News Conference today: Trump to add citizenship question via executive order

Let's watch the legal fireworks explode over this one. 

Let me make an observation here. Had this been known ahead of time, I have a sneaking suspicion that you would not have seen Chief Justice Roberts make the call he did. After all, it was completely unexpected (based on his questioning and previous decisions on issues like these). The decision created a new legal norm of allowing Judges to overrule executive branch decisions not just on arbitrary or capricious grounds, but on the grounds that the Judge either didn't like the decision or the explanation of the decision. Creating new precedents while simultaneously increasing Judicial authority is not a normal Roberts move.

As many (including myself) have noticed about Roberts, he seems to pick one of the bigger cases that are generally decided at the end of the term and move over to side with the liberals. It's almost as if he is both tossing a bone both to the four liberals, while also trying to fight off the conventional wisdom of this being a politicized 5-4 court. But unlike Kennedy, who was a true swing voter because he held fast to his own principals, Roberts seems to grasp for reasons to side with the liberals on big issues. Whereas Kennedy's opinions were easy to follow, well principled, and mostly expected, Roberts opinions on these are convoluted, unprincipled, and usually come completely out of left field.

Would he had made "this" particular decision had he known it would have caused all the political fuss, legal hassles, and possibly pushed the President into creating another big constitutional showdown? After all, it's was not a well argued logical legal decision. It is not what you would expect him to do based on his past ruline. It was not a popular decision across the country, as an overwhelming amount of Americans are for the question being on the census.

This was a decision that if it played out in most any other situation, Roberts would have sided with precedent, difference to the other branch, and common sense. Now what we are seeing is a complete legal trainwreck with the USSC right smack dab in the middle, and Roberts only has himself to blame.

The President is following the USSC decision.

The court unanimously ruled that the question itself was constitutional and could be added. They ruled 5-4 that the means used to add the question was somehow in violation of the Administrative Procedures Act.

That means that the question can be legally added by another means, based on the legal logic of the court decision.

So the question I have for you Roger...

Was the court being honest with this ruling?

Or was their logic of using the APA to remove the question "really" a dishonest means to get to what they considered a justifiable ends?


Because if they really just didn't want the question on the census, even though they had no real legal reason to deem it unconstitutional (keeping in mind that we had this on the census question in the past, and every first world nation that does a census has it on theirs).... then this decision represents a dishonest unconstitutional judicial power grab.

Is that what you are saying Roger?


Or are you saying you really don't understand how convoluted the Roberts decision was? If this is all over your head, just say so.

This is one of those times were a USSC was so bad, that I actually have no reason to not applaud this move. Make no mistake. This was not Trump's idea or Trump's decision. This was 100% Bill Barr. Barr is a brilliant legal mind, and is basically single handedly sticking it to the USSC on this.

It will ultimately come down to the Court showing it's true colors.

I am not arguing the Roberts decision.

You are, the decision said the question was constitutional. The federal law cited only applies to agencies of the US government.

The law does not apply to the chief executive.

He can order the question on the census and there not a hell of a lot the congress or courts can do about it.

At least not without violating the rule of law.

so, as usual, the alky and d0pie are so proud of their ignorance that they put it on full display yet again today.

and in the alky's case i'm not sure which is greater - his hypocrisy or his stupidity.

when 0linsky was making his 'pen & phone' declarations the alky cheered him on every fucking day. and in many of those declarations the USSC ruled 9-0 AGAINST.

trump does the complete opposite and respects the USSC 9-0 constitutionality of the citizenship question and it drives the alky ever deeper into his descent into madness.

to me what's truly remarkable about this whole situation is not that trump would seek to reinstate the question, but that 0linsky had it removed in the first place.

the latest polls indicate that national sentiment is in favor of asking the citizenship question.

why, it's almost like the alky is mourning the loss of all those shiny new democrat voters he's been promised by all the open borders advocates.

Possible. Trump provides the executive order, based on the the first 4 parts of the latest ruling (all stating that adding the question was legal). Then immediately orders the census to start being printed.

By the time a lawsuit is filed, a Judge hears the case, and orders an injunction (assuming he or she does)... the new census will already be partially printed with the citizenship question. It could cost "millions" for a Judge to overrule and not allow for a new census to be changed and restarted. Then the department can argue that there isn't enough time to abide by a new ruling.

But seriously, I could maybe see a district judge providing an injunction preventing the censuses from being written. But I would seriously doubt that a single district judge would attempt to "force" the executive branch of the Government to start printing a new census that runs counter to an EO order.


All that being said, I have been wrong about how far some of these "resistance Judges" are willing to go to show their TDS influence on their legal decisions.

Technically we had two censuses - A long form (that included the citizenship question) and a short form (that did not). Both forms were used, with the majority getting the short form, but still many getting the long form. This had been the procedure for I believe three censuses. Before that everyone got a long form with the citizenship question.

Obama simply stopped sending out the long form (which had the question) and decided that everyone would get the short form. So it's not really that he "removed" the question. He more less discontinued the form that had the citizenship question on it.

So it's not quite a blanket EO to remove it and then an EO to put it back on. That being said, it may have been just easier to have switch it around, and decide to use the long form vs the short form. Then the citizenship question would have not been the only thing we would be talking about, and there would have been an easier explanation to provide to the courts.

Actually, it was Bush who ended the long form. That decision was made in 2008. Many Republicans had long fought against the use of the long form, which captured a subsample of characteristics that could be used for statistical analysis. One use, that benefited me in my early career, was the collection of journey to work data (how far do you live from work, how long does it take to commute, what mode do you use, what's your household income, number of cars owned, etc.). This was useful in establishing a consistent national baseline for use in creating travel demand models, which assist in the evaluation of impacts of new transportation facilities and new developments.

Many conservatives hated the long form as intrusive, and fought to remove it each census. Reagan elected to keep the form for 1990, and Democrats made the decision to use the form for the 1970, 1980, and 2000 censuses.
