I will explain why:
They refuse to acknowledge that another argument exists.
This absolute refusal to acknowledge another side is the most extreme and most damning level of cognitive dissonance and bias confirmation that can take place.
It's one thing to acknowledge counter-arguments, take issue with the points involved, debate those points in an intelligent manner, and be able to establish in a logical manner why those counter-arguments are wrong.
But that isn't what is taking place here.
What is taking place is a complete refusal to accept other arguments, and a complete absolute dependency on the argument that they want to believe. This can be seen by the constant use of the Cohen plea as the absolute and only argument that matters. It is quite literally the "only" argument that they fall back on,
But of course it's not the only argument. It's simply the only argument that their cognitive dissonance and bias confirmation allows them to believe matters.
The reality is that there is a major disagreement here. The Federal Elections Commission for one has taken a stance that the NDA is not a campaign expense and therefore a refusal to report the use of the NDA not a criminal action.
The idea that the findings and legal determinations of the Federal agency responsible for overseeing campaign finance laws is irrelevant to this debate is laughable. Again, such an refusal to accept the FEC as a valid entity in this situation is little more than absolute proof that your belief is 100% guided by cognitive dissonance and bias confirmation.
Let's dispense of the back and forth between a variety of legal experts (with the acknowledgement that most agree with the FEC, rather than the prosecutors) - because in most ways it is just an extension of the two arguments.
So to be fair. For me (or anyone else) to suggest that they are attempting to remove the idea of cognitive dissonance and bias confirmation from their brain, you must at the very least acknowledge the argument being made by the other side.
I acknowledge it and I declare it weak for several reasons:
- Nobody has ever been convicted of this sort of crime in the past. The only person who was charged was aquitted. If this case was so solid, then John Edwards would have been found guilty. You are literally arguing that our history of campaign laws (and a jury) was wrong.
- Moreover, there were incriminating circumstances in the Edwards case that do not exist today. Those payoffs went into seven figures, and it was unlikely that Edwards could have paid for this out of his own pocket. Edwards arguably used his position as Presidential candidate to attract donors to pay for something that benefited him personally. While I appreciate that this seems unethical, it was technically found to be not "illegal" and he was ultimately acquitted.
- Trump on the other hand could easily pay for these NDAs. He didn't require the use of donors or any campaign money to pay for it. He ultimately reimbursed Cohen for the payments. As long as that money did not come from his campaign, then he committed no crime.
- Dozens of politicians have paid out 17 million dollars for settlements that included NDAs. Again, not a single one of them was charged with a crime, in spite of executing the very same actions. If what Trump did was illegal, then so was the actions of these congressmen.
- Lastly, there is literally no reason why the FEC would have reason to play politics with this situation. In fact, their conclusions regarding NDAs far precedes the situation with Trump. On the flip side, there is every reason why an aggressive prosecutor would want to add more charges to a plea, especially if those charges can in any way implicate someone of prominence. It makes them look important.
- One of the two is wrong. Either the independent Government agency (responsible for overseeing campaign finance laws) that made this determination long before Trump was in the picture, or SDNY prosecutor (with no formal affiliation with overseeing campaign finance laws) who has every reason to "trump" up charges on someone who is attempting to avoid jail time. There is literally no logical reason to believe that the former is wrong, and the latter is correct.
I have yet to see anyone come up with a logical and reasonable argument as to why Edwards, dozens of members of congress, and lord knows who else in politics might have paid hush money have not been convicted of crimes for their actions, if said actions were indeed a crime. Of course, it you are wondering why you have seen no such argument (other than it doesn't really exist), cognitive dissonance and bias confirmation is the simple and correct answer.
Btw... if your response to this post is to cut and paste documents from the prosecution, regurgitate the Cohen plea, or simply call me a name... then you are proving yourself to be under the direct and absolute influence of cognitive dissonance and bias confirmation.
If you want to prove me wrong. Accept that the argument of the Federal Elections Commission exists and is relevant. Then explain why their reasoning is wrong.

Manhattan-based federal prosecutors are investigating whether some of the $107 million in donations to then-President elect Donald Trump’s inaugural committee were misspent, The Wall Street Journal reports.

