Part II

If this was about optics, then Democrats and especially Mueller lost the day


Starts off correcting the misstatement regarding whether or not he would have "indicted" the president if not for the OLC opinions. That was likely the biggest "talking point" that the left was excited about (even if it was clear to most that it was a misstatement).

Bottom line: He took back the idea that he would have indicted the President.


Apparently the second hearing is going to involve the Democrats trying to talk about Volume I. This is the area that people really are pretty set on. The fact of the matter is that this is where the Democrats will find themselves arguing with Mueller. He is already disagreeing with them on their characterization of events.

They are attempting to tell him he was wrong about his charging decisions. He will continue to disagree.

I will say that the one thing that the Republicans (so far) have let go is not forcing Mueller and the Democrats to clarify as to whom Papadopoulos and Manafort were talking to. Papadopoulos got his information not from "the Russians" but from a London based Professor. Manafort did not share information with "the Russians" but rather with one of his employees.

Democrats keep referring to these people as if they might as well be Vladimir Putin himself, and Mueller is failing to correct (and Republicans are not following up).

Democrats are clearly struggling to gain traction here. The obvious strategy was to allow the House to work on the obstruction portion, while the Senate worked on the conspiracy side. Perhaps things will change in the second half of things here.


Mueller doesn't look quite as bad as he did earlier (or maybe we are just getting used to the fact that he is a bumbler), but the Democrats have adopted a strategy of questioning the legal aspects of why there was a lack of indictments. This puts them in an adversarial situation.

The portion where Democrats suggested that Trump Jr sending out a link being a crime is not taken kindly by media members who all pretty much relinked the wikileaks information. As one person stated, if that was a crime, half of Washington DC would be in jail.

Curious that Mueller determined that the two dozen plus leaks that could only come from his investigation, didn't come from his investigation. It seems like an odd (and somewhat naive) viewpoint that these leaks must have come from someone outside of his investigation.

I thought that maybe after the break that Democrats would switch gears and not necessarily try to get Mueller to state that there was some "conspiracy" that he otherwise had not previously found. But they are right back to questioning Special Counsel on the idea that there really "was" a conspiracy that was missed. Sort of the plain sight conspiracy that Adam Schiff is so fond of suggesting. Mueller made the call that none of this was criminal. Democrats seem like people who believe if they ask the same question nine times and get a "no", that the tenth time just might be a "yes".

A historic heat wave is bringing unprecedented temperatures to Western Europe, and is poised to expand northeastward to Scandinavia and into the Arctic by late this weekend. Once above the Arctic Circle, the weather system responsible for this heat wave could accelerate the loss of sea ice, which is already running at a record low for this time of year.

First, residents of Paris, London, Brussels, Amsterdam, Munich, Zurich and other locations are suffering through dangerously high temperatures on Wednesday and Thursday.

Already on Wednesday, all-time national heat records in the Netherlands, Belgium and Germany had fallen, right on the heels of a late June heat wave that broke similar records in France and other countries. The German meteorological agency noted that Wednesday’s national record of 104.9 degrees (40.5 Celsius) may last just a day before being broken on Thursday.


It’s difficult to beat all-time heat records in mid-July, considering this is the hottest time of year. It’s even more unusual to beat these records by a large margin, which is what is occurring now.

Surprisingly the big winner in all of this may be Nancy Pelosi who has been trying to keep the lid on impeachment.

However, I think the damage has been done. Mueller has been expose as a geriatric figure head and Schiff and Nadler as been exposed as fools on national TV.

Best move for the Democrats is to quietly shut this down and hope people forget by Election Day.

r the course of more than five hours of quiet, rather than dramatic testimony on Capitol Hill, Mr Mueller defended the work of team of investigators and the report that was made public in April.

It is not clear whether the appearance of Mr Mueller will benefit the cause of those pushing for Mr Trump’s impeachment. Indeed, Nancy Pelosi said afterwards, there was no immediate plans to open proceedings.

Some Democrats were said to have been disappointed the 74-year-old who once headed the FBI, had not provided more of a blockbuster, or provided a fresh bombshell.

At the same time, Mr Mueller’s public words were significant in a number of ways. There are five of the most important things:

Possible obstruction of justice

Mr Mueller said Trump tried to have him fired, asked the White House counsel to lie about it, and ordered aide Corey Lewandowski to limit the scope of his investigation. In his response to questions from Ted Lieu and later Adam Schiff, Mr Mueller may have not gone materially beyond what was in his report, but hearing him state this in person was a powerful moment.

No exoneration:

The president repeatedly claims Mr Mueller’s report cleared him of both collusion with Russia and obstruction of justice. But the special counsel again denied this. Asked whether the report exonerated Mr Trump on the question of obstruction of justice, Mr Mueller said: “That is not what the report said. The president was not exculpated for the acts that he allegedly committed.”

President’s written answers were ‘generally’ untruthful

Mr Mueller made clear he would have preferred a sit down interview with the president rather than a written Q&A, but that he had to agree to that given the amount of time if would have taken to go through the courts to force a face-to-face. Mr Mueller said he had sent several follow up questions but received no response.

Asked by congresswoman Val Demmings, if Mr Trump’s written answers to questions were inadequate, incomplete and untruthful, Mr Mueller said: “Generally.”

Russian interference still continuing

Mr Mueller said the Trump campaign was aware of Russia’s efforts to help him in 2016. He denied the investigation was a “witch hunt”, and that it had found the Russian government “interfered in our election in sweeping and systematic fashion”.

He said Russia’s efforts in 2016 were not a “single attempt”. He said: “They’re doing it as we sit here.”

Mueller refused to be mouthpiece for Democrats’ pushing for Trump impeachment

Congresswoman Veronica Escobar asked Mr Mueller about a mention in his report about “constitutional processes for addressing presidential misconduct”, something those in favour of Mr Trump’s impeachment took as call to arms. Mr Mueller refused to answer when asked specifically whether one of those “processes” was impeachment.

Denny - Mueller stated that a sitting President can be indicted once they leave office. That is not a novel idea or something that needed an explanation from Mueller. Mueller has no say in whether Trump would ever be indicted. Not that it would matter, because it's not going to happen regardless of who has their say.

mueller never did have any say. that's the most disingenuous part of the argument coming from the democrats and their media stenographers.

mueller's job was to conduct a probe and to gather data and evidence. then, based upon that evidence, he was supposed to turn his findings over to the DOJ. and based upon the review of mueller's findings and the compilation of alleged crimes committed, it was then to be determined what to do next.

the fact remains that mueller found nothing to implicate the president. nor did he find anything that exonerates him. that's always been the point. mueller gathered the findings into a report and said here, do with it what you will.

Not that it would matter, because it's not going to happen regardless of who has their say.

if there was ever a golden opportunity to indict a president after leaving office it was clinton. he DID obstruct justice. and no one had the nerve to indict him. in trumps case he MAY still get indicted after leaving office. but he beats the charges without breaking a sweat.

Exoneration is not even a real thing.

What is a real thing is the assumption of innocence and the fact that you need to prove to a jury (unanimously) beyond a reasonable doubt that the person is actually guilty of a crime.

There is no legal precedent for obstruction by tweet, obstruction by tantrum, obstruction by controlling media spin, or obstruction for arguing your own innocence. There is no legal precedent for obstruction by firing a subordinate (who may end up in jail), holding opinions about a prosecutor, or ordering counsel to explore whether Mueller had a conflict (which he clearly did in retrospect).

So yeah, you go right in there with the whole guilty until proven innoncent "we can convict someone unless they are exonerated" and see where that gets you in a "real" court of law.
