President Trump plans to sign an executive order that would remove the right to citizenship for babies of non-citizens and unauthorized immigrants born on U.S. soil, he said yesterday in an exclusive interview for "Axios on HBO," a new four-part documentary news series debuting on HBO this Sunday at 6:30 p.m. ET/PT.

Why it matters: This would be the most dramatic move yet in Trump's hardline immigration campaign, this time targeting "anchor babies" and "chain migration." And it will set off another stand-off with the courts, as Trump’s power to do this through executive action is debatable to say the least.

Trump told "Axios on HBO" that he has run the idea of ending birthright citizenship by his counsel and plans to proceed with the highly controversial move, which certainly will face legal challenges.

"It was always told to me that you needed a constitutional amendment. Guess what? You don't," Trump said, declaring he can do it by executive order.
When told says that's very much in dispute, Trump replied: "You can definitely do it with an Act of Congress. But now they're saying I can do it just with an executive order."
"We're the only country in the world where a person comes in and has a baby, and the baby is essentially a citizen of the United States ... with all of those benefits," Trump continued. "It's ridiculous. It's ridiculous. And it has to end."
"It's in the process. It'll happen ... with an executive order."
The president expressed surprise that "Axios on HBO" knew about his secret plan: "I didn't think anybody knew that but me. I thought I was the only one. "

Behind the scenes: "Axios on HBO" had been working for weeks on a story on Trump’s plans for birthright citizenship, based on conversations with several sources, including one close to the White House Counsel’s office.
The legal challenges would force the courts to decide on a constitutional debate over the 14th Amendment, which says:

"All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside."

We've been over this before. The argument is going to be overmeaning of the "subject to the jurisdiction thereof" clause.

For example; A child born to diplomats attached to a foreign mission are not US citizens even though they were born in a US hospital.

One can make the argument that if you enter the country illegally, you are not subjecting yourself to US jurisdiction and therefore a child born to you would not be a citizen.

I'm sure that the case will go to the Supreme Court and given the current make up of the Court I'm pretty sure they will kick it to Congress to clarify the meaning of the jurisdiction clause.

But it will be fun to watch the notorious RGB deliver a strict constructionist opinion in her dissent.

McCain was born on US territory to US parents. In this case the Canal Zone was subject to US jurisdiction. So your argument is irrelevent.

As the President stated, Congress can write a law.

If the previous President had allowed Congress to write the laws, then this President wouldn't be writing executive actions to counter previous executive actions.

As much as anything else, Trump was elected to undo whatever Obama did by executive action. It's neither wrong, unconstitutional, unethical, or unexpected that Trump would continue to undo Obama's attempts to write laws by executive fiat.

I hope he continues to undo everything Obama did via executive action.

Now they can clearly see that an executive action is not a law and can be undone at anytime by the next President.

A law requires a repeal, which is a whole other can of worms.

Well since there was never a successful challenge to McCain's candidacy on the issue and he was on the ballot in all 50 states then it was resolved.

An opinion from an obscure law professor is just that an opinion and a very bad opinion at that. I don't think I would ever want a lawyer he trained.

This will give liberals some comfort. The case law is generally against Trump argument for a broader interpretation of the Jurisdiction clause of the 14th amendment. Case law narrowly defined it to ambassadors and other persons with diplomatic immunity.
