Trump to sign bill and declare National Emergency

Well all the media huffing and puffing (aka fake news stories) about how Republicans would join Democrats in decrying a national emergency was just that, huffing and puffing. Not only will the President likely declare a national emergency, but he will do so with the support of many GOP leaders, including Mitch McConnell.

So the idea that Congress (as WaPo, Politico, and NYT contended) would offer up a scathing rebuttal in the form of some sort of overwhelming bipartisan Congressional rebuke is sort of out the window. No doubt Democrats in the House will likely put together some sort of official House denouncement, but it probably will not have the widespread support that some on the left were hoping for.

That being said, many conservatives are not happy with the idea of Trump attempting to garner wall funding with the use of executive action, due to the fact that they believe it creates the wrong precedent. They are afraid that if he ultimately succeeds in pushing this through that it opens the door for future Democratic Presidents to use a similar action to declare a politically charged issue (like global warming) as a national emergency, and then spend trillions.

There are a couple of logical problems with this suggestion:

The most obvious is that national emergencies are unfunded declarations. Most of these declarations spend little or no money. They are policies that do things like restrict international trade with countries, restrict private business with certain entities, seize property, or block entrance into the United States for foreign nationals from hostile nations.

Even with the declaration of a national emergency, Presidents still have no authority to simply add money to the budget.

The statutory language allows for a President to find and use only otherwise unobligated funds. This only would allow the President to move money out of projects that are currently overfunded (such as a national disaster fund that is no longer necessary), or take it from budget areas that allow for non-specific funding (such as certain military construction money that has no specific purpose). In the grand scheme of things there is simply not a lot of cash to be found in this manner. Expert opinions vary, but most suggest that there is only a few billion dollars that could be reasonably allocated for this sort of purpose. While that would certainly accomplish the goals in this situation, it would certainly not allow for any sort of project that would require massive amounts of money (such as funding the Green New Deal).

Secondly, there is actually nothing that would prevent a Democratic President from striking first in this situation. Even if Trump decides against the national emergency, there is nothing to prevent the next President, or the next President after that, or the next President after that from declaring a national emergency over something like global warming.

Of course, this sort of declaration would likely go through the same legal battle that Trump will go through if/when he declares his emergency. While Congress put some very specific limits on what a President can do with a national emergency declaration, it did not provide much input on what sort of situations would fall under the umbrella of a national emergency.

In my humble opinion, the current makeup of the USSC would likely allow Trump to prevail with his national emergency under the logic that Congress did not distinguish what creates a national emergency, and because border security is something that specifically falls under the reign of the executive branch.

However, I think that the current USSC would have a much harder time favoring a declaration of national emergency that attempted to rebuild our economy and business make up because of global warming. In that case, the courts may fall back on the constitutional separation of powers to declare that such an emergency would require not just a declaration from the executive branch, but also specific funding from Congress. Not only because there would not be enough unobligated money to fund such an overhaul, but also because something like the Green New Deal seems to clearly fall under the authority of Congress (not the executive branch).

However, I think that the current USSC would have a much harder time favoring a declaration of national emergency that attempted to rebuild our economy and business make up because of global warming. Appears to me that you are arguing with the entire concept of the National Emergency laws.

I didn't write them. Trump didn't write them. Roberts didn't write them. They are words on a piece of paper. But you appear to be very very angry with those words.

We'll see what happens in court, Roger.

But the Justices on the USSC are obligated to follow the law (even if they don't like the law). Should the law be more specific about what sort of things a President could use this for? Probably, but nearly everyone familiar with the law suggests that there is only vague definitions with deference given to the President.


But you certainly misunderstand the separation of powers argument.

When it comes to things like national security (including border security) the executive branch has the bulk of those responsibilities.

But even to that degree, Congress holds the purse strings.

But in a perfect constitutional reality, the legislative branch would provide funding without micromanaging the specifics. They are not responsible for making many of those decisions.

On the flip side, as I suggested, the separation of powers limits what a President can spend on any national emergency declaration. This is the main difference between this President looking for a few billion to finish a border wall (which is locatable), and another President looking for a few trillion to overhaul a large portion of our economy.

Sometimes, Roger... the facts are not on the same side as you would like them to be. You seem to want to take this out on whoever points this out as if they are responsible for them.

Yes Roger...

The constitution is clear that Congress holds the purse.

