No, not this Acosta

This Acosta

Make no mistake, this whole Epstein deal goes much deeper than the deal that Alex Acosta provided for Epstein. And I don't mean deeper into the Trump Administration. I think this one might go much deeper with powerful players who had a reason to keep Epstein happy.  Make no mistake, deals were cut, there were winks and nods, and everyone thought it was old (good and buried) news.

The problem is that where this one goes, not many in the media will be interested. Much better story (politically) to tie Acosta to Trump and his Administration now, rather than tie him to the people he was associated with when this whole thing went down.

President Trump’s efforts to add a citizenship question to the 2020 Census ended not with a bang but with a whimper of a news conference tucked after a summit on the state of social media. This startling defeat highlights important limits on the administration’s playbook for laundering bigotry through administrative processes and bald-faced lies. It also showcases how executive abuses of power can be constrained: through congressional oversight and steel-nerved judges committed to the rule of law.

In Department of Commerce v. New York, the Supreme Court invalidated Commerce Secretary Wilbur Ross’s decision to add a question about citizenship to the 2020 census. It held that the reason he had given for adding the question — enforcing the Voting Rights Act — was “a distraction” from the truth. After initially stating it would lay down its arms, and in response to an enraged presidential tweet, the administration hinted Trump might seek to add the question by executive order.


These suggestions recalled how this administration approached the travel ban and the ban on military service by transgender individuals. It first announced an illegal policy motivated by bias and without developing the new rule through any of the usual procedures. Then, after courts enjoined that illegal action, the administration rounded up some lawyers to try to make things look more respectable and present a “new” policy as though history never happened.

This strategy worked for the travel ban. Federal courts halted the original policy on the grounds that it arose from anti-Muslim animus. But after Trump’s lawyers removed the most explicit references to religion and slightly tweaked the list of which countries were subject to the order — in addition to feigning consultation with relevant expert agencies— the Supreme Court upheld a third version of the ban.

Something similar is happening with the ban on military service by transgender individuals. After the administration first announced the ban as a way to put an unexpected presidential tweet into action, numerous courts blocked it as unconstitutional. So the administration put together a group of supposed experts to issue a report and made some cosmetic changes to the policy, and the Supreme Court ultimately allowed the revised policy to go into effect, albeit without reaching a decision on its validity.


But the census case is different. At long last, the administration’s web of lies tangled up not its intended prey but the president’s own priorities. And the separation of powers helped finish off a Trump proposal rather than belatedly allowing it to take effect. The result was a resounding victory for the rule of law over the rule of Trump.

Much credit for that development belongs to U.S. District Judges Jesse M. Furman, George J. Hazel and Richard Seeborg. From the beginning, these capable judges rejected the Justice Department’s procedural high jinks and clumsy efforts to hide the truth. They then wrote powerful opinions that brought into stark relief the simple implausibility of the administration’s asserted rationale for adding a citizenship question. After the Supreme Court agreed that Ross’s rationale was “pretextual,” a legal term for a pure fiction specifically intended to obscure the truth, this trio of judges stood by the integrity of the judicial system. And they did so even as Trump attacked them via tweet, tried to replace his whole legal team in patently deficient motions and engaged in a shockingly open-air search for some passable new pretext for adding a citizenship question.

Alexander Acosta is out as labor secretary, President Donald Trump told reporters Friday.

His resignation followed a wave of new information about the alleged crimes of accused child sex trafficker Jeffrey Epstein, for whom Acosta helped broker a sweetheart plea deal more than a decade ago.
Epstein was arrested when his private jet landed at a New Jersey airport July 6. He faces new charges, brought by the U.S. attorney’s office in Manhattan, for allegedly recruiting and trafficking dozens of minors in New York and Florida between 2002 and 2005, then molesting and sexually abusing them.

The allegations are similar to those federal prosecutors in Miami brought in 2007 when Acosta, who was then a U.S. attorney, helped draft a nonprosecution agreement for Epstein without notifying his alleged victims. In February, a federal judge ruled that federal prosecutors, including Acosta, broke the law by signing the agreement

The agreement granted Epstein immunity from federal prosecution. The powerful former hedge fund manager stood to face life imprisonment for trafficking and sexually abusing underage girls for at least six years, according to a Miami Herald investigation.

But under the nonprosecution agreement, Epstein was sentenced to just 18 months in county jail after he pleaded guilty to two lesser prostitution charges, and ultimately served only 13 months. The agreement also permitted Epstein to leave jail for 12 hours a day, six days a week, so he could continue working.

Women who say they were molested by Epstein have come forward following his arrest, describing being recruited and groomed by Epstein’s associates when they were young teenagers.

Jennifer Araoz told NBC News she was just 14 when a woman representing Epstein approached her outside her New York City performing arts high school and promised to help her become an actress.

In 2002, when she was 15, she says the wealthy financier raped her.
“I was so young that I was worried that somehow I would get in trouble,” Araoz said on the “Today” show, explaining why she didn’t alert anyone at the time. “I was really frightened of Epstein. He knew a lot of powerful people and I didn’t know what he could do to me, and I wasn’t sure that anyone could protect me.”

