Wisenberg said.McCabe (according to those who have seen his book) is going to be claiming that the justification for opening up the investigation was based on "public information" rather than the Steele Dossier. He will also defend his decision to include openly anti-Trump agents such as Peter Strzok on the investigative team. Both are going to be very dubious arguments to make.
Now as much as some would like to think that the FBI has full authority to do whatever they want, it's actually not only against FBI policy, but a criminal act for anyone in the FBI to open an unwarranted investigation without credible evidence. This should be especially true when it comes to partisan investigators going after a sitting President.
Let's be honest here folks. If this happened to any of the forty four other Presidents not named Trump, there wouldn't be a single person in this country who would support the lawlessness of the FBI.

The demands, made by Chairman Jerrold Nadler (D-N.Y.), cover communications between former White House counsel Donald McGahn and the president relating to Trump’s fired national security adviser, Michel Flynn, as well as Flynn’s statements to the FBI about contacts with former Russian ambassador Sergey Kislyak.
“We will act quickly to gather this information, assess the evidence, and follow the facts where they lead with full transparency with the American people,” Nadler said in a statement. “This is a critical time for our nation, and we have a responsibility to investigate these matters and hold hearings for the public to have all the facts. That is exactly what we intend to do.”
In a statement Monday, White House press secretary Sarah Sanders acknowledged receipt of Nadler’s letter to the White House and said officials “will review it and respond at the appropriate time.” She did not comment further.
Nadler is also seeking to learn about communications regarding Trump’s firing of former FBI director James B. Comey, as well as what occurred at a June 2016 meeting at Trump Tower. That meeting included Trump Jr., Kushner, Trump’s former campaign manager Paul Manafort and Russian lawyer Natalia Veselnitskaya, who had “dirt” to offer about Democratic presidential nominee Hillary Clinton, according to an email made public.
Nadler has also asked American Media Inc., and its CEO, David Pecker, a longtime Trump ally, about the hush payments or “any payment” made by former Trump personal lawyer Michael Cohen to assist Trump during the campaign.
The documents requested by Nadler are a first step in the committee’s effort to explore possible obstruction of justice by the president into special counsel Robert S. Mueller III’s investigation into Russian interference in the 2016 election and whether Trump or anyone close to him coordinated with the Russians during the campaign.

The chairmen of three House committees wrote letters to the White House and the State Department requesting documents on President Trump’s communications with Russian President Vladimir Putin, citing “profound national security, counterintelligence, and foreign policy concerns,” the Washington Post reports.
The unsinkable Representative Charles B. Rangel appeared on C-SPAN over the weekend. Why unsinkable? Well, in 2010 the House of Representatives censured the New York Democrat by a vote of 333 to 79 (when the body was still majority-Democratic) for violating 11 ethics rules and “bringing discredit to the House.” The New York Times called it a “staggering fall” for the senior Democrat. But fall/shmall, he’s since been reelected and will retire at his leisure.
While chatting with Brian Lamb, Rangel dropped a few falsehoods as casually as cigar ash. This isn’t to pick on Rangel; he’s just illustrative. He hired many blacks in his family business and pushed to desegregate the Arizona National Guard. He had a good-faith objection to some features of the 1964 act, which he regarded as unconstitutional.
Goldwater was no racist. The same cannot be said of Fulbright, on whom Bill Clinton bestowed the Medal of Freedom. Fulbright was one of the 19 senators who signed the “Southern manifesto” defending segregation.
Okay, but didn’t all the old segregationist senators leave the Democratic party and become Republicans after 1964? No, just one did: Strom Thurmond. The rest remained in the Democratic party — including former Klansman Robert Byrd, who became president pro tempore of the Senate.
Former racists of both parties renounced their old views (as Kevin D. Williamson points out, Lyndon Johnson himself voted against anti-lynching laws and poll-tax repeals), and neither party has a perfect record on racial matters by any stretch. But it is a libel to suggest that the Republican party, the anti-slavery party, the party of Lincoln, and the party that traditionally supported civil rights, anti-lynching laws, and integration, became the racist party after 1964.

The Court did not subject Section 4(b) to the "congruence and proportionality" standard of review or address whether that standard is the appropriate measure to use when determining the constitutionality of legislation passed pursuant to Section 2 of the Fifteenth Amendment.[32] The Court also noted the federalism concerns raised by the Section 5 preclearance requirement, but it did not reach the issue of whether Section 5 remains constitutional. However, because the Section 5 preclearance requirement applies only to jurisdictions covered by the Section 4(b) coverage formula, the decision rendered Section 5 inoperable unless Congress enacts a new coverage formula.[4][24][33]
Justice Thomas wrote a concurring opinion expressing his view that Section 5 is also unconstitutional for the same reasons the Court held Section 4(b) unconstitutional.[2][34]