But Congress wrote a law that allows a President to move around some funding in the case of a national emergency. That law doesn't allow the President to add money to the budget or otherwise fund anything on his own.

THE LAW only allows a President to move around funding in the case of a national emergency. But it does allow this, because Congress recognizes that there will be times when money going to a particular project is going to BECOME less important than money that the President might deem is better served addressing something urgent.

There is nothing wrong with this law as a matter of concept.

Moreover, the President is attempting to use the law "exactly" as intended.

The argument Roger (and the only argument that matters) is whether or not the President "should" be using a national emergency for this particular situation.

Whether or not the President "should" do something is an entirely different argument as to whether or not a President "can" do something.

The courts will be asked to weigh in on this issue. It's clear that many people would like them to weigh in on the former (which is not their place). But the reality is that the court are constitutionally limited to the second question.

I suspect that lower courts will overstep on this one (like they generally do) and block the move on the basis that the President's reasoning is flawed. I suspect some sort of 5-4 decision by the USSC that will likely uphold the order (not because of it being good or bad but) because the Constitution puts border security under the Executive branch, and the law allows Presidential discretion to make this determination.

(This is my objective opinion of what the court will do based on the law and the constitution - rather than my subjective opinion on what I would like to see happen)

The way to handle this Roger is for Congress to rewrite the national emergency laws to either be more specific in what can be defined as a national emergency, or what funds can be used, or whether or not they would like to see some sort of oversight of the decision.

Right now, Congress is allowed to disagree and overturn the decision of the President if they can muster a 2/3 vote. So there is congressional oversight written into the law. That oversight (and not a court challenge) is how the law is written.

Bottom line Roger...

Congress is responsible for the laws that they write and obligated to follow them, even if those laws were written by previous congresses with different ideas.

Congress can always pass changes, updates, repeals or whatever to change existing laws that they no longer like. That is the recourse if they believe that a particular law is flawed.

The concept that a President can declare a national emergency and move funds around to accommodate that emergency is not something that Trump pulled out of his ass, it's the law as it is written.

Obviously there are a lot of people (on both sides) that don't like the President's choice to declare a national emergency. But it seems to some degree like much of the angst is aimed at the fact that the option even exists.

Remember the "Jordon rules" regarding Michael Jordon and the Chicago Bulls in their glory days?

Well there seems to be a desire to create "Trump rules" whereby the very nature of people not liking him, that normal rules should not apply and that he should be treated differently than other Presidents.


Btw.... this entire "crisis" could have been avoided if the same latitude for border security be given to Trump as has been given to the previous several Presidents. Congress treated Trump "differently" than they have treated previous Presidents on this subject... purely for political and childish reasons.

Our entire Government is being run by children. Trump, Pelosi, Schumer, McConnell, and pretty much anyone interested in running in 2020 are all of similar emotional maturity levels. Nobody is putting the best interests of the Country in front of their own partisan and personal interests.

Not sure what that means... but let's go with this. The national emergency laws were amended to make a President have to reissue them periodically in order to keep them on the books. They were also amended to provide the ability of Congress to overturn a Presidential national emergency.

Congress set that level at requiring 2/3 vote (or the same as a veto override). They could have set that level at a simple majority or something in between.

But they didn't.

The law provides Congressional oversight for this EXACT SITUATION.

The law requires that 2/3 of Congress disagrees with the President. The reasoning is likely to prevent a partisan Congress from overturning legal executive action based on a partisan party line vote.

The law only wants to see the President questioned when that questioning is bi-partisan and overwhelming.


That is the intent of the law. If Congress can muster 67 Senators and 290 members of the House to overturn the EO, then they can block it.


So the law has already written in it's own oversight.

There is nothing in the law that requires a national emergency order to garner the support of a Federal Judge.

The difference here James is that the arguments against the travel ban were at least under the pretense that the EO was a violation of the Constitution on the grounds that it was discriminatory. Those arguments generally attempted to prove that Trump was unfairly targeting a specific group of people and therefore violated the Constitution.

The argument here is what exactly?

That the President is declaring a national emergency for something that some people thing is not a national emergency?

Again, the recourse is to find enough members of congress to override him. If he is "that obviously wrong" then finding 66% of Congress to agree should be no problem. If you cannot garner 66% of Congress then it would appear that resistance to the move is likely partisan in nature. A policy dispute rather than an obvious misuse of the law.


As much as the lower courts love to believe that their job is to referee policy disputes or provide a level of oversight on Trump's decision making, those assumptions disappear by the time it gets to the USSC.

