MICHAEL MANN REFUSES TO PRODUCE DATA, LOSES CASE

Some years ago, Dr. Tim Ball wrote that climate scientist Michael Mann “belongs in the state pen, not Penn State.” At issue was Mann’s famous “hockey stick” graph that purported to show a sudden and unprecedented 20th century warming trend. The hockey stick featured prominently in the IPCC’s Third Assessment Report (2001), but has since been shown to be wrong. The question, in my view, is whether it was an innocent mistake or deliberate fraud on Mann’s part. (Mann, I believe, continues to assert the accuracy of his debunked graph.) Mann sued Ball for libel in 2011. Principia Scientific now reports that the court in British Columbia has dismissed Mann’s lawsuit with prejudice, and assessed costs against him.

What happened was that Dr. Ball asserted a truth defense. He argued that the hockey stick was a deliberate fraud, something that could be proved if one had access to the data and calculations, in particular the R2 regression analysis, underlying it. Mann refused to produce these documents. He was ordered to produce them by the court and given a deadline. He still refused to produce them, so the court dismissed his case.

The rules of discovery provide that a litigant must make available to opposing parties documents that reasonably bear on the issues in the case. Here, it is absurd for Mann to sue Ball for libel, and then refuse to produce the documents that would have helped to show whether Ball’s statement about him–he belongs in the state pen–was true or false. The logical inference is that the R2 regression analysis and other materials, if produced, would have supported Ball’s claim that the hockey stick was a deliberate fraud on Mann’s part.

Mann says that his lawyers are considering an appeal. He can appeal to his heart’s content, but there is not a court in North America that will allow a libel case to proceed where the plaintiff refuses to produce the documents that may show whether the statements made about him were true or false.

In coming days, no doubt we’ll be reading about all the issues on which David Koch, his brother and their comrades in arms have exerted influence for their benefit and at the expense of ordinary people. Let’s not overlook that the financial machine they created also prompted the creation of a financial machine in opposition to their interests. The total effect is to create an electoral system awash with self-interested money, with no countervailing pressure in sight.

We are all paying the price, and will continue to do so into the limitless future.

The Koch brothers’ individual efforts to undermine policies on climate change and other problems are bad enough, but the system they pioneered bodes even worse for the future of American democracy. And let’s not ignore that this system has spread throughout American politics, with huge funding networks on the right and the left.

Conservative firebrand former Illinois Rep. Joe Walsh announced Sunday with ABC News Chief Anchor George Stephanopoulos on ABC's "This Week" that he's launching a long-shot Republican presidential primary challenge against President Donald Trump.

"I'm going to run for president," Walsh told Stephanopoulos in an exclusive interview.

When Stephanopoulos pointed out the massive uphill climb Walsh has in front of him in the primary thanks to Trump's overwhelmingly high approval rating within the party, the controversial former congressman argued that conservatives don't have an alternative to the president.

"I'm running because he's unfit; somebody needs to step up and there needs to be an alternative. The country is sick of this guy's tantrum -- he's a child," Walsh said.

And despite what his enablers claim, Mr. Trump isn’t a conservative. He’s reckless on fiscal issues; he’s incompetent on the border; he’s clueless on trade; he misunderstands executive power; and he subverts the rule of law. It’s his poor record that makes him most worthy of a primary challenge.

Mr. Trump has taken the legitimate differences that Americans have on policy and turned them into personal division. He’s caused me to change my tone and to reflect upon where I went over the line and to focus on policy differences moving forward.

We now have a president who retweets conspiracy theories implicating his political opponents in Jeffrey Epstein’s death. We now have a president who does his level best to avoid condemning white supremacy and white nationalism.

You can't put that in a law because Supreme Court will say it unconstitutionally vague and the decision would be unanimous.

You would have to list what "feature" makes it an assault weapon.

Compare and contrast the Remington model 7400 deer rifle with the A/R 15.

Both have a pistol grip, both are semiautomatic with a clip magazine, but the Remington uses a large caliber bullet.

Which one is the assault rifle?

Only a few stories noted that in 2015 David Koch donated $159 million to Sloan Kettering, thus plausibly salvaging the life of one of the left’s hoariest icons.
