Let's face it, by the time a Judge is considered qualified to be a USSC Justice, they would have been nominated and confirmed at least once before. That means that they will be saddled with being either a Republican or Democrat nominee, and neither side will look kindly on Schultz nominating someone from the other side.

The only other option would be to go outside the judicial community and find someone with zero political affiliation at all and nominate a complete outsider to the USSC. But who is both popular enough, completely non-political, and qualified in any way to get 67 votes?
Maybe Judge Wapner of the people's court? Too bad he's dead.
