?

The fact of the matter is that Judge Kavanaugh has conducted himself as a straight shooter, a devoted family man, a devout Christian, a man everyone in his field (liberal and conservative) respects, and a widely respected Judge.

He has earned his place (based on his lifelong behavior) on the short list of possible nominees for the USSC for both Mitt Romney and Donald Trump based on how he has conducted himself every since entering the professional field he is currently in.

It doesn't matter that he is "conservative". It matters that he is universally respected in his field.

Moreover, while there have been over 70 women and several men who knew Kavanaugh during his high school days who flat out say they do not believe the allegations, there hasn't been one women who claims to know the two of them who is siding with Ford. Her support comes "entirely" from people who don't know Kavanaugh and largely from people who don't even know Ford.


So the bottom line here Roger is simple. There is no amount of testimony that will prove to me conclusively that she is accurately remembering what happened 36 years ago, and I believe there is a fairly decent chance that she is being less than honest. Perhaps if she did not hire Katz and Seidman to guide her through it, I wouldn't have the nasty feeling that it's all about politics.

On the flip side, nobody has given me "any" reason to believe that Kavanaugh is someone who would have done it, or would be lying about it today.

Grassley has scheduled a vote for Monday.

He gave them a deadline of 10:00 EST to agree to their terms.

Even if she is refusing to fly (any guesses as to how long it takes for someone to show that she has been on planes before) - it's about a forty to forty five hour drive from Palo Alto to Washington D.C.

She could have left today and gotten there by Tuesday without any real problem. She could take a train and get there on Tuesday. She could take a bus and be in Washington DC on Monday.

Or she could put on some big girl panties and get on a plane like other adults.

You have been trying to discredit Doctor Ford because she didn't report anything to her parents or authorities when it happened, so you can't believe what she says about the assault because Cavanaugh is a conservative.

Today I had an appointment with my liver transplant doctor. He is just amazed at how well I am doing.

Friday afternoon’s Rod Rosenstein bombshell brought with it a familiar anxiety inside the Trump administration, as aides waited to see just how volcanic the president’s reaction would be to the latest story about backstabbing within his top ranks.

Current and former administration officials said they fully expected President Trump to dismiss staff inside the Justice Department following reports that Rosenstein had contemplated—sarcastically, his defenders say—the idea of wiretapping the president or removing him from office via the 25th Amendment. Less clear was how many people will get the ax and when, exactly, it will fall.

“Trump is gonna go on a jihad,” one former senior White House official told The Daily Beast. The official speculated that Rosenstein’s comments were leaked with just that reaction in mind. “The NYT op-ed gave an opportunity to really drive home the deep state stuff. With this new story, it gives additional credibility.”


The stakes of the latest administration imbroglio could not be higher, as Rosenstein heads the Special Counsel investigation into Russian interference in the 2016 election. His position atop that probe has made him a regular target of Trump supporters, and a new round of calls for his dismissal came quickly after the Times story posted Friday afternoon.

Pennsylvania Trending Solid Blue

A new Morning Call/Muhlenberg College poll in Pennsylvania finds Sen. Bob Casey (D) crushing challenger Lou Barletta (R), 53% to 35%.

In the governor’s race, Gov. Tom Wolf (D) leads challenger Scott Wagner (R) by a similar margin, 55% to 36%.

In the generic congressional ballot, Democrats lead Republicans in the state by double digits, 50% to 39%.
