Since the announcement regarding Sessions departure, Whitaker has been criticized by many on the left for holding the liberally unpopular general viewpoint that a Special Counsel should actually be constrained by the limits set forth within the Special Counsel law. By all accounts, he has been specifically critical of the perception that the ever-expanding investigative reach of Special Counsel Robert Mueller is somehow warranted. To be clear, it's not.

Now you have and will continue to hear the burning questions from the left as to who is going to "protect" the Robert Mueller investigation. But what, exactly, does he need protection from? Well, that is actually quite simple. The left would like him protected from the guidelines set forth by the laws of Special Counsel. These are guidelines that if followed would actually limit his probe, and require that it stay within the scope that was set forth by Rosenstein when he ordered it, unless specific new orders are provided.
As it stands, Robert Mueller has had pretty much free reign. Rosenstein is controlling Mueller in much the same way a 10 year old girl might control a 150 sled dog during an afternoon walk. Special Counsel attorneys have admitted in court documents and court statements that they are not necessarily following Special Counsel or Department of Justice guidelines. But they have continued to argue that not following guidelines is not technically breaking the law, and that not following guidelines does not protect those people (such as Paul Manafort) who have found themselves in the cross hairs.
I suspect that will change moving forward, and anyone who is willing to be intellectually honest would have to admit that it "should" change.
There are lots of questions to be answered if there is a change of who is supervising Mueller. Will Whitaker allow Mueller to continue his existing investigations into people like Roger Stone without oversight, will he allow them to continue with limitations, or will he shut them down completely. Will he allow Mueller to expand into any new areas, or will he demand that Mueller start winding things down. What sort of report will he seek from Mueller. Who will see the report. Will he allow Mueller to talk about it. Will he actually look into the relationship between Rosenstein and Mueller and determine which guidelines are being followed, which are being ignored, and if any actions might be necessary if rules (or laws) have been broken. Will Whitaker start turning over information to Congress that has been subpoenaed and stonewalled by Rosenstein and others?
The truth is that Mueller has gone pretty much rogue, without any real resistance from anyone within the DOJ, and with the tacit consent of Rosenstein himself. Whether you believe this was all done with good or bad intentions, there is a growing consensus that it will be coming to an abrupt end.

George Conway, husband of White House counselor Kellyanne Conway, has co-authored an op-ed calling President Trump's move to replace ex-Attorney General Jeff Sessions "unconstitutional."
The piece, published Thursday in the New York Times, asserts that Trump's decision to appoint Matthew Whitaker as acting attorney general is in violation of the Appointments Clause of the Constitution, which stipulates that principal officers must be confirmed by the Senate.
"President Trump's installation of Matthew Whitaker as acting attorney general of the United States after forcing the resignation of Jeff Sessions is unconstitutional," wrote Conway, along with lawyer Neal Katyal. "It's illegal. And it means that anything Mr. Whitaker does, or tries to do, in that position is invalid."
Trump announced Wednesday that Whitaker, Sessions's chief of staff, would take over for the attorney general. Sessions submitted a letter of resignation Wednesday at Trump's request.

The bipartisan Mueller protection legislation cleared the Senate Judiciary Committee in April but has seen no floor action amid public skepticism from Majority Leader Mitch McConnell (R-Ky.) that Mueller’s Russia investigation faces any legitimate threat from President Donald Trump.

Following Trump’s Wednesday ousting of Attorney General Jeff Sessions and appointment of acting Attorney General Matthew Whitaker — who has publicly criticized the Mueller probe — Flake tweeted, “it is more important than ever to protect the Special Counsel.”
Flake and Coons’ plan to seek unanimous agreement for the Senate to vote on the bill, however, is still likely to draw an objection from the GOP side of the aisle.
McConnell told a radio station in his home state on Thursday that “I don’t think there’s any chance that the Mueller investigation will not be allowed to finish” in light of Sessions’ departure from the Department of Justice.
Democrats are all but guaranteed to support next week’s bipartisan push for action on the Mueller protection bill, which was the product of months-long talks to combine two different versions of the legislation.
