NY Times: McCabe might actually be indicted?

Prosecutors Near Decision on Whether to Indict Andrew McCabe
In two meetings last week, Mr. McCabe’s lawyers met with the deputy attorney general, Jeffrey A. Rosen, who is expected to be involved in the decision about whether to prosecute, and for more than an hour with the United States attorney for the District of Columbia, Jessie K. Liu, according to a person familiar with the meetings. The person would not detail the discussions, but defense lawyers typically meet with top law enforcement officials to try to persuade them not to indict their client if they failed to get line prosecutors to drop the case.
So in layman's terms:
  • It would appear that the Prosecutor (Jessie Liu) handling the case for the District of Columbia has decided to indict McCabe for his false and misleading statements during the investigation. 
  • This has prompted the Attorneys for McCabe to reach out to a higher authority (Deputy A.G. Jeffrey Rosen) to see if they can pull some strings and have that decision reversed. 

The NY Times is using some semantic magic by calling the decision to indict McCabe a "failure to get line prosecutors to drop a case" and by suggesting that the meeting with the Deputy A.G. is a common place event where attorneys can make an additional plea. It's not.

The headline is more than a little misleading as the guts of the story actually strongly suggests that the decision has already been made by the D.C. prosecutors to go ahead with the case. A better headline might be that counsel for McCabe are making a last minute plea with higher authorities to head off an upcoming indictment.

The story also tosses in the red herring that indictments of FBI agents are rare and that it might be difficult to get a conviction in a D.C. Court because of the political makeup of the D.C. jury pool. But the fact that an indictment is rare, or that a potential jury might be partisan, does not really affect whether or not there is a case to be brought.

The reality is that this is about the fairness in our criminal justice system. There is little logic in the argument that General Flynn or George Papadopoulos were correctly indicted for false statements, while Andrew McCabe should not be because of his position as a liberal FBI agent making it harder to get a conviction with a potentially liberal jury. The indictment should go through, and the prosecutors should have their day in court.

One of the worst habits among the D.C. commentariat is the tendency to treat President Trump’s lies as if they possess magical qualities. We are constantly told that Trump’s lying “works,” a claim that rests on the idea that no matter what Trump says, his supporters will believe him.

It’s true that Trump supporters generally accept what he tells them. But the reverence accorded to Trump’s powers of deception sometimes seems to imply they have an almost paranormal quality. And this takes things way too far.

Case in point: American farmers. There are indications that they are now getting genuinely angry over Trump’s efforts to gaslight them so shamelessly over the impact of his trade war with China.

The New York Times has a good report that fleshes out the damage that farmers are sustaining right now — and their reaction to it. China’s retaliatory tariffs are closing off the biggest export market in the world — leading to a massive drop in exports of soybeans, pork, wheat and other agricultural products.

The administration has rolled out billions and billions of dollars in aid to farmers. But farm loan delinquencies and bankruptcies are rising, and the ripple effects are spreading, with one major manufacturer of agricultural equipment cutting its profit outlook this month.

And Trump’s trade war is only escalating: Trump has increased tariffs on Chinese products yet again, and China slapped new tariffs on $75 billion in U.S. exports. As the Times puts it, “farmers are beginning to panic.”

What seems notable is that farmers’ representatives are growing angry about what Trump is telling them about all this. Trump frequently makes such claims as “farmers are starting to do great again.”

That’s a lie. But don’t take my word for it. The New York Times reports that the head of a major farm group forcefully challenged that claim at a recent gathering with Trump’s agriculture secretary, Sonny Perdue:

American farmers have become collateral damage in a trade war that Mr. Trump began to help manufacturers and other companies that he believes have been hurt by China’s “unfair” trade practices.

More than a year into the trade dispute, sales of American soybeans, pork, wheat and other agricultural products to China have dried up as Beijing retaliates against Mr. Trump’s tariffs on Chinese imports. Lucrative contracts that farmers long relied on for a significant source of income have evaporated, with Chinese buyers looking to other nations like Brazil and Canada to get the commodities they need. Farm bankruptcy filings in the year through June were up 13 percent from 2018 and loan delinquency rates are on the rise, according to the American Farm Bureau.

The predicament of farmers is becoming a political problem for Mr. Trump as he heads into an election year. For months, farmers have remained resolute, continuing to pledge support to a president who says his trade policies will help the agricultural industry win in the end. While there are few signs of an imminent blue wave in farm country, a growing number of farmers say they are losing patience with the president’s approach and are suggesting it will not take much to lose their vote as well.

Mr. Trump, who regularly brags about an economic boom despite signs of a slowdown, has in some cases made matters worse. He recently dismissed sales of American wheat, suggesting Japan was buying it only as a favor to the United States. And his frequent tweets insisting that “farmers are starting to do great again” have rubbed some agriculture groups the wrong way.

“We’re not starting to do great again,” Brian Thalmann, the president of the Minnesota Corn Growers Association, told Mr. Perdue at the event. “Things are going downhill and downhill quickly.”

On Monday, after a 72-hour period during which Mr. Trump twice escalated his trade war with China, Mr. Thalmann said he could no longer support the president as he did in 2016.

Donald Trump’s approval rating has sunk in every 2020 battleground state, showing major vulnerabilities for the incumbent president a little over a year from election day.

That’saccording toMorning Consult’s tracking poll, which found Mr Trump’s approval slipping in 17 of the states that are expected to be competitive next year.

His approval rating remains above water in just two of those states — with a two per cent net positive rating in Georgia, and a 6 per cent net positive rating in Texas.

The new poll shows that, in key states that Mr Trump won in 2016 to break down the so-called Democratic “firewall”, his fortunes may have turned. Those include Michigan, Pennsylvania, and Wisconsin, where Mr Trump beat Hillary Clinton with a combined 130,000 votes.

But the concerning polling expands far beyond those states, and into territory that has generally been considered safe for Republicans — and states Mr Trump won.

In Ohio, where Mr Trump began his time as president with 14 per cent net approval, he has slipped to negative 6 per cent. In Iowa, where his approval was 9 per cent, that figure has dropped to negative 11 per cent.

In Arizona, his approval has dropped from 19 per cent approval, down to negative 7 per cent. In Florida, where he once enjoyed 22 per cent approval, he has dropped to negative 1 per cent. In North Carolina, where he enjoyed 17 per cent approval, that rating has dropped to negative 1 per cent.

The polls come as both Republicans and Democrats gear up for the 2020 elections, and as both sides suggest they believe they can pull together a coalition of these states for a victory next year.