Another woman, Courtney Wild, told ABC News she “never felt like the U.S. attorney was on my side,” referring to Acosta’s handling of the case in Florida years earlier.

While at least one former federal prosecutor described the deal as “completely unprecedented” in its leniency, Acosta has continued to defend it:

Trump nominated Acosta for labor secretary after businessman Andrew Puzder withdrew from consideration amid accusations that he abused his ex-wife during their marriage. The president also floated the idea that Acosta might replace former U.S. Attorney General Jeff Sessions.

Following the new charges against Epstein, many people called for Acosta’s resignation, including lawmakers and abuse survivors. Some of the most prominent voices included House Speaker Nancy Pelosi (D-Calif.), Senate Minority Leader Chuck Schumer (D-N.Y.), and 2020 candidates Sen. Kamala Harris (D-Calif.), Sen. The Hispanic population in the US has accounted for over 60% of the nation’s homeownership growth in the last ten years, the largest in 14 years according to the National Association of Hispanic Real Estate Professionals’ recent report.

“Over the past decade, Hispanics have accounted for 62.7% of net US homeownership gains, growing from 6,303,000 homeowners to 7,877,000, a total increase of 1,574,000 Hispanic homeowners,” NAHREP said. “This upward trajectory for Hispanic homeownership is consistent with projections made by the Urban Institute that Hispanics will account for more than half of all new homeowners over the next several years and for 56% of all new homeowners by 2030.”

The organization’s data revealed that Hispanics made up over 30% of overall US household formations in 2018 alone, contributing 362,000 homeowners to the US housing market. The Hispanic homeownership rate increased to 47.1% from 46.2% in 2018. This rate marked the biggest net gain for Hispanics since 2005.

Fannie Mae’s 2018 annual housing survey backed these findings, showing a growing demand for homeownership among Hispanic Americans. In fact, 88% of Hispanics believe that buying a home is the best housing investment plan, according to the survey.

“In 2018, Hispanics formed 485,000 new households, accounting for 32.4% of total U.S. household formations,” NAHREP said. “According to Harvard’s Joint Center for Housing Studies, Hispanics are projected to increase by 4.6 million households between 2015 and 2025. Hispanic household growth continues to outpace that of overall US household growth and is anticipated to do so for the foreseeable future.”

In the subsequent order, Judge Freidrich wrote: “On May 29, 2019, following the Court’s hearing, the Special Counsel held a press conference…[in which he] carefully distinguished between the efforts by ‘Russian intelligence officers who were part of the Russian military’ and the efforts of” Concord. This, the Judge found, made the criminal contempt proceedings she contemplated against Mueller’s team “unnecessary and excessive under the circumstances.”

A narrow escape it was indeed. Freidrich found that both the release of the Mueller report and Barr’s statements boosting the report violated DC Rule 57.7 prohibiting lawyers from trying cases in the press. Judge Freidrich rejected the government’s argument that the Mueller report did not smear Concord with unproven links to the Russian government.

A racist rant by a white woman at a grocery store was caught on video. In it, she’s seen telling a Puerto Rican woman that she should “be deported” and go back to her “own country.”

Johanny Santana was shopping in Abington Township, located in Montgomery County, Penn., during the incident, as reported by NBC 10 Philadelphia. According to a video she posted on Facebook, Santana was at check-out at the store, in process of paying and leaving when the woman behind her in line began a tirade.

The video shows that she was unhappy with the fact that Santana was speaking Spanish, which is when the fall-out began.

When the Puerto Rican woman asked if she had a problem, the other woman responded with “Can you stop talking to me?

The latest estimate released Thursday by the National Agricultural Statistics Service is based on crop conditions July 1 and comes as wheat harvest is well under way in the state.

Former special counsel Robert Mueller will give extended testimony when he appears before Congress on July 24, one week later than originally anticipated, the Democratic chairmen of the House Judiciary and Intelligence committees announced Friday.

Mueller has agreed to testify for three hours before the Judiciary panel, allowing all members the opportunity to question him. He was previously scheduled to testify July 17 under subpoena, but his appearance was to be limited to approximately two hours per committee, meaning some Judiciary members would not get a chance to ask questions.

"We are pleased to announce that Special Counsel Mueller will provide additional public testimony when he appears before our committees. At his request, we have agreed to postpone the hearing for one week, until July 24, at which time Mr. Mueller will appear in public before the House Judiciary Committee followed by the House Permanent Select Committee on Intelligence," Judiciary Chairman Jerrold Nadler (D-N.Y.) and Intelligence Chairman Adam Schiff (D-Calif.) said in a statement.

The Judiciary panel will convene at 8:30 a.m. on July 24 to hear Mueller's testimony on his two-year investigation into Russian interference and potential obstruction of justice by President Trump, the chairmen said. After a brief break, Mueller will testify at noon before the Intelligence panel.

A lot of the questions will be asked by lawyers who work for the congressmen and women.

Those of us who remember the Watergate hearings are looking forward to seeing a lot more than Mueller said in his 19 minute report.
