Well Said...

Following a series of questions about President Trump’s former personal attorney Michael Cohen’s failure to disclose $20 million of liabilities on a bank loan application, Rep. James Comer (R-KY) asked him, “Mr. Cohen, you called Donald Trump ‘a cheat’ in your opening testimony. What would you call yourself?”
“A fool,” Cohen said.
Throughout nine hours of public testimony before the House Judiciary Committee on Wednesday, “the fool” managed to embarrass Trump – a lot – and he certainly distracted the public’s attention from the President’s historic summit taking place half-way around the world. However, Cohen never managed to provide House Democrats with what they wanted most of all, which was evidence that President Trump had committed an impeachable offense.

I think, contrary to popular hope, this hearing was never anything more than a chance to embarrass the President. Congress (led by Democrats in the House) chose to provide a disgraced criminal with a national limelight forum to smear a sitting Presidents with innuendos and personal insults.

But there was never any chance that Cohen would produce anything of substance.

Now there are grossly uninformed fools who somehow believe that a $35,000 check mattered. It didn't because the President openly stands by the idea that he reimbursed his attorney for the non-disclosure agreement with Stormy Daniels. Everyone knows Trump paid back Cohen for the $130,000, which was presented as the very legal fee that it was. Not sure what a "check" would have to do with anything. Is there some controversy that it wasn't cash, credit, or wire transfer??

Face it, only the galactically stupid would believe that the reimbursement was any sort of surprise or had any tangible meaning. Although those who like to manipulate the galactically stupid will certain imply differently.

Same holds true for pretty much everything Cohen said. Nothing was a surprise, and there was no smoking gun evidence of anything illegal. Perhaps if Cohen's ruined reputation and embarrassing dishonesty was not at issue, his personal word would mean something. But it simply doesn't.

This was an embarrassing farce. Quite likely a new low in the gut level hatred partisanship that is now being displayed in our country. But I am sure it won't be the "low" for very long. The left is simply blind with rage, and will continue to lash out every opportunity that they get.

"Garden variety financial fraud"

Cohen was famously at the center of arranging a payment related to Trump's alleged sexual encounter with adult film star Stormy Daniels, who was paid $130,000 to keep quiet about a claimed 2006 tryst. Trump has denied Daniels' allegation that the two ever had a sexual relationship. Under an agreement between Trump and Cohen, the attorney would pay Daniels and then be reimbursed.

But that repayment didn't come immediately — and Cohen showed that it stretched into Trump's time in the Oval Office in 2017. Instead of paying in a lump sum, smaller payments were used to make it look like Cohen was simply being paid a legal retainer. One check he showed lawmakers was for $35,000 and was dated Aug. 1, 2017 — signed by Trump well into his first year in office. Another, dated March 17, 2017, was signed by Trump Organization CFO Allen Weisselberg and Donald Trump Jr., the president's eldest son.

President Obama had to pay $375,000 in fines for actual campaign violations during his 2008 run, and I don't think we needed 16 prosecutors, half of Congress and the entire media on the case.

The theory of Trump's alleged campaign finance violation is that if you're running for office, all normal life expenses suddenly become campaign-related. According to these neurotics, ANY money Trump or his companies spent during the campaign is a potential campaign finance expenditure.

Paying your gardeners is a campaign expense -- because who would vote for a man who can't even keep the hedges tidy at Mar-a-Lago? If Trump had gone to the hospital for an appendectomy -- well, he got his appendix cut out because he feared that if he died of appendicitis, he wouldn't get the nomination.

Luckily our laws aren't as insane as our media. For the hush money payments to be campaign expenses, the government would have to prove:

1) Trump, with his fine legal mind, knew he was violating the law; and

2) He authorized the payments only because he was running for office.

So prosecutors have a fantastic case, provided they can get Trump to admit on the stand, Oh no, I wasn't worried that these allegations would hurt my brand at all. I didn't care about what my grandkids or Melania would think. I had Cohen pay off a porn star for the sole purpose of misleading the public into voting for me on the basis of my character.

Such an argument would be absurd with anyone, but we're talking about Donald Trump. He didn't exactly hold himself out to the voting public as a moral paragon.

As voters were well aware, Trump's been married three times, has appeared in Playboy videos, and was a fixture on the Howard Stern show for years, discussing breast sizes and ranking women's looks. In the very first GOP debate, Fox News reminded viewers that Trump had called women "fat pigs, dogs, slobs and disgusting animals."

The reason the "Access Hollywood" tape failed so spectacularly was that Trump had never appealed to Americans based on his character.

To take a contrary example at random, off the top of my head: Sen. John Edwards' presidential campaign was entirely premised on his boasting about how much he loved the poor and loved his cancer-stricken wife -- and also loved his son, who died in a car accident and he's never told anyone this story before ...