There are at least 5 members of the USSC who understand that their job is to follow the laws and the constitution... not be a third branch of law-makers.

Trump's declaring a national emergency to get his wall. He's forcing a constitutional crisis.

WASHINGTON — Congress knew President Donald Trump thought there was a border crisis when it voted to curb his wall Thursday.

In the arcane language of House and Senate appropriators, endorsed by veto-proof majorities in both chambers, lawmakers said Trump could have no more than $1.375 billion to build 55 new miles of steel fencing. They specifically cited the risk to law enforcement in banning him from constructing solid walls.

It was a resounding and explicit rejection of the idea that there is a national emergency requiring billions of dollars to build a border wall. And that judgment was rendered at a time when Trump has been making a very public case — in speeches, interviews and tweets — that there is a "humanitarian and security crisis" and after he shut down the government for 35 days to make his point.

This is not a case in which an act of God or war struck when Congress was dormant; lawmakers reacted — just not in the way the president had hoped.

Put simply, Congress heard Trump's plea for emergency funding and used its primary authority under the Constitution — the power of the purse — to say no.

That's not an answer Trump likes to hear. So he's not taking it.

Instead, he is planning to announce Friday morning that he will declare a national emergency and draw $8 billion from the just-passed bill and other existing federal accounts to build the wall anyway, according to an administration official. Lawsuits will ensue, and the courts will have to decide whether and how to intervene in a power struggle between the other two branches.

Whatever the case at the border, there's now a clear constitutional crisis that will bolster the power of either Congress or the president.

It's an outcome that many lawmakers — both supporters and opponents of the president — had hoped to avoid.

"I don’t want to see him do that, but it is sad that he is in the position of even having to do that and he would not need to do that had Congress simply done their job and funded the government and funded the wall," Rep. Rob Bishop, R-Utah, said before the president's decision had been confirmed. "Blame Congress."

Rep. Donna Shalala, D-Fla., a former secretary of Health and Human Services under President Bill Clinton, said it would be improper for Trump to take money intended for other purposes and shift it to building a wall.

"That’s why there’s going to be a legal challenge," she said. "I hope he doesn't do that."

Many Republicans, particularly establishment conservatives, have said in recent weeks that it's a bad idea for Trump to use executive powers to circumvent Congress. They envision a Democratic president tapping emergency powers and federal accounts to address liberal wish lists in the future.

Sen. John Cornyn, R-Texas, suggested the same in criticizing the impending move by Trump.

“I think it’s a dangerous step," he said. "One, because of the precedent it sets. Two, because the president is going to get sued and it won’t succeed in accomplishing his goal, and three, because I think [Speaker Nancy] Pelosi will then introduce a resolution which will pass the House, then come over here and divide Republicans. So to me, it strikes me as not a good strategy.”

In theory, Congress could have gone further to stop Trump from building a wall. The new bill could have included a "none-of-the-funds" provision prohibiting him from using any federal money to build a barrier along the border. But a provision like that would surely have drawn a veto — if it didn't sink the bill in the Senate — and possibly forced another government shutdown.

Given its strong desire to avoid that, Congress spoke as forcefully as it could to pre-empt Trump's emergency declaration.

Now, the courts will decide who really has the power over the wall.

So there is some clarification that I wondered about...

Why was Congress looking to pass some sort of non-binding denunciation of a national emergency, when they have the ability to override the President by a 2/3 vote?

Well the law does state that Congress can override a national emergency using a 2/3 vote. But apparently this was shot down by the Courts as unconstitutional.

The logic is that Congress is not allowed to defer and authorize the executive branch to be given discretion, while also allowing Congress to then "take back the discretion".


This sets up a precedent where the Courts have already established that the law not only provided the President with the authority, but the courts established that the authority could not be challenged by Congress.

Some people suggest that the courts "could" use the logic that because Congress wanted oversight, and that the courts shot that down, that the courts must provide the oversight themselves.

McCarthy suggests that such logic might be used by "Obama appointees hard-wired to block Trump".

McCarthy (however) also points out that Congress could have provided an avenue for Judicial review within the law. The fact that they didn't (even after their original attempt at oversight was shot down) - suggest that Congress did not intend for Judicial review. Moreover, the Courts could conclude that Congress's attempt at oversight was designed to be legislative rather than judicial.

