Attorney General William Barr would prevent allegations of obstruction

Barr, whom President Trump has nominated to be the next attorney general, was not prejudging the facts. He was addressing the law and Justice Department policy. With great persuasive force, the 19-page memo posits two contentions. First, based on what is publicly known, the special counsel’s theory of obstruction is legally flawed. Second, if a Justice Department investigation is going to be used to take down a democratically elected president, the social cohesion of our body politic demands that it be over a clear, very serious crime, not a novel and aggressive theory of prosecution
As Barr elaborates, if a president may be prosecuted for obstruction based on carrying out the executive’s constitutional prerogatives — exercises of prosecutorial discretion, giving direction to the course of an investigation, making personnel and management decisions — then every other official in the Justice Department is similarly vulnerable. The apprehension that proper and necessary acts could be construed as improperly motivated, and therefore as actionable obstruction, would profoundly undermine the administration of justice.

So these are very "lucid" points that will no doubt create the excuse that the Democrats needed to oppose and attempt to obstruct the confirmation of William Barr. This may not be as politically easy as it might appear, given all of the previous support shown for Barr from the left.

The problem is that finding "any" solid choice for Attorney General who does not agree with the basic concepts provided by Barr is slim to none. Again, nothing Barr states is not 100% true, and nothing he states is controversial at all. The only problem for Barr is he is on record for his beliefs. Others would not be.

Short sightedness aside, the legal actions of people in power (especially those we elected) cannot be criminalized based on some newfound liberal justice concept that crimes are no longer defined by the action, but by the intent. More to the point, when one person's political intent becomes another persons version of criminal activity, then we no longer have a real system of justice. We have a system where political disagreement are settled by law enforcement and courts, rather than where they are supposed to be (elections).

A holiday government shutdown appeared more likely on Thursday after President Donald Trump informed House Republicans he would refuse to accept a stop-gap measure -- already passed by the Senate -- that doesn't include funds for his long-promised border wall.

What was once a deal to avoid a Christmas partial shutdown was torpedoed Thursday by conservatives and Trump, who unleashed fury at another agreement that stops short of providing the $5 billion the President has demanded for the border.

It was a closing burst of wrath in the final days of the Republican-majority House. If Trump cannot secure the money he is demanding for the wall now, it's unlikely he will see a spending bill that meets his requirement for at least two years as Democrats assume control.

Two days before Gustavo Garcia's "reign of terror" through Tulare County, he was arrested by Tulare County sheriff's deputies for being under the influence of a controlled substance.

Deputies held Garcia at the Tulare County jail for 10 hours before releasing him back to the public, according to Tulare County Sheriff Mike Boudreaux.

Less than 48 hours later, Garcia would go on a rampage through Tulare County that left three dead, including Garcia, and at least seven hospitalized. He's accused of racking up a dozen crimes in 24 hours.

ICE agents issued an immigration hold against Garcia on Friday, following his arrest. The hold was not honored, however, and Garcia was released later that day, unbeknownst to ICE.

"This is an unfortunate and extremely tragic example of how public safety is impacted with laws or policies limiting local law enforcement agencies’ ability to cooperate with ICE," the federal agency said in a statement.

Boudreaux agreed with ICE agents.

"The Tulare County Sheriff’s Office is equally as frustrated with this situation," Boudreaux said. "Because of California law, detainers can no longer be recognized by local law enforcement."

The law that Boudreaux and ICE refer to is SB 54, otherwise known as the "Sanctuary State Bill."

Under SB 54, local law enforcement cannot communicate with ICE or other immigration officials without a warrant signed by a federal judge, except in the case of specific felonies.

"Before SB 54, Gustavo Garcia would have been turned over to ICE officials. That’s how we’ve always done it, day in and day out," Boudreaux said. "After SB 54, we no longer have the power to do that. Under the new state law, we must have a 'federally signed warrant' in order to do that. We didn’t honor the detainer because state law doesn’t allow us to.

A federal judge hadn't signed Garcia's hold. ICE has issued 200 detainers in Tulare County in the past year, only 50 have been honored, Boudreaux said.

"This is an eye-opener," he said, speaking to state officials.

Ralph Peters, a retired U.S. Army officer, said he told Fox at the beginning of the month that he did not want his contributor contract renewed.

“Over my decade at Fox, I was long proud of the association,” Peters wrote in an email that was distributed to colleagues at Fox News, and first reported by BuzzFeed News. “Now I am ashamed.”


Fox said in a statement that the network did not want attributed to a specific spokesperson that Peters was entitled to his opinion, “despite the fact that he’s choosing to use it as a weapon in order to get attention.” Fox said it was proud of its opinion programming and prime-time hosts.

Peters said he believed Fox had “degenerated from providing a legitimate and much-needed outlet for conservative voices to a mere propaganda machine for a destructive and ethically ruinous administration.”

Meanwhile, congressional Republicans, utterly neutered by Trump the past two years, were suddenly apoplectic over his decision to give the keys to Syria to Russia and Iran and walk away. Whatever the merits of being involved in Syria, Trump’s penchant for ignoring his advisers and congressional allies and doing whatever the F he wants was finally too much. Sen. Lindsey Graham, perhaps his staunchest ally in the Senate, said Trump’s actions were “Obama-like”—perhaps the gravest insult possible in Republican land. (We, on the other hand, would be thrilled with that compliment!)

Meanwhile, attempts to pass a continuing resolution that would avert a partial government shutdown are being challenged by the nihilistic Freedom Caucus, which now has Trump all riled up. Which is the honerable thing to do when there is a serious diffrence in policy. In the end, Mattis couldn't answer the question "What is a win in Syria?" As an intelligence officer said, there are no "good guys" in the Syrian civil war and right now Russia is backing the winning horse.

If you are not ready to go "all in" then what are we there for? Another open ended commitment of American troops to fight and die for what exactly?

If anything Syria and Afghanistan proves out HW Bush's strategy for the first Gulf War. Define clear objectives, go in with overwhelming force, win and get out.

The entire military has been trying to convince the President that his personal views have no foundation in the consequences of his actions. He will NOT listen to anyone who dares to differ with him. The White House is in total chaos. As is our foreign policy affairs.

He's dismantling the alliances that have kept the Russians from imposing dictatorial regimes in the Ukraine and other countries. It's not a simple just declare victory and withdraw.

You sharply criticized Obama when the withdrew our forces from Iraq. Now you are standing by and cheering on the President who is forming alliances with Putin and the Chinese.

One-party autocracy certainly has its drawbacks. But when it is led by a reasonably enlightened group of people, as China is today, it can also have great advantages. That one party can just impose the politically difficult but critically important policies needed to move a society forward in the 21st century. It is not an accident that China is committed to overtaking us in electric cars, solar power, energy efficiency, batteries, nuclear power and wind power. China’s leaders understand that in a world of exploding populations and rising emerging-market middle classes, demand for clean power and energy efficiency is going to soar. Beijing wants to make sure that it owns that industry and is ordering the policies to do that, including boosting gasoline prices, from the top down.