About a year before Edwards was caught by a real newspaper, The National Enquirer, visiting his love child and mistress in the Beverly Hilton, Edwards droned on and on about the importance of marital fidelity to CBS's Katie Couric. It was, he said, "fundamental to how you judge people and human character -- whether you keep your word, whether you keep what is your ultimate word, which is that you love your spouse, and you'll stay with them."

In order to preserve this utterly false image, Edwards arranged for his campaign donors to fork over nearly a million dollars to keep his baby mama happy and quiet. These were donors -- not Edwards' personal lawyer -- who ponied up because they wanted him in the White House, and the money was being spent to protect the candidate's completely bogus public image.

But when federal prosecutors brought a case against Edwards for failing to report these rather more obvious campaign expenditures, the government was nearly laughed out of court. The media ridiculed the entire prosecution and the jury acquitted, presumably on the grounds that, however much Edwards didn't want voters to know about the affair, he also didn't want his wife to know.

Early reports on what Cohen might say suggested he was going to tell the committee that Trump told him to lie to Congress about his alleged porn-star payoffs. That would have meant the president had suborned perjury — a serious crime. Such testimony would indeed have amounted to a smoking cruise missile aimed directly at the White House.

But that is not what Cohen said.

This is what he said: “Mr. Trump did not directly tell me to lie to Congress. That’s not how he operates. In conversations we had during the campaign, at the same time I was actively negotiating in Russia for him, he would look me in the eye and tell me there’s no business in Russia and then go out and lie to the American people by saying the same thing.” Cohen added: “In his way, he was telling me to lie.”

If a president is to be impeached when an associate says he intuited that the president wanted him to lie under oath, there is no president following Trump who wouldn’t be vulnerable to the same charge and to impeachment under the same standard.

That is why subornation of perjury has a high evidentiary standard and one that mustn’t be lowered just because liberals and Never Trumpers are determined to see Trump humiliated.

hysteria must reign in order to find a reason to impeach and/or indict trump.

reasoned, thoughtful legal analysis just doesn't get you there.

up to now it's been morbidly entertaining to watch, but i'm afraid that at some point in the not-so-distant future, this cold culture war we find ourselves in will be triggered - by the left - into a hot one.

and then things get interesting.

"One of the things that I bring to the table is a visceral understanding that people under 40 have been shaped by an entirely different set of events. We’ve literally grown up in different Americas. They were shaped by a Cold War America, a post-World War II America; and we are an Iraq War America, a 9/11 America, a hyper-capitalism-has-never-worked-for-us, Great Recession America. People are used to talking about millennials as if we’re teenagers. We’re in our thirties now. We’re raising kids and getting married and having families, and we have mortgages and student-loan debt. It’s important that [Congress is] in touch. People tend to interpret this as me railing against older people and being ageist. But that’s not what this is about. It’s a problem of representation. We don’t have enough intergenerational representation. We largely have one generation. That’s not to say that one generation should be out of power, it’s that others should be here as well." - Alexandria Ocasio-Cortez.

“Though we said at the beginning of the Town Hall that the audience was made up of Democrats and Independents, we should have more fully identified any political affiliations,” the cable news network said in a statement.

WASHINGTON — President Trump ordered his chief of staff to grant his son-in-law and senior adviser, Jared Kushner, a top-secret security clearance last year, overruling concerns flagged by intelligence officials and the White House’s top lawyer, four people briefed on the matter said.

Mr. Trump’s decision in May so troubled senior administration officials that at least one, the White House chief of staff at the time, John F. Kelly, wrote a contemporaneous internal memo about how he had been “ordered” to give Mr. Kushner the top-secret clearance.

The White House counsel at the time, Donald F. McGahn II, also wrote an internal memo outlining the concerns that had been raised about Mr. Kushner — including by the C.I.A. — and how Mr. McGahn had recommended that he not be given a top-secret clearance.

Boy talk about projection.

1. The fact he wasn't even in the Czech Republic in the time frame accused in the Steel dossier is well established.

2. He has no reason to lie and every reason not to lie about it. It's a story too easy to check out. If he told Mueller that Trump told him to lie to Congress you can bet Mueller's investigators would be on it like stink on shit.

3. Nor does anybody else have any knowledge of blackmail material. The steel dossier is less credible than Cohen.

4. If Cohen is lying about evidence of collusion than so maybe is Mueller. Because there seems to be a consensus from the leaked stories that the special counsel has no evidence of collusion.

It's obvious that Cohen will lie when it suits his needs and it's a lie that can't be exposed (with the exception of telling the committee he never wanted a job at the White House when there was ample evidence he indeed wanted one and was disappointed in not getting one. That was a mysterious blunder to me.)

Otherwise, he'll tell the truth when if serves his interest.

This is not hard to figure out.