Ultimately Congress could decide to repeal and rewrite the NEA law. As McCarthy also suggests, people are elected to Congress for the exact purpose of passing laws... not to "lay low in the tall grass - emerging only on Fox, CNN, and MSNBC to bleat about how bad things are".

first was the "oversight" hearing regarding the DOJ. it was SUCH a fucking joke i can't do it justice by describing it here, you have go to c-span and watch it. all the democrats cared about was mueller, and the republicans on the committee were the only ones asking oversight questions specific to the DOJ but not concerning mueller.

The southern border is a major entry point for criminals, gang members, and illicit narcotics. The problem of large-scale unlawful migration through the southern border is long-standing, and despite the executive branch’s exercise of existing statutory authorities, the situation has worsened in certain respects in recent years. In particular, recent years have seen sharp increases in the number of family units entering and seeking entry to the United States and an inability to provide detention space for many of these aliens while their removal proceedings are pending. If not detained, such aliens are often released into the country and are often difficult to remove from the United States because they fail to appear for hearings, do not comply with orders of removal, or are otherwise difficult to locate. In response to the directive in my April 4, 2018, memorandum and subsequent requests for support by the Secretary of Homeland Security, the Department of Defense has provided support and resources to the Department of Homeland Security at the southern border. Because of the gravity of the current emergency situation, it is necessary for the Armed Forces to provide additional support to address the crisis.

NOW, THEREFORE, I, DONALD J. TRUMP, by the authority vested in me by the Constitution and the laws of the United States of America, including sections 201 and 301 of the National Emergencies Act (50 U.S.C. 1601 et seq.), hereby declare that a national emergency exists at the southern border of the United States, and that section 12302 of title 10, United States Code, is invoked and made available, according to its terms, to the Secretaries of the military departments concerned, subject to the direction of the Secretary of Defense in the case of the Secretaries of the Army, Navy, and Air Force. i can hire the whole load in a car and risk getting busted at a port of entry, or i can hire 10 beaners to backpack it 40 pounds each.

guess which one has a better chance of getting through.

A nonprofit founded by Georgia Democrat Stacey Abrams was slapped with three different tax liens over the past year, bringing the organization’s known total to seven.

Third Sector Development, a nonprofit started by Abrams that focuses on registering black voters, was hit with three separate tax liens in the past year for failing to pay state unemployment tax, The Atlanta Journal-Constitution reported Tuesday. The three tax liens, filed by Georgia state regulators, total roughly $3,500.

This isn’t the first time state regulators have targeted Abrams’ organization. The Georgia Department of Labor issued four tax liens worth $13,000 against Third Sector Development between 2014 and 2016, also citing unpaid employment contributions.

Abrams has blamed third-party clerical errors for all the issues.

White House press secretary Sarah Sanders confirmed Friday that she has been interviewed by special counsel Robert Mueller's team investigating Russian interference in the 2016 presidential election.

“The President urged me, like he has everyone in the administration, to fully cooperate with the special counsel. I was happy to voluntarily sit down with them,” Sanders said in a statement to ABC after the news was first reported by CNN.

One source tells ABC News the interview happened roughly 7-9 months ago, around the same time that it's believed other White House officials were being brought in for interviews.

Sanders isn’t the only member of the comms staff to sit for an interview with the special counsel’s office.

Secondly I wouldn't try to hide women, I would have threatened their children with harm if she said anything to cause suspicious behavior. Most of the women who are brought into the country come through the ports of entry without detection.

U.S. Customs and Border Protection officials in Arizona announced Thursday their largest-ever seizure of fentanyl — 254 pounds of powder and pills hidden in a truck hauling cucumbers.

The load was enough for more than 100 million lethal doses of the drug, a synthetic opioid that has fueled an epidemic of U.S. overdose deaths. In addition to the fentanyl, which was concealed in a secret floor compartment of the trailer, officers also uncovered 395 pounds of methamphetamine, CBP officials said.

Michael Humphries, director of the Nogales port of entry, told reporters that the drugs were detected Saturday after scanning equipment alerted officers to the presence of “anomalies” in the cargo that did not resemble any vegetable.

A CBP canine team searched the truck, and officers opened the false floor compartment to find 400 packages of narcotics — an estimated $3.5 million worth of fentanyl and $1.1 million worth of methamphetamine.

“This represents the largest fentanyl seizure in CBP history,” said Humphries, standing beside armed CBP officers and a table stacked with dope.