WASHINGTON (The Borowitz Report)—In what they believe is a legal masterstroke, lawyers for Donald J. Trump are now claiming that he cannot be impeached because he was never actually elected.
In a lengthy memo sent to the special counsel, Robert Mueller, the lawyers pushed back vehemently against any allegation that Trump was legally elected President.
“Because Russian interference made the election of Donald J. Trump wholly illegitimate, any attempt to remove him from an office that he does not legally hold is clearly impossible,” the memo asserted.
The memo claimed that the Constitution contains “no provision for removing a person from office when that person was installed there by a foreign power.”
The memo went on to argue that, if a subpoena is sent to the White House, it will be returned to Mueller and stamped “addressee unknown.”
“A person referred to in a subpoena as ‘President’ Donald J. Trump simply does not exist,” the memo claimed.
Minutes after the memo was leaked, the former New York mayor Rudolph Giuliani appeared on “Fox & Friends” and proudly announced that he was its author.

McDougal, a former Playboy Playmate, and her lawyers have said that the National Enquirer paid her $150,000 in August 2016 as part of a "catch-and-kill" strategy to keep the story from circulating publicly.

When Cohen pleaded guilty to arranging the payments in August, he said he had done so "at the direction" of an unnamed candidate, and that a $150,000 payment prior to the 2016 election was "for the principal purpose of influencing" the election. The meeting between Cohen, Pecker and unnamed other parties to discuss suppressing stories was referenced in the criminal information document to which Cohen pleaded guilty. The document also refers to "at least one other member of the campaign" being present.
The statement of admitted facts says that AMI's "principal purpose in making the payment was to suppress the woman's story so as to prevent it from influencing the election." Rudy Giuliani, a lawyer for the president, has said the payments were made to spare Trump's family from shame.

At the Nashville airport I walked out into the concourse to this scene @americanairlines was flying a plane full of children who had lost a parent in combat to Disneyworld on an all expenses paid trip and they threw a party for them at the gate❤️But when they announced them over the loud speaker and they lined up to board the plane the whole airport literally stopped and sang the national anthem with military present in salute. Most every person standing around, myself included was bawling at the sight of these kids and spouses who have paid so great a price for our country. To see all of this at Christmas time was so humbling. Ninth Circuit Court Rules Border Wall Must Be 'Short Enough That A Pregnant Woman Carrying A Child In Each Arm Could Be Expected To Scale It Without Difficulty'
SAN FRANCISCO, CA—Amid heated debate in Washington over President Trump's border wall, the Ninth Circuit Court of Appeals has weighed in, ruling that construction on the U.S.-Mexico border wall can proceed, so long as it is "short enough that a pregnant woman carrying a child in each arm could be expected to scale it without difficulty."
While that definition may seem vague to some, the Ninth Circuit's judges further clarified in their decision that "two or three feet high ought to suffice." Contractors working on the wall have been ordered to have a pregnant woman and several children on hand. Each family will be asked to stress-test climbing over the wall every ten feet to ensure all portions of the barrier are equally easy to scale. Should the sample woman have to exert herself too much, construction workers will have to lower that part of the wall.
"We are in full support of President Trump's right to secure our nation's borders, so long as his actions do not cause undue burden on those trying to get into our country illegally," the court wrote in its decision.
The Court further assured Americans that is decision is in keeping with the Constitution, claiming that they googled "What is the Constitution?" and "Constitutional Law for Dummies" several times during deliberations.

Indicting Trump on campaign finance charges is a Democratic revenge fantasy.
Because Democrats want to see Trump impeached or even jailed, the question is whether he can be successfully prosecuted for the payments after leaving office.
The law, and common sense, suggest the answer is “no.”
The idea that Trump is going to lose reelection in November 2020 and then, having suffered the humiliation of getting booted by the voters, get indicted and stand trial on a dubious campaign-finance violation dating from 2016 is fantastical. This would be a banana-republic move, and is more a Democratic revenge fantasy — or should be — than a realistic scenario.
There are major legal obstacles to Trump’s prosecution. One is whether he had the requisite intent of violating the law, and here the standard is very high.
The other question is are payments to a porn star and a playboy model really the issue Democrats want to die on the impeachment hill for?
Given the current facts, there is not one GOP congressman that will cross the aisle and vote for impeachment and it's highly unlikely Democrats from GOP districts they poached would vote for it either.
So if it does pass, it will pass on a very narrow partisan vote only to die a quick death in the senate trial.

You simply continue to refuse to acknowledge that FEC ruling, the previous acquittal, and all legal history refutes the claim.
You have done nothing to show that the FEC is incorrect.
Because you still refuse to acknowledge it.
And no Rog... someone else's opinion doesn't count as evidence that the FEC is wrong.
You need to read the law yourself, accept the FEC explanation as they have determined it, and show us how their explanation does not validate with the law.
